He appealed on <b>questions of fact<\/b> after the trial judge granted permission. The Court of Appeal Region 2 held the permission procedurally defective and rejected the appeal.<\/p>\n<p><b>Dika 1461\/2569<\/b> reversed and remanded. Because the <b>Act on the Establishment of Kwaeng Courts B.E. 2499<\/b> (ss.4, 22, 22 bis) sets out no procedure for requesting that permission, <b>Civil Procedure Code s.224 para 3<\/b> applies so far as applicable. A trial judge who sees an important issue and then certifies the appeal is exercising a lawful discretion.
