A couple lived together from 1983, ran a joint money-lending business, married only in 1997 and divorced in 2001. Two plots that came to the man through the business, from loans and mortgages he made, sat in his sole name, and both lower courts called them his separate property because they pre-dated the marriage. In Dika 97\/2569<\/b> the Supreme Court changed the judgment on those two plots: land acquired through the couple’s joint effort during cohabitation is copropri\u00e9t\u00e9 \u00e0 parts \u00e9gales<\/b> conform\u00e9ment aux r\u00e8gles de copropri\u00e9t\u00e9 (le jugement ne cite pas de num\u00e9ros de section), le mariage ult\u00e9rieur ne change pas cela, et l\u2019homme doit l'inscrire comme co-propri\u00e9taire<\/b>.<\/p>\n

Thai law has no common-law marriage (s.1457<\/b>), so an unmarried partner gets no sin somros<\/i> presumption and must prove joint acquisition. Here, years of business records did it. For foreigners the extra catch is the Land Code: a foreign partner’s remedy over land is money or a registered usufruct, not a name on the deed.<\/p>\n
