Dans Dika 2984\/2569<\/b> la Cour supr\u00eame a jug\u00e9 qu'un enfant reconnu par le p\u00e8re a qualit\u00e9 pour agir, en tant qu'h\u00e9ritier l\u00e9gal de celui-ci en vertu de Articles 1627 et 1629 du CCC<\/b>, pour demander au tribunal, en vertu de l\u2019 article 1497<\/b> de d\u00e9clarer nulle le mariage ult\u00e9rieur du p\u00e8re, enregistr\u00e9e en 1986 alors que son pr\u00e9c\u00e9dent mariage \u00e9tait encore valide, en violation de article 1452<\/b>. Elle a infirm\u00e9 la d\u00e9cision de la Cour d\u2019appel et a r\u00e9tabli le jugement de premi\u00e8re instance d\u00e9clarant le mariage nul. Un \u201c conjoint survivant \u201d nul aurait autrement r\u00e9duit la part de l\u2019enfant dans l\u2019h\u00e9ritage.<\/p>\n
