Dans la plupart des pays, <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/registered-thai-lawyer\/\">avocats inscrits<\/a> doit respecter son \u201c code \u00e9thique \u201d, et cela peut \u00e9galement s'appliquer en dehors de son pays. Un code \u00e9thique regroupe des r\u00e9glementations et des r\u00e8gles que les avocats doivent suivre, et il est g\u00e9n\u00e9ralement mis en place pour prot\u00e9ger les clients et la justice. Si un avocat ne respecte pas l'une de ces r\u00e8gles, il ou elle peut perdre sa licence pour exercer le droit ou encourir d'autres sanctions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il existe g\u00e9n\u00e9ralement des comit\u00e9s et\/ou des instances o\u00f9 l&#039;on peut porter plainte contre le comportement d&#039;un avocat. Curieusement, je n&#039;ai quasiment rien trouv\u00e9 \u00e0 ce sujet en anglais avant de traduire et de compiler les textes ci-dessous, qui sont d&#039;ailleurs assez superficiels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br\/>Les avocats tha\u00eflandais ne font pas exception, mais les r\u00e8gles y sont simples, concises et peu d\u00e9taill\u00e9es. Nous avons fait un\u00a0<strong>NON OFFICIEL<\/strong>\u00a0translation of these \u201cEthical Code for Thai lawyers\u201d. The translation was very difficult and we hope you will understand most of this text. Our goal is only to inform and please read the disclaimer below this page. The 1986 rules are still the ones in force. The Lawyers Council has amended them twice, and both times only on court dress: regulation No. 2 of B.E. 2566 (Royal Gazette, 27 June 2023) rewrote the dress rule for women lawyers in clause 20(2), and regulation No. 3 of B.E. 2568 added dress rules for lawyers whose gender identity differs from their sex at birth.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ethical-code-for-thai-lawyers\">CODE DE D\u00c9ONTOLOGIE DES AVOCATS THA\u00cfLANDAIS<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.thailawonline.com\/fr\/documents\/Ethical%20Code%20Lawyers%20Thailand.pdf\/\" rel=\"noreferrer noopener\" target=\"_blank\">Lawyers Council regulation on lawyers&#8217; ethics, B.E. 2529 (1986)<\/a> (en tha\u00ef)<\/li>\n\n<li><a href=\"https:\/\/www.thailawonline.com\/fr\/documents\/Ethic%20regulations%20for%20lawyers%20in%20Thailand.pdf\/\" rel=\"noreferrer noopener\" target=\"_blank\">R\u00e8gles d\u00e9ontologiques des avocats tha\u00eflandais (en anglais). R\u00e8glement de 1986<\/a>\u00a0(m\u00eame document que pr\u00e9c\u00e9demment, avec une traduction non officielle)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Les avocats \u00e9trangers inscrits doivent respecter les r\u00e8gles de leur propre association professionnelle et, en r\u00e8gle g\u00e9n\u00e9rale, m\u00eame s'ils travaillent \u00e0 l'\u00e9tranger, ils sont soumis aux r\u00e8gles de leur pays d'origine. Mais de nombreux \u201c avocats \u201d \u00e9trangers en Tha\u00eflande ne sont pas des avocats et ne poss\u00e8dent pas de licence pour exercer le droit. M\u00eame si un avocat \u00e9tranger est inscrit dans son propre pays, il ne peut g\u00e9n\u00e9ralement pas plaider devant un tribunal en Tha\u00eflande.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi restreint l'acc\u00e8s des \u00e9trangers au titre d\u201c\u201davocat\". Cela ne signifie pas qu'ils ne sont pas qualifi\u00e9s et qu'ils ne peuvent pas travailler pour un cabinet d'avocats. N'importe quel cabinet d'avocats international en Tha\u00eflande emploie des avocats \u00e9trangers, de Tilleke Gibbins \u00e0 Baker Mackenzie en passant par ThaiLawOnline. Oui, je sais, nous sommes bien plus petits que ces deux autres ! Mais nous essayons de maintenir des services juridiques de haute qualit\u00e9.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"two-organisations\">Deux organisations<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The Lawyers Council of Thailand (TLC) and the Thai Bar (TBA, \u0e40\u0e19\u0e15\u0e34\u0e1a\u0e31\u0e13\u0e11\u0e34\u0e15\u0e22\u0e2a\u0e20\u0e32) are the two bodies a Thai lawyer answers to. The TLC licenses lawyers and enforces their ethics; the Thai Bar is the body every applicant for a licence must first join (Lawyers Act B.E. 2528, section 35). That is the problem: Should a Bar Association represent the best interests of the lawyers or the best interest of the public? Well, not everyone follow their Ethical Code for Thai lawyers. But this is crucial.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"a-tlc\">a) TLC<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The TLC was created by the Lawyers Act B.E. 2528 (1985).<\/strong> Section 6 makes it a juristic person made up of its committee and its members, and section 7 gives it its objects, among them controlling lawyers&#8217; ethics and running welfare for its members. It registers and licenses lawyers: section 8(1) gives it that power and duty, and under section 36 the Board accepts the registration and issues the licence once the applicant meets the section 35 qualifications. Its committee is one representative of the Ministry of Justice, one of the Thai Bar, and a president and up to 23 other members elected by lawyers nationwide, at least nine of whom must have offices in the regions (section 14).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"b-tba\">b) \u00c0 d\u00e9terminer<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Thai Bar is older than the Council<\/strong>, and the Lawyers Act treats it as an existing body. Ils n'en ont g\u00e9n\u00e9ralement pas. <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/escrow\/\">compte s\u00e9questre<\/a> comptes. Ces pratiques ont \u00e9t\u00e9 instaur\u00e9es il y a longtemps \u00e0 l'\u00e9tranger pour prot\u00e9ger le public. Il reste encore beaucoup \u00e0 faire en Tha\u00eflande pour respecter le Code de d\u00e9ontologie des avocats tha\u00eflandais.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La derni\u00e8re r\u00e9vision : 25 septembre 2026.<\/strong> The statements of law on this page were checked against the Lawyers Act B.E. 2528 (sections 6, 7, 14, 35 and 37), the Lawyers Council regulation on lawyers&#8217; ethics B.E. 2529, and its amendment No. 2 of B.E. 2566 as published in the Royal Gazette. The author&#8217;s own experience and opinions are his and are not part of that check.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ethical-rules-from-abroad-for-foreign-lawyers-apply-even-if-they-work-in-thailand\">Les r\u00e8gles d\u00e9ontologiques internationales s&#039;appliquent aux avocats \u00e9trangers, m\u00eame s&#039;ils travaillent en Tha\u00eflande.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Si un avocat \u00e9tranger a un comportement contraire \u00e0 l'\u00e9thique en Tha\u00eflande, vous pouvez d\u00e9poser une plainte aupr\u00e8s de son barreau. Les codes de d\u00e9ontologie des avocats s'g\u00e9n\u00e9ralement partout o\u00f9 ils exercent, qu'ils agissent en tant qu'avocats ou qu'ils violent des r\u00e8gles par leur comportement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lorsqu'une personne utilise des titres tels que \u201c conseiller juridique \u201d, \u201c consultant juridique \u201d ou \u201c<a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/director\/\">directeur<\/a> of X,\u201d they often are not an \u201cattorney,\u201d \u201clawyer,\u201d or \u201cbarrister.\u201d It\u2019s important to ask for their qualifications, experience, and references. Remember, only Thai nationals can be licensed as lawyers in Thailand (Lawyers Act B.E. 2528, section 35). Genuine attorneys will not hesitate to share their legal status, education, and can easily provide their license number. You can also check their status with their Bar Association in Thailand or abroad if you wish.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"foreign-attorneys-must-follow-their-ethical-code\">Les avocats \u00e9trangers doivent respecter leur code de d\u00e9ontologie.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As for me, I was admitted to the Bar of Quebec but chose to resign a few years ago. Why? I was paying $2,000 in membership fees per year without receiving anything in return. Moreover, they required me to complete 30 hours of continuing education about Quebec laws every two years, despite my having lived and worked in Asia for over 10 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Quitter le barreau \u00e9tait une meilleure d\u00e9cision pour moi. Cependant, je continue d'apprendre le droit tha\u00eflandais et m'efforce d'am\u00e9liorer mes connaissances et mes comp\u00e9tences, comme tout avocat devrait le faire. Je n'ai jamais fait l'objet d'une enqu\u00eate pour manquement \u00e0 une r\u00e8gle d\u00e9ontologique. Si votre avocat tha\u00eflandais ne fait pas son travail correctement, n'h\u00e9sitez pas \u00e0 porter plainte aupr\u00e8s de son barreau.
