Renaming the claim did not help: the issue it raised fell within the issues already decided about that policy. <b>Consumer Case Procedure Act B.E. 2551 s.7<\/b> applies the ordinary Code to consumer cases, so the friendlier forum gave the insurer no relief.<\/p>\n<p>The lesson cuts both ways. The insurer was the defendant in the first case, so its deductible claim had to be raised there, by counterclaim, or not at all. Whichever side you are on, bring every claim arising from the same contract in the first case.
