In most countries, <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/registered-thai-lawyer\/\">registered lawyers<\/a> must follow their \u201cethical code\u201d and it can apply also outside of their country. An ethical code are some regulations, rules that lawyers must follow and they are in place normally to protect the clients, to protect justice. It a lawyer fail to follow one of these rules, he or she can lose the license to practice law or have other penalties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il existe g\u00e9n\u00e9ralement des comit\u00e9s et\/ou des instances o\u00f9 l&#039;on peut porter plainte contre le comportement d&#039;un avocat. Curieusement, je n&#039;ai quasiment rien trouv\u00e9 \u00e0 ce sujet en anglais avant de traduire et de compiler les textes ci-dessous, qui sont d&#039;ailleurs assez superficiels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br\/>Les avocats tha\u00eflandais ne font pas exception, mais les r\u00e8gles y sont simples, concises et peu d\u00e9taill\u00e9es. Nous avons fait un\u00a0<strong>NON OFFICIEL<\/strong>\u00a0translation of these \u201cEthical Code for Thai lawyers\u201d. The translation was very difficult and we hope you will understand most of this text. Our goal is only to inform and please read the disclaimer below this page. These were still valid in 2011 and I am pretty sure nothing has changed in 2023.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ethical-code-for-thai-lawyers\">CODE DE D\u00c9ONTOLOGIE DES AVOCATS THA\u00cfLANDAIS<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.thailawonline.com\/fr\/ethical-code-for-thai-lawyers\/\" rel=\"noreferrer noopener\" target=\"_blank\">https:\/\/www.thailawonline.com\/documents\/Ethical%20Code%20Lawyers%20Thailand.pdf<\/a> (en tha\u00ef)<\/li>\n\n<li><a href=\"https:\/\/www.thailawonline.com\/fr\/documents\/Ethic%20regulations%20for%20lawyers%20in%20Thailand.pdf\/\" rel=\"noreferrer noopener\" target=\"_blank\">R\u00e8gles d\u00e9ontologiques des avocats tha\u00eflandais (en anglais). R\u00e8glement de 1986<\/a>\u00a0(m\u00eame document que pr\u00e9c\u00e9demment, avec une traduction non officielle)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Registered foreign attorneys must follow the rules of their own legal association, and normally even if they work abroad, they are subjects to the rules of their own country. But many foreign \u201clawyers\u201d in Thailand are not lawyers and do not have a license to practice law. Even if a foreign lawyer is registered in his own country,, he can normally not plead in Court in Thailand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Foreigners are restricted by law to be \u201cattorneys\u201d. That doesn\u2019t mean they are not qualify and can\u2019t work for a law firm. Any international law firm in Thailand do employ foreign attorneys, from Tilleke Gibbins, to Baker Mackenzie or ThaiLawOnline.. Yes, I know, we are way smaller than these 2 others! But we try to maintain high quality legal services.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"two-organisations\">Deux organisations<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">e Thailand Lawyer\u2019s Council (TLC) and the Thai Bar Association (TBA) are two professional organizations for lawyers in Thailand. The TLC is an independent body that regulates the legal profession, while the TBA is a professional organization that represents the interests of lawyers. That is the problem: Should a Bar Association represent the best interests of the lawyers or the best interest of the public? Well, not everyone follow their Ethical Code for Thai lawyers. But this is crucial.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"a-tlc\">a) TLC<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>La TLC a \u00e9t\u00e9 cr\u00e9\u00e9e en 1979 par le Parlement tha\u00eflandais.<\/strong>\u00a0It is responsible for regulating the legal profession, including reviewing applications for admission to the bar, maintaining the discipline of lawyers, and managing the lawyers\u2019 compensation fund. The TLC is composed of a president, two vice presidents, and nine members, all of whom are lawyers appointed by the Parliament.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"b-tba\">b) \u00c0 d\u00e9terminer<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>L&#039;Association du Barreau tha\u00eflandais (TBA) a \u00e9t\u00e9 fond\u00e9e en 1927 par un groupe d&#039;avocats tha\u00eflandais.<\/strong>\u00a0Il s&#039;agit d&#039;une organisation professionnelle qui repr\u00e9sente les int\u00e9r\u00eats des avocats, notamment en d\u00e9fendant leurs droits, en offrant des services de formation et de perfectionnement professionnels et en promouvant l&#039;excellence juridique. L&#039;Association du Barreau du Texas (ABT) est compos\u00e9e d&#039;un pr\u00e9sident, de deux vice-pr\u00e9sidents et de 50 membres, tous avocats \u00e9lus par les membres de l&#039;ABT.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le Conseil du barreau tha\u00eflandais (TLC) et l&#039;Association du barreau tha\u00eflandais (TBA) collaborent pour promouvoir la profession juridique en Tha\u00eflande. Cependant, leurs r\u00f4les sont distincts. They do not have normally <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/escrow\/\">escrow<\/a> accounts. These practices were established a long time ago abroad to protect the public. There are still a lot to do in Thailand, to follow the Ethical Code for Thai lawyers.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ethical-rules-from-abroad-for-foreign-lawyers-apply-even-if-they-work-in-thailand\">Les r\u00e8gles d\u00e9ontologiques internationales s&#039;appliquent aux avocats \u00e9trangers, m\u00eame s&#039;ils travaillent en Tha\u00eflande.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If a foreign lawyer acts unethically in Thailand, you can file a complaint with their bar association. Lawyers\u2019 ethical codes usually apply everywhere they practice, whether they\u2019re acting as an attorney or if they violate any rules through their behavior.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When someone uses titles like \u201clegal advisor,\u201d \u201clegal consultant,\u201d or \u201c<a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/director\/\">directeur<\/a> of X,\u201d they often are not an \u201cattorney,\u201d \u201clawyer,\u201d or \u201cbarrister.\u201d It\u2019s important to ask for their qualifications, experience, and references. Remember, only Thai nationals have been allowed to become attorneys in Thailand since around 1970. Genuine attorneys will not hesitate to share their legal status, education, and can easily provide their license number. You can also check their status with their Bar Association in Thailand or abroad if you wish.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"foreign-attorneys-must-follow-their-ethical-code\">Les avocats \u00e9trangers doivent respecter leur code de d\u00e9ontologie.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Pour ma part, j&#039;\u00e9tais membre du Barreau du Qu\u00e9bec, mais j&#039;ai choisi de d\u00e9missionner il y a quelques ann\u00e9es. Pourquoi ? Je payais 1\u00a0402\u00a0000 $ de cotisation annuelle sans aucun avantage en retour. De plus, on m&#039;obligeait \u00e0 suivre 30 heures de formation continue sur le droit qu\u00e9b\u00e9cois tous les deux ans, alors que j&#039;avais v\u00e9cu et travaill\u00e9 en Asie pendant plus de 10 ans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Leaving the bar was a better decision for me. However, I continuously learn about Thai law and strive to improve my knowledge and skills, as any lawyer should. I\u2019ve never been investigated for failing to follow an ethical rule. If your Thai lawyer doesn\u2019t do the work properly, do not hesitate to make a complaint to his Bar Association.
