fait en Thaïlande ?

For a relationship formed in Thailand, living together does not become a legal marriage after a particular number of years. A traditional wedding, a religious ceremony, shared household expenses or introducing someone as your wife does not replace marriage registration under Section 1457 of the Civil and Commercial Code.

This distinction matters when a bank, court or Land Office asks for evidence of your status. Photographs of a wedding are not a substitute for the relevant civil records.

A marriage celebrated abroad requires a separate analysis. A valid foreign marriage is not necessarily ineffective in Thailand because the couple never held a second registration ceremony here. Applicable conflict-of-law rules, the marriage certificate and evidence of validity must be considered. Our article on foreign marriages recognised in Thailand explains this distinction.

Before making an inheritance plan, establish whether the couple is legally married, where the marriage took place, and whether any earlier marriage was properly dissolved. Using the words “girlfriend” or “wife” informally does not settle the legal question.

Une compagne thaïlandaise hérite-t-elle si son partenaire étranger décède ?

An unmarried partner is not a statutory heir simply because of the relationship. Under Thai intestate succession rules, living together, caring for a partner or sharing expenses does not create a spouse’s inheritance entitlement.

However, saying “the girlfriend gets nothing” without examining the assets is too broad. She might already own part of a lawful jointly acquired asset, hold a debt claim against the estate, or benefit under a valid will. Her existing property is not transformed into the deceased’s property on death.

For example, if an unmarried couple lawfully owns a condominium in equal registered shares, the survivor retains their own half. The deceased’s half must be administered under the relevant succession rules. The survivor does not automatically acquire the other half merely because both names appear on the title.

A valid will gives an unmarried partner a route to inherit. The document must identify the intended beneficiary and dispose of assets belonging to the testator. A will leaving “my house” is inadequate planning if the house belongs to someone else or the land and building have different owners.

For international estates, distinguish Thai immovable property from movable assets. Thai conflict-of-law rules do not necessarily apply the same succession law to every asset merely because the owner lived in Thailand. Coordinate any Thai will with existing foreign wills. See our Guide pour rédiger un testament en Thaïlande.

Une épouse hérite-t-elle de tout en Thaïlande ?

No. Where Thai intestate succession rules apply, a surviving spouse’s inheritance depends on the other surviving heirs. The spouse’s own property must first be separated from the estate.

Diviser la propriété conjugale avant de calculer l’héritage

On death, the marital-property relationship must be settled under Section 1625 and the relevant family-law provisions. The surviving spouse’s own share is not an inheritance from the deceased. The deceased’s share, together with their separate property, forms the estate, subject to liabilities and other applicable claims.

Consider an illustration involving only a debt-free cash fund of 6 million baht, all established as marital property. There is no will, no prenup changing the result, two surviving children and no surviving parents of the deceased.

The survivor first retains 3 million baht as their own marital-property share. The remaining 3 million baht is divided between the spouse and two children, giving each 1 million baht. The spouse therefore receives 4 million baht overall, but only 1 million baht came through inheritance.

This example does pas establish a foreign spouse’s entitlement to half of land purchased as the Thai spouse’s separate property. The classification of each asset comes first.

La part du conjoint sans testament

Other heirs entitled to inherit

Surviving spouse’s share of the estate

Descendance

A share equivalent to a child’s share, with representation rules where relevant

No descendants, but surviving parent or parents

Une moitié

No descendants or parents, but full-blood siblings or their qualifying representatives

Une moitié

The applicable class consists of half-blood siblings, grandparents, or uncles and aunts

Deux tiers

No other statutory heirs

Toute la succession

These fractions come from Article 1635. There is a frequently missed exception to the usual order of heirs: surviving parents also inherit alongside descendants under Article 1630. Do not calculate an estate from the number of children alone.

Un testament valide change la répartition des biens

The table describes intestate succession. Thai law permits disinheritance and testamentary distribution under Article 1608. Do not describe the spouse’s intestate fraction as an untouchable minimum under every valid will.

The deceased still cannot give away property belonging to the survivor. A will and a marital-property claim therefore answer different questions.

Que se passe-t-il si votre petite amie ou votre épouse thaïlandaise meurt en possédant des terres ?

Start with whether you inherit at all. Then examine whether you are legally entitled to retain the land.

An unmarried foreign partner has no statutory entitlement based solely on the relationship. A legally recognised foreign spouse is a statutory heir, although a valid will and competing heirs affect the distribution. Neither position automatically produces unrestricted foreign land ownership.

Article 93 et autorisation d’acquérir des terres héritées

Section 93 addresses a foreigner inheriting as a statutory heir and provides for ministerial permission, subject to the land limits in Section 87. Being named in a will alone does not make an unrelated boyfriend or girlfriend a statutory heir for this purpose.

The provision is not a promise of approval. Before relying on retention, obtain a case-specific assessment of the legal route and the competent Land Office’s requirements. A marriage certificate or estate-administrator appointment does not itself supply landholding permission.

Article 94 et démolition des terrains

Where foreign acquisition is unlawful or lacks the required permission, Section 94 provides for disposal within a period fixed by the Director-General: at least 180 days and no more than one year. Failure to dispose within the prescribed period gives the Director-General authority to arrange disposal.

Do not turn this into a universal statement that every foreign heir has exactly one year from the date of death. Identify the applicable procedure, notice and deadline for the estate. The statutory provisions appear in Chapitre 8 du Code foncier thaïlandais. More info on the Department of Lands in Thailand official website.

Planifier le résultat financier ainsi que le terrain

For a couple whose objective is financial support for the survivor, a will directing an authorised estate sale and distribution of net proceeds deserves consideration. Such a plan should address the administrator’s powers, estate debts, sale expenses, other beneficiaries and the treatment of any registered occupation rights.

For a couple whose objective is keeping the survivor in the home, a cash inheritance alone is insufficient. The survivor also needs an enforceable basis for occupation. A purchaser considering land subject to an existing registered right will assess both the title and the practical ability to use the property, which affects the sale process and price.

Discuss these objectives together. “Leave everything to my partner” does not explain how the administrator should handle a home the partner cannot lawfully retain as landowner.

Votre petite amie ou épouse thaïlandaise peut-elle vendre le terrain sans votre permission ?

The answer depends on ownership, property classification and registered rights.

Terres appartenant à un partenaire non marié

If your girlfriend owns the land, your relationship does not give you a spouse’s consent right. Paying household bills or keeping the original title deed at home does not create a registered interest.

A claimed contribution, loan or ownership interest must be assessed on its own legal basis and evidence. Sending money proves a payment. The payment alone does not establish whether the money was a gift, loan, building contribution or part of another arrangement.

Terres appartenant à un conjoint

Section 1476 requires joint management or spousal consent for specified dealings in marital property, including the sale or mortgage of immovable property. However, a spouse’s separate property falls under different management rules.

Mixed Thai and foreign couples must pay particular attention to the confirmation signed when the Thai spouse acquires land. A declaration recording the purchase funds as the Thai spouse’s separate property has consequences. Do not sign on the assumption that marriage still guarantees a half share or a veto over every future sale. Read our explanation of the confirmation letter for a Thai spouse’s land purchase.

Where a transaction needed consent but proceeded without it, Section 1480 provides a possible annulment remedy. Ratification, good-faith acquisition for value and limitation periods matter. The provision includes a one-year period from knowledge of the ground for revocation and an outer ten-year limit from the transaction. See Article 1480.

Un droit enregistré est différent d’un droit d’empêcher toute vente.

A registered usufruct or another enforceable interest might continue after ownership changes. This does not necessarily give its holder an absolute veto over selling the underlying title. The distinction is whether the buyer takes the property subject to the right, rather than whether a sale is impossible.

Registration priority and existing mortgages require attention. A later right should never be presented as automatically defeating an earlier secured creditor or every enforcement sale.

Et si vous aviez payé la maison au nom de votre petite amie ?

First separate the land from the building. Foreign land restrictions do not automatically prohibit ownership of a building, but paying construction costs does not, by itself, complete the legal arrangements for separate building ownership and occupation of the site.

Review the title, construction agreement, building documentation, payment records and any registered superficies, lease or other right. A house registration book records administrative information; its entries should not be treated as conclusive proof of ownership.

If the money was intended as a loan, the evidence should match the arrangement from the beginning. If the money was a gift, a later breakup does not automatically turn the gift into a repayable debt. A claim for repayment, unjust enrichment or a share of a lawful asset requires the correct legal basis, supporting evidence and attention to prescription.

Do not use an agreement saying a Thai partner secretly holds land “for” the foreigner as a substitute for lawful ownership. A nominee arrangement creates a separate land-law problem and exposes the parties to enforcement risks.

Before transferring substantial funds, decide precisely what the payer will receive: a lawful ownership share, a genuine debt claim, a registered right to occupy, or a gift with no repayment obligation. Those choices have very different consequences after separation or death.

Comment protéger un partenaire ou un conjoint non marié en Thaïlande

Faire des testaments séparés pour les deux partenaires

Estate planning should work in both directions. The foreign partner’s will addresses their estate. The Thai partner’s will addresses the assets belonging to the Thai partner. One person cannot dispose of the other’s property.

For an ordinary written will under Section 1656, the signing formalities require close attention, including the testator signing before at least two witnesses present together and the witnesses signing then to certify the signature. Use eligible, independent witnesses. Beneficiaries and the spouses of beneficiaries should not act as witnesses to their gifts.

Identify substitute beneficiaries and an appropriate administrator, explain the intended treatment of land, and coordinate the document with foreign wills. A broad revocation clause in a new Thai will must not accidentally revoke a carefully prepared overseas estate plan.

Keep the original accessible and tell the intended administrator where to find it. A good document is of limited practical use when nobody knows the document exists. Our Thai will drafting guide explains the available forms and preparation process.

Dénoncer un usufruit lorsque l’utilisation à vie est l’objectif

A usufruct gives its holder rights to possess, use and enjoy another person’s property within the registered terms and the law. For a foreign resident concerned about remaining in a home, a properly registered lifetime usufruct deserves consideration.

Whose death matters? A usufruct ends when the usufructuary, the holder of the right, dies. The landowner’s death does not, by itself, extinguish a valid lifetime usufruct held by someone still alive. The owner’s heirs normally receive land subject to the continuing right. Article 1418 addresses duration and termination on the holder’s death.

A usufruct does not transfer land ownership to the foreigner and does not pass to the foreigner’s children. Review existing charges, the intended use, expenses and maintenance obligations before choosing the arrangement. Further details appear in our guide sur les accords d'usufruit.

Considérer un bail enregistré pour une période déterminée

A lease is appropriate where the parties want occupation for an agreed term with defined rental and contractual obligations. Under the ordinary Civil and Commercial Code rules, a lease exceeding three years must meet the registration requirements to be enforceable beyond three years, and an ordinary immovable-property lease is generally limited to thirty years per term.

Do not advertise successive renewal promises as a guaranteed registered ninety-year interest. Renewal, transfer and succession clauses need careful drafting. In particular, the lessor’s death and the lessee’s death raise different questions. A lease should not be described as automatically inheritable simply because the document states a long term.

Lisez notre guide to lease agreements in Thailand before paying for a long lease or relying on a renewal promise.

Envisager un droit de superficie pour un bâtiment détenu séparément du terrain

Superficies is relevant where the objective is a right to own a building or structure on someone else’s land. Proper registration and the relationship between the building, land use and duration need to be addressed together.

Unlike a usufruct, a right of superficies is generally transferable and transmissible by inheritance unless the creating instrument provides otherwise. Its agreed duration remains critical: a right expiring on the holder’s death cannot provide a remaining term for heirs.

This makes superficies in Thailand worth considering when a couple wants both residential protection and an arrangement addressing the building after a death. The Land Office must be able to register the proposed structure against the particular title and facts.

Registrer les prêts réels et la propriété partagée légale

Where repayment is intended, document a real loan and preserve the banking evidence. A properly registered mortgage securing a genuine debt offers different protection from an unsecured promise, but the collateral, priority, interest and enforcement terms require review. A mortgage does not turn a foreign lender into an unrestricted landowner after default.

For assets foreigners are entitled to own, record ownership shares clearly. A condominium, vehicle, bank balance and company shares each require their own transfer and ownership analysis. A general “everything belongs to both of us” agreement is a poor substitute for identifying the asset and the intended rights.

Organiser le contrat de mariage avant l’enregistrement du mariage

A prenuptial agreement helps identify separate property and organise the marital-property relationship. Compliance with the registration formalities at the time of marriage is essential. Signing a document later and calling the document a prenup does not achieve the same result.

A prenup neither grants foreign land ownership nor replaces a will. See our prenuptial agreement service and guide.

Revoir les accords conclus entre les époux pendant le mariage

Section 1469 permits avoidance of qualifying property agreements made between spouses during marriage, during the marriage or within one year after the spouses cease to be married, subject to protection for good-faith third parties.

This is a reason to review timing and legal character before promising that a spouse-to-spouse transfer or grant is permanent. Registration alone does not answer every family-law challenge.

Notre analysis of agreements between spouses under Section 1469 distinguishes established holdings from issues requiring further analysis. A gift case involving a reserved usufruct should not be presented as a judgment conclusively deciding every grant of a usufruct between spouses.

Décisions de la Cour suprême relatives aux amies, aux épouses et à la propriété

Acquisition commune non mariée dans le Dika 97/2569

ThaiLawOnline’s published case note describes a couple who acquired land through a joint business before registering their marriage. The Supreme Court recognised equal co-ownership despite registration in one name. The practical point is the evidence of joint acquisition, not the mere fact of cohabitation.

This does not mean every unmarried partner owns half, nor does the decision override foreign landholding restrictions. See Dika 97/2569 and unmarried couples’ property.

Un testament défectueux dans le Dika 2102/2551

The firm’s wills case review describes an intended gift to an unmarried partner which failed because the typed document did not satisfy the required will formalities. Witnesses signing years later did not repair the original execution. Without a valid gift under the will, the partner could not inherit merely as a spouse.

The practical lesson is to check execution as carefully as wording. See the discussion of décisions de la Cour suprême relatives aux testaments thaïlandais.

Transferts de terres maritales à Dika 3228/2569

This dispute concerned four plots. Challenges involving two older transfers were time-barred. Two later transfers were revoked in full, and the Supreme Court held that the recipient should also be required to leave those plots after losing ownership.

The case illustrates why both the correct remedy and the deadline matter. A missing consent does not mean every historical transfer will be undone. Read our spousal-consent case analysis et le Thai decision text reproduced by ThaiDeka.

Que doit faire le survivant lorsqu'un partenaire meurt ?

Secure the original will and obtain the death certificate. Identify the deceased’s assets and liabilities, the survivor’s own property, and any competing family claims. Do not assume appointment as estate administrator means ownership of the estate.

For a home, obtain a current title search and check the registered owner, mortgages, leases, usufructs, superficies and other entries. Establish whether the surviving partner owns the building, holds an occupation right, or is relying solely on inheritance.

Where there is a foreign beneficiary and land, raise the landholding and disposal issue at the outset. Obtain the applicable instructions and deadline in writing. Planning the sale early gives the administrator more opportunity to compare offers, settle documentation and account for estate liabilities.

Court appointment of an administrator is common where assets, institutions or a dispute require one, but the applicable procedure should be checked rather than assumed identical for every estate.
