Clarification concernant la politique r\u00e9cente<\/strong><\/h3>\n<p>Suite \u00e0 la r\u00e9cente confusion, le gouvernement tha\u00eflandais a apport\u00e9 des pr\u00e9cisions concernant sa politique de 2022 relative \u00e0 l&#039;acquisition de terrains par des \u00e9trangers en Tha\u00eflande. Cette politique vise principalement \u00e0 attirer des investisseurs \u00e9trangers fortun\u00e9s. Elle stipule que seules les personnes titulaires d&#039;un visa de r\u00e9sident de longue dur\u00e9e (LTR) sont autoris\u00e9es \u00e0 acqu\u00e9rir des terrains.<\/p>\n<p>Auparavant, une annonce autorisant les \u00e9trangers \u00e0 acqu\u00e9rir des maisons et jusqu&#039;\u00e0 un rai (environ 0,6 acre) de terrain moyennant un investissement de 40 millions de bahts a engendr\u00e9 un malentendu. Certains ont interpr\u00e9t\u00e9 cela comme une \u201c\u00a0vente\u00a0\u201d de terres par la Tha\u00eflande. Il est important de noter qu&#039;en principe, l&#039;achat de terres par des \u00e9trangers est interdit en Tha\u00eflande, mais des exceptions existent.<\/p>\n<p>Le porte-parole du gouvernement, Anucha Burapachaisri, a pr\u00e9cis\u00e9 que cette politique n&#039;est pas nouvelle\u00a0; elle a \u00e9t\u00e9 initialement mise en place apr\u00e8s la crise financi\u00e8re de 1997. Sa r\u00e9activation vise \u00e0 attirer les investissements malgr\u00e9 les difficult\u00e9s engendr\u00e9es par la pand\u00e9mie de Covid-19. Cependant, la version actuelle limite l&#039;acc\u00e8s \u00e0 la propri\u00e9t\u00e9 fonci\u00e8re aux personnes titulaires d&#039;un visa LTR. Il est int\u00e9ressant de noter que le visa LTR, tout comme le Sap Ing Sith, sont des lois autorisant les \u00e9trangers \u00e0 acqu\u00e9rir des terres en Tha\u00eflande.<\/p>\n<p>Le gouvernement souhaite apaiser les inqui\u00e9tudes et apporter des \u00e9claircissements aux acteurs locaux et \u00e9trangers. Il pr\u00e9voit d&#039;y parvenir en expliquant l&#039;historique et les raisons qui sous-tendent sa politique. Cette d\u00e9marche contribuera \u00e0 attirer davantage d&#039;investissements \u00e9trangers et t\u00e9moignera de l&#039;engagement du gouvernement \u00e0 soutenir la croissance et la stabilit\u00e9 \u00e9conomiques en cette p\u00e9riode d&#039;incertitude.<\/p>\n<p>Le gouvernement souhaite apaiser les inqui\u00e9tudes et apporter des \u00e9claircissements aux acteurs locaux et \u00e9trangers. Il pr\u00e9voit d&#039;y parvenir en expliquant le contexte et les raisons qui sous-tendent ses d\u00e9cisions politiques. Cette d\u00e9marche contribuera \u00e0 attirer davantage d&#039;investissements \u00e9trangers et t\u00e9moignera de son engagement \u00e0 soutenir la croissance et la stabilit\u00e9 \u00e9conomiques en cette p\u00e9riode d&#039;incertitude.<\/p>\n<h3 class=\"wp-block-heading\" id=\"2-key-points-for-a-foreigner-buying-land-in-thailand\"><strong>2. Points cl\u00e9s pour un \u00e9tranger achetant un terrain en Tha\u00eflande\u00a0:<\/strong><\/h3>\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.thailawonline.com\/fr\/thailand-ltr-visa\/\">Seuls les titulaires de visa LTR<\/a> Il est possible d&#039;acqu\u00e9rir des terrains dans le cadre de cette politique. Un investissement minimum de 40 millions de bahts sur une dur\u00e9e minimale de trois ans est requis. La politique est applicable pendant cinq ans \u00e0 compter de sa publication au Journal officiel. Les acquisitions fonci\u00e8res sont limit\u00e9es \u00e0 Bangkok, Pattaya, aux autres zones municipales et aux zones r\u00e9sidentielles d\u00e9sign\u00e9es. Les \u00e9trangers ne peuvent acqu\u00e9rir qu&#039;un rai de terrain au total, m\u00eame s&#039;ils en revendent des parcelles ult\u00e9rieurement. Le non-respect de ces conditions peut entra\u00eener la r\u00e9vocation des droits fonciers par le D\u00e9partement du cadastre.<\/li>\n<li>Cela figurait autrefois dans un d\u00e9cret tha\u00eflandais et a \u00e9t\u00e9 relanc\u00e9 en 2022 pendant la pand\u00e9mie de COVID-19. Veuillez noter qu&#039;il existe de nombreuses conditions et que, personnellement, je n&#039;ai jamais vu son application depuis que je travaille sous la l\u00e9gislation tha\u00eflandaise (2006). Notez \u00e9galement que d&#039;autres exceptions existent, par exemple en vertu du BOI (Conseil des investissements en Tha\u00eflande) ou de la loi sur le p\u00e9trole. N&#039;oubliez pas non plus\u2026 <a href=\"https:\/\/www.thailawonline.com\/fr\/sap-ing-sith-in-thailand\/\">Sap Ing Sith, qui est la propri\u00e9t\u00e9 du terrain<\/a> Les \u00e9trangers peuvent acqu\u00e9rir des terrains en Tha\u00eflande, mais la dur\u00e9e est limit\u00e9e \u00e0 30 ans, renouvelable.
