The Supreme Court ruled the buyer qualifies as a “personne intéressée” au sens de l'article 50 of the Act, as amended in B.E. 2565, and may petition for protection of those funds, even though the amendment took effect after the original petition, because a provision that creates a right applies back to the date of the petition.
