C'est le seul instrument que la loi tha\u00eflandaise offre pour d\u00e9roger aux r\u00e8gles par d\u00e9faut en mati\u00e8re de <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/marital-property\/\">sin somros<\/a> et sin suan tua. L'accord doit \u00eatre r\u00e9dig\u00e9 par \u00e9crit, sign\u00e9 par les deux futurs \u00e9poux et au moins deux t\u00e9moins, et enregistr\u00e9 avec le mariage au bureau de district (amphur), o\u00f9 il est not\u00e9 sur le registre des mariages (Kor Ror 2). Un accord sign\u00e9 des semaines plus t\u00f4t mais non pr\u00e9sent\u00e9 lors de l'enregistrement du mariage est nul. Un texte en tha\u00ef est d\u00e9pos\u00e9 ; les couples pr\u00e9parent g\u00e9n\u00e9ralement une version bilingue \u00e0 l'avance plut\u00f4t que de s'en remettre \u00e0 une traduction effectu\u00e9e au guichet.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>l\u2019article 1465<\/strong> limite le contenu. L'accord porte uniquement sur les biens. Les clauses relatives \u00e0 la fid\u00e9lit\u00e9, aux t\u00e2ches m\u00e9nag\u00e8res ou au comportement n'y ont pas leur place, et une clause soumettant les relations patrimoniales des \u00e9poux \u00e0 une loi \u00e9trang\u00e8re est nulle, bien que seule la clause litigieuse soit r\u00e9put\u00e9e non \u00e9crite. Une fois enregistr\u00e9, <strong>Article 1467<\/strong> emp\u00eache toute modification sauf autorisation judiciaire. Les accords sign\u00e9s apr\u00e8s le mariage sont d'une autre nature : en vertu de l'article 1469, l'un ou l'autre des conjoints peut les annuler \u00e0 sa guise pendant le mariage ou dans l'ann\u00e9e suivant sa fin, c'est pourquoi un <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/postnuptial-agreement\/\">contrat postnuptial<\/a> offre une protection bien plus faible.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"practical-points-for-a-foreigner-marrying-in-thailand\">Points pratiques pour un \u00e9tranger se mariant en Tha\u00eflande<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>L'accord est sign\u00e9 avant la date du mariage et apport\u00e9 \u00e0 l'amphur avec les passeports, l'ambassade <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/affirmation-of-freedom-to-marry\/\">affirmation de la libert\u00e9 de se marier<\/a> et sa traduction asserment\u00e9e. Certains bureaux d'arrondissement souhaitent voir le texte quelques jours \u00e0 l'avance pour que l'officier de l'\u00e9tat civil puisse le v\u00e9rifier. Un calendrier r\u00e9aliste, de la premi\u00e8re instruction \u00e0 l'enregistrement, est de deux \u00e0 trois semaines, compressible \u00e0 environ une semaine dans les cas urgents.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>Les erreurs habituelles<\/strong> signent sans deux t\u00e9moins, se pr\u00e9sentent \u00e0 l'amphur sans le texte en tha\u00ef, ajoutent une clause de loi applicable copi\u00e9e d'un mod\u00e8le \u00e9tranger et tentent de modifier les termes apr\u00e8s le mariage par accord priv\u00e9. Les couples ayant des actifs \u00e0 l'\u00e9tranger ont souvent besoin d'un second instrument coordonn\u00e9 selon la loi de leur pays d'origine, car l'enregistrement tha\u00eflandais ne garantit pas \u00e0 lui seul l'ex\u00e9cution en Angleterre, en Australie ou aux \u00c9tats-Unis ; voir le guide sur <a href=\"https:\/\/www.thailawonline.com\/fr\/will-a-thai-prenuptial-agreement-hold-up\/\">si un accord pr\u00e9nuptial tha\u00eflandais est valable \u00e0 l'\u00e9tranger<\/a>.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"what-the-agreement-changes-at-divorce\">Ce que l'accord change en cas de divorce<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>Sans accord, les biens acquis pendant le mariage sont des sin somros et sont partag\u00e9s \u00e0 parts \u00e9gales en vertu de l'article 1533 en cas de divorce, tandis que les biens poss\u00e9d\u00e9s avant le mariage, ainsi que les successions et <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/gift\/\">dons<\/a> re\u00e7u pendant celui-ci, restent sin suan tua en vertu de l'article 1471. Un accord pr\u00e9nuptial permet aux \u00e9poux de redessiner ces limites : les salaires, une entreprise ou un condominium sp\u00e9cifique peuvent \u00eatre conserv\u00e9s comme biens personnels, ou un seul \u00e9poux peut se voir confier la gestion exclusive de certains actifs.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>Il ne peut pas trancher la question de la <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/child-custody\/\">garde<\/a>, child support or spousal maintenance, which the court assesses at the time of the divorce, and under Section 1468 its terms do not affect the rights of third parties acting in good faith. N'importe quel couple enregistrant un mariage en Tha\u00eflande, qu'il soit compos\u00e9 de deux \u00e9trangers ou d'un Tha\u00eflandais et d'un \u00e9tranger, peut enregistrer un contrat de mariage en m\u00eame temps. L'article 1466 du Code civil et commercial rend nul tout contrat de mariage non enregistr\u00e9. Un accord sign\u00e9 apr\u00e8s le mariage est trait\u00e9 comme un accord entre \u00e9poux en vertu de l'article 1469 et peut \u00eatre annul\u00e9 par l'un ou l'autre des \u00e9poux \u00e0 tout moment pendant le mariage ou dans l'ann\u00e9e suivant sa fin.<\/p>\n\n<\/div>\n<\/div>\n<div id=\"faq-question-3\" class=\"rank-math-list-item\">\n<h3 class=\"rank-math-question\">Un accord pr\u00e9nuptial tha\u00eflandais peut-il choisir une loi \u00e9trang\u00e8re ?<\/h3>\n<div class=\"rank-math-answer\">\n\n<p>Non. L'article 1465 dispose qu'une clause soumettant le r\u00e9gime matrimonial des \u00e9poux \u00e0 la loi d'un autre pays est nulle.
