Elle est extr\u00eamement pointilleuse sur la forme. Un testament peut \u00eatre r\u00e9dig\u00e9 \u00e0 la perfecci\u00f3n et \u00eatre tout de m\u00eame nul en raison de la mani\u00e8re dont il a \u00e9t\u00e9 sign\u00e9. En vertu de la <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/thai-civil-and-commercial-code\/\">Code civil et commercial<\/a>, un testament olographe ordinaire n\u00e9cessite tous les \u00e9l\u00e9ments suivants :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00c9criture.<\/strong> Il doit s'agir d'un document \u00e9crit. La loi tha\u00eflandaise ne reconna\u00eet pas un testament vid\u00e9o ou un enregistrement audio comme un testament ordinaire.<\/li>\n\n<li><strong>Un rendez-vous.<\/strong> La date de confection doit figurer sur le document (article 1656). Un testament non dat\u00e9 suscite des contestations quant \u00e0 savoir quel testament est le plus r\u00e9cent.<\/li>\n\n<li><strong>La signature du testateur.<\/strong> Le v\u00f4tre, sur le document.<\/li>\n\n<li><strong>Deux t\u00e9moins, pr\u00e9sents en m\u00eame temps.<\/strong> Vous signez devant eux deux, et tous deux signent ensuite pour certifier votre signature. Les trois signatures appartiennent \u00e0 une seule et m\u00eame s\u00e9ance, en un seul lieu. Un testament sign\u00e9 par fractions est nul et ne peut \u00eatre sauv\u00e9 par la suite.<\/li>\n\n<li><strong>Des t\u00e9moins qui ont qualit\u00e9 pour t\u00e9moigner.<\/strong> Pas une personne mineure ou autrement non <em>sui juris<\/em>, ni une personne interdite ou jug\u00e9e quasi-incomp\u00e9tente, ni une personne sourde, muette ou aveugle (article 1670).<\/li>\n\n<li><strong>T\u00e9moins qui n'h\u00e9ritent pas.<\/strong> A <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/gift\/\">cadeau<\/a> \u00e0 un t\u00e9moin, ou au conjoint d'un t\u00e9moin, est nul (article 1653). Le reste du testament subsiste, mais ce legs est caduc. C'est le d\u00e9faut le plus courant dans les testaments que les expatri\u00e9s r\u00e9digent eux-m\u00eames.<\/li>\n\n<li><strong>Un testateur \u00e2g\u00e9 de 15 ans ou plus.<\/strong> Un testament fait par une personne qui n'a pas accompli sa quinzi\u00e8me ann\u00e9e est nul (article 1703).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Remarquez ce qui est <em>pas<\/em> sur cette liste : un notaire, un avocat, un timbre et l'enregistrement au bureau de district. Aucun d'entre eux n'est requis pour un testament tha\u00eflandais ordinaire. Quiconque vous dit le contraire essaie de vous vendre quelque chose.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"clause-by-clause\">Le mod\u00e8le d'exemple, clause par clause<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le fichier PDF d'exemple ci-dessus comporte douze clauses num\u00e9rot\u00e9es. Voici ce que fait chacune d'elles et pourquoi elle s'y trouve.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Testateur.<\/strong> Identifie-vous : nom, nationalit\u00e9, date de naissance, num\u00e9ro de passeport ou de carte d'identit\u00e9 tha\u00eflandaise, et adresse. La pr\u00e9cision importe car le <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/land-office\/\">Bureau foncier<\/a> et les banques compareront cela avec vos documents des ann\u00e9es plus tard.<\/li>\n\n<li><strong>D\u00e9claration d'intention.<\/strong> D\u00e9clare que ce document est votre dernier testament et r\u00e9voque les pr\u00e9c\u00e9dents. Lisez le <a href=\"https:\/\/www.thailawonline.com\/fr\/thai-will-and-foreign-will\/\">Guide sur les testaments tha\u00eflandais et \u00e9trangers<\/a> avant d'utiliser une clause de r\u00e9vocation large : elle peut accidentellement annuler un testament dans un autre pays.<\/li>\n\n<li><strong>Administration de mon <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/estate\/\">domaine<\/a>.<\/strong> Donnez vos <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/estate-administrator\/\">administrateur de succession<\/a> et d\u00e9finit leurs pouvoirs, notamment le paiement des dettes, des frais fun\u00e9raires et des imp\u00f4ts sur la succession. Le tribunal tha\u00eflandais proc\u00e8de \u00e0 la nomination officielle, mais il nomme normalement la personne que vous avez d\u00e9sign\u00e9e.<\/li>\n\n<li><strong><a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/legatee\/\">L\u00e9gataire<\/a>.<\/strong> Qui re\u00e7oit quoi. Dans l'exemple, l'ensemble du patrimoine est transmis \u00e0 une seule personne ; les testaments r\u00e9els le partagent souvent, et chaque part doit \u00eatre d\u00e9nu\u00e9e d'ambigu\u00eft\u00e9.<\/li>\n\n<li><strong>Gardien du testament.<\/strong> Qui d\u00e9tient l'original ? Il n'existe pas de registre national des testaments en Tha\u00eflande, de sorte qu'un testament qui ne peut \u00eatre produit est un testament qui n'existe pas.<\/li>\n\n<li><strong>Survie des l\u00e9gataires.<\/strong> Que se passe-t-il si un b\u00e9n\u00e9ficiaire d\u00e9c\u00e8de avant vous ? Sans cette clause, cette part revient \u00e0 <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/intestacy\/\">succession ab intestat<\/a> and Thai statutory succession decides it instead of you.<\/li>\n\n<li><strong>Severability.<\/strong> If one clause is struck down, the rest of the will stands.<\/li>\n\n<li><strong>No contest provision.<\/strong> Discourages heirs from challenging the will.<\/li>\n\n<li><strong>Omitted.<\/strong> Confirms that anyone not named was left out deliberately, not by oversight. This closes off a common line of attack.<\/li>\n\n<li><strong>Insufficient estate.<\/strong> How gifts are reduced if the estate cannot cover them all.<\/li>\n\n<li><strong>Interpretation.<\/strong> Singular includes plural, and which language prevails. In a bilingual will this clause is not decorative: Thai courts work in Thai.<\/li>\n\n<li><strong>Capacity of the testator.<\/strong> Your declaration that you are of sound mind and acting freely.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">After the clauses comes the part that decides whether any of it works: the signature page and the witness attestation, where both witnesses write their own name, address and contact details <strong>in their own handwriting<\/strong>. That is not a formality. Years later, a court may need to trace and question those witnesses, and their own handwriting is what makes them traceable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"when-a-template-is-enough\">Quand un mod\u00e8le suffit et quand il ne suffit pas<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A template is genuinely enough when your situation is simple: you are leaving everything to one or two adult people, your assets are a Thai bank account, a condominium and a vehicle, nobody in your family disputes anything, and you have no minor children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A template is <strong>pas<\/strong> enough, and will cost your family far more than a lawyer would have, when any of these is true:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>You own land through a Thai company or a <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/nominee\/\">candidat<\/a> structure.<\/strong> The shares, not the land, are what passes, and the will has to say so correctly.<\/li>\n\n<li><strong>You have minor children.<\/strong> Guardianship and a trust arrangement to a set age need real drafting.<\/li>\n\n<li><strong>You have a will in another country.<\/strong> The two documents must be scoped so they do not revoke each other. See the <a href=\"https:\/\/www.thailawonline.com\/fr\/thai-will-and-foreign-will\/\">conflict of law guide<\/a>.<\/li>\n\n<li><strong>Your family is likely to fight.<\/strong> A previous marriage, an unrecognised partner, estranged children: these are the wills that end up in court, and they are the ones that must be drafted to survive an attack.<\/li>\n\n<li><strong>You want to leave Thai land to a foreigner.<\/strong> A foreign heir can inherit land but generally cannot keep it, and must dispose of it. The will should deal with that explicitly. A gift to a witness or to a witness&#8217;s spouse is void under Section 1653. Neighbours, colleagues and friends who receive nothing are ideal.
