It is not a title deed. The land remains State land, the allotment can be used only for agriculture, and it cannot be sold, mortgaged or transferred except by inheritance to a statutory heir or by a transfer to a farmers&#8217; institution or to the Agricultural Land Reform Office itself (section 39). It is land taken into the agricultural land reform programme, either State land or private land bought by the State, and allotted to qualifying farmers. The Agricultural Land Reform Office, not the Department of Lands, issues the \u0e2a.\u0e1b.\u0e01. 4-01 document and keeps the register. Section 39 of the Act prohibits the allottee from transferring the right to anyone else; the only exceptions are inheritance by a statutory heir and a transfer to a farmers&#8217; institution or to ALRO for land reform purposes. The <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/supreme-court-dika\/\">Cour supr\u00eame<\/a> applies it strictly: a divorce memorandum giving Sor Por Kor land to a foreign spouse is void (Decision 679\/2558, an Italian husband), and so is a will leaving the land to someone other than a statutory heir (Decision 6527\/2561).<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>L'utilisation est restreinte ainsi que le transfert.<\/strong> L'attribution est destin\u00e9e \u00e0 l'agriculture. Construire un complexe h\u00f4telier, un logement <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/estate\/\">domaine<\/a> or a second home on it breaches the conditions and can lead ALRO to revoke the allotment and recover the land, as it has done with resorts built on reform land in areas such as Khao Yai.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"why-foreigners-keep-meeting-sor-por-kor-land\">Pourquoi les \u00e9trangers continuent-ils de se procurer des terres Sor Por Kor<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>Les terrains Sor Por Kor sont vastes, pittoresques et bon march\u00e9, ce qui explique exactement pourquoi ils sont propos\u00e9s aux \u00e9trangers pour des villas et des fermes, souvent avec un \u201c bail \u201d de 30 ans ou une soci\u00e9t\u00e9 tha\u00eflandaise comme montage. Rien de tout cela ne fonctionne. Le <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/land-office\/\">Bureau foncier<\/a> impossible d'enregistrer un bail, un usufruit, <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/superficies-right\/\">superficie<\/a> ou d'hypoth\u00e8que sur des terres Sor Por Kor puisqu'il n'y a pas de titre foncier \u00e0 enregistrer, le contrat de l'\u00e9tranger est donc un document priv\u00e9 sans effet sur le terrain. Si l'acheteur construit une maison, celle-ci se trouve sur un terrain de l'\u00c9tat en violation de l'attribution et sa d\u00e9molition peut \u00eatre ordonn\u00e9e.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>V\u00e9rifiez le haut du document, pas l'histoire du vendeur.<\/strong> Un formulaire Sor Por Kor 4-01 porte la mention du Bureau de la r\u00e9forme agraire en-t\u00eate et ne comporte pas de Garuda rouge ou vert. Tout achat, bail ou investissement le concernant doit \u00eatre refus\u00e9, quel qu'en soit le prix. La conversion maintient la condition d'exploitation agricole et l'interdiction de transfert \u00e0 des non-agriculteurs, de sorte qu'une parcelle convertie reste inaccessible \u00e0 un \u00e9tranger ou \u00e0 une entreprise contr\u00f4l\u00e9e par des \u00e9trangers. Une vente d\u00e9guis\u00e9e \u00e0 un \u00e9tranger, par l'interm\u00e9diaire d'un conjoint tha\u00eflandais, d'un pr\u00eate-nom ou d'une soci\u00e9t\u00e9, est nulle, et l'\u00c9tat peut r\u00e9cup\u00e9rer la parcelle sans indemniser l'\u00e9tranger. Le Bureau foncier ne dispose d'aucun titre \u00e0 enregistrer, de sorte qu'aucun bail, usufruit ou droit de superficie ne peut \u00eatre enregistr\u00e9, et un contrat priv\u00e9 ne conf\u00e8re \u00e0 l'\u00e9tranger aucun droit ex\u00e9cutoire sur le terrain. Le r\u00e9cent syst\u00e8me de \u00ab chanote \u00bb agricole permet \u00e0 l'agriculteur d'emprunter sur la parcelle, mais la terre reste soumise \u00e0 la condition d'exploitation agricole et \u00e0 l'interdiction de transfert \u00e0 des non-agriculteurs. Elle ne devient pas un terrain en pleine propri\u00e9t\u00e9 ordinaire qu'une entreprise tha\u00eflandaise ou le conjoint d'un \u00e9tranger peut acheter.<\/p>\n\n<\/div>\n<\/div>\n<div id=\"faq-question-3\" class=\"rank-math-list-item\">\n<h3 class=\"rank-math-question\">Quelle est la diff\u00e9rence entre le Sor Por Kor et le Por Bor Tor 5 ?<\/h3>\n<div class=\"rank-math-answer\">\n\n<p>Le Sor Por Kor 4-01 est une attribution de terres domaniales \u00e0 un agriculteur, d\u00e9livr\u00e9e par le Bureau de la r\u00e9forme agraire. Le Por Bor Tor 5 est simplement un re\u00e7u fiscal local indiquant qu'une personne a pay\u00e9 un imp\u00f4t foncier sur une parcelle.
