Les ressortissants tha\u00eflandais utilisent le num\u00e9ro \u00e0 13 chiffres de leur carte d'identit\u00e9 ; une entreprise utilise son num\u00e9ro d'enregistrement \u00e0 13 chiffres du <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/dbd\/\">DBD<\/a>; un \u00e9tranger sans num\u00e9ro d'identification tha\u00eflandais doit en faire la demande aupr\u00e8s du D\u00e9partement des revenus. Un individu qui poss\u00e8de d\u00e9j\u00e0 un num\u00e9ro d'identification personnelle en vertu de la loi sur l'\u00e9tat civil, qui couvre les citoyens tha\u00eflandais et les \u00e9trangers titulaires d'une carte d'identit\u00e9 rose ou jaune <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/tabien-baan\/\">tabien baan<\/a>, n'est pas tenu de faire une demande s\u00e9par\u00e9e et utilise ce num\u00e9ro. Un \u00e9tranger pr\u00e9sent en Tha\u00eflande pour une p\u00e9riode ne d\u00e9passant pas 14 jours, et pas plus de 90 jours au total au cours d'une ann\u00e9e fiscale, en est exempt\u00e9.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong><a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/juristic-person\/\">Personnes morales<\/a><\/strong> recevoir leur num\u00e9ro automatiquement : depuis l'unification des registres, le num\u00e9ro d'enregistrement DBD d'une entreprise est son num\u00e9ro d'identification fiscale et appara\u00eet sur son <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/vat\/\">TVA<\/a> enregistrement et factures fiscales. Une entreprise \u00e9trang\u00e8re sans enregistrement en Tha\u00eflande se voit attribuer un num\u00e9ro par le D\u00e9partement des imp\u00f4ts sur demande.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"how-a-foreigner-applies\">Comment un \u00e9tranger postule<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>La demande se fait sur le formulaire L.P. 10.1 (\u0e25.\u0e1b.10.1) pour un particulier, d\u00e9pos\u00e9 dans n'importe quel bureau des imp\u00f4ts de zone ou succursale, ind\u00e9pendamment du lieu de r\u00e9sidence du demandeur. L'agent demande le passeport avec le visa ou la prolongation en cours, ainsi qu'une preuve d'adresse en Tha\u00eflande : un contrat de location, un tabien baan, ou un certificat de mariage avec la carte d'identit\u00e9 du conjoint tha\u00eflandais et son enregistrement de maison. Un employ\u00e9 apporte g\u00e9n\u00e9ralement son permis de travail ; un retrait\u00e9 transf\u00e9rant des revenus \u00e9trangers apporte le contrat de location et, si on le lui demande, un relev\u00e9 bancaire. Il n'y a pas de frais et le num\u00e9ro est normalement d\u00e9livr\u00e9 le jour m\u00eame.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>O\u00f9 il est utilis\u00e9 ensuite : la d\u00e9claration annuelle (PND 90 ou PND 91), d\u00e9pos\u00e9e entre le 1er janvier et le 31 mars pour l'ann\u00e9e civile pr\u00e9c\u00e9dente d\u00e8s que les revenus d\u00e9passent 60 000 bahts (120 000 bahts si le seul revenu est un salaire, et des seuils plus \u00e9lev\u00e9s pour les couples mari\u00e9s) ; un certificat de retenue \u00e0 la source d'un employeur ou d'une banque tha\u00eflandaise ; et le certificat de r\u00e9sidence a <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/tax-resident\/\">r\u00e9sident fiscal<\/a> doit faire valoir les avantages d'une convention fiscale \u00e0 l'\u00e9tranger. L'erreur courante est de demander un num\u00e9ro pour ne jamais d\u00e9poser de d\u00e9claration ensuite.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"thai-tax-id-thai-id-card-and-foreign-tin\">Num\u00e9ro d'identification fiscale tha\u00eflandais, carte d'identit\u00e9 tha\u00eflandaise et NIF \u00e9tranger<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>Le num\u00e9ro de carte d'identit\u00e9 nationale tha\u00eflandaise fait \u00e9galement office de num\u00e9ro d'identification fiscale pour les Tha\u00eflandais et les \u00e9trangers titulaires d'une carte rose ; un \u00e9tranger qui n'en poss\u00e8de pas dispose d'un num\u00e9ro distinct attribu\u00e9 par le d\u00e9partement des recettes (Revenue Department), qui ne conf\u00e8re aucun statut d'immigration. Aucun de ces num\u00e9ros n'est identique au num\u00e9ro fiscal d'origine de l'\u00e9tranger, que les banques tha\u00eflandaises collectent d\u00e9sormais dans le cadre de la Norme commune de d\u00e9claration (CRS) : lorsqu'une banque demande le NIF \u00e9tranger d'un client, elle s'enquiert de sa r\u00e9sidence fiscale \u00e0 l'\u00e9tranger et non d'un num\u00e9ro tha\u00eflandais.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>Avoir un num\u00e9ro d'identification fiscale tha\u00eflandais ne fait de personne un r\u00e9sident fiscal, et ne pas en avoir n'excuse pas l'imp\u00f4t. La r\u00e9sidence est d\u00e9termin\u00e9e par le test des 180 jours de l'article 41 du Code des revenus, et depuis 2024, un r\u00e9sident qui transf\u00e8re <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/foreign-sourced-income\/\">revenus de source \u00e9trang\u00e8re<\/a> doit des imp\u00f4ts sur ce montant, qu'un num\u00e9ro ait \u00e9t\u00e9 attribu\u00e9 ou non.
