He registers at the district office in the Buddhist year in which he enters his eighteenth year of age (section 16), collects his call-up summons in the year he enters his twenty-first (section 25), and then attends the selection. Active service lasts <strong>deux ans<\/strong>, shorter for men with special qualifications under ministerial regulation, and a man who has completed the Ministry of Defence military training course can serve less or be placed straight into the reserve (section 9). Failing to appear for selection is punishable by up to three years in prison (section 45). The Act as enacted was read in full, and the three amending instruments that matter to this page were read as <strong>scanned Gazette pages<\/strong>: the Military Service Act (No. 2) B.E. 2498 (vol. 72 part 66, special issue p.2, 26 August 2498), whose section 3 replaced section 14; the Act (No. 3) B.E. 2507 (vol. 81 part 7, p.51, 21 January 2507), whose section 6 replaced the discharge ladder; and the Act (No. 4) B.E. 2516 (vol. 90 part 75, special issue pp.5 to 10, 29 June 2516), whose sections replaced section 16 and section 33 and whose section 11 replaced all three penalty sections. Sections 4, 7, 9, 13, 14, 16, 25, 29, 33, 39, 43, 44 and 45 were each read against the operative text, not against a summary. <strong><a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/supreme-court-dika\/\">Cour supr\u00eame<\/a> Decision 9306\/2539<\/strong> was read in full in Thai, to its disposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Two things were verified here that this page turns on, and they are stated because a reader has no way to check them. First, section 14 (8) as replaced in 1955 reads simply <strong>a person who has been naturalised as Thai under the law<\/strong>. The words <strong>or a person whose father is an alien<\/strong>, which the Act carried in 1954, are not in the replacement, so a foreign father does not take a son outside the call-up. Second, the discharge ages of 30, 40 and 46 sit in <strong>section 39<\/strong>, which section 6 of the 1964 Act replaced; section 35 is a different provision about registering on the active-service roll, and this page previously cited it by mistake.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>What this review does not cover, said rather than implied: the personnel and intake figures, the April timetable and the district-office practice described throughout, which are administration and reporting rather than statute; the ministerial regulations that set the education deferment conditions and the shortened service for special qualifications, which the Act delegates and which were not read; and the political and public-opinion passages, which are commentary.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"overview-of-thai-military-service\">Aper\u00e7u du service militaire tha\u00eflandais<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le service militaire en Tha\u00eflande a consid\u00e9rablement \u00e9volu\u00e9 depuis sa cr\u00e9ation. As of 2020, approximately 360,850 active military personnel serve, alongside 200,000 reservists. The men liable for service are those aged 18 complete and not yet 30 complete under section 4 (2) of the Military Service Act B.E. 2497, and section 39 releases a man from military service at 46. The RTARF is under the command of the King of Thailand. The Minister of Defence oversees military operations. This shows the military\u2019s important role in national defense and internal security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En Tha\u00eflande, le service militaire n&#039;est pas un simple devoir, mais un v\u00e9ritable rite de passage pour de nombreux hommes. Section 50 (5) of the Constitution B.E. 2560 makes it a duty of every person to serve in the armed forces as provided by law, and section 7 of the Military Service Act B.E. 2497 is the law that provides it, limiting the duty to men of <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/thai-citizenship\/\">nationalit\u00e9 tha\u00eflandaise<\/a>. When individuals turn 21, they must join a conscription lottery. A red card means they will enlist in the Thai military. This service usually lasts for two years. Conversely, a black card indicates an exemption from service. The 1905 conscription law is where the practice began, but it is not the law in force. The governing statute today is the Military Service Act B.E. 2497 (1954), whose section 3 repealed its predecessor. It aims to provide a steady supply of military personnel. It also helps build discipline and patriotism in young Thai men.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le processus de conscription militaire en Tha\u00eflande a lieu chaque ann\u00e9e en avril, lorsque les hommes tha\u00eflandais en \u00e2ge de servir se rassemblent dans leurs bureaux de district respectifs pour le recrutement. Dans un premier temps, les volontaires sont soumis \u00e0 des examens m\u00e9dicaux complets, incluant des tests de d\u00e9pistage de drogues, afin de d\u00e9terminer leur aptitude au service. Environ 104\u00a0000 conscrits \u00e9taient n\u00e9cessaires pour les forces arm\u00e9es tha\u00eflandaises. L&#039;issue de la conscription d\u00e9pend fortement du nombre de volontaires, soulignant ainsi l&#039;importance d&#039;une bonne condition physique et mentale lors de ce processus de s\u00e9lection crucial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour \u00eatre \u00e9ligible au service militaire obligatoire en Tha\u00eflande, les individus doivent \u00eatre des citoyens tha\u00eflandais de sexe masculin \u00e2g\u00e9s de 21 ans et plus. Ils sont tenus de passer des examens m\u00e9dicaux approfondis, comprenant des examens physiques \u00e9valuant les maladies et handicaps potentiels susceptibles d'entraver leur service. L'article 3 a abrog\u00e9 la loi sur le service militaire B.E. 2479 qui la pr\u00e9c\u00e9dait.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Il a \u00e9t\u00e9 amend\u00e9 cinq fois et pas une seule fois depuis 1973<\/strong>: Loi (n\u00b0 2) B.E. 2498, Loi (n\u00b0 3) B.E. 2507, Annonce du Conseil r\u00e9volutionnaire n\u00b0 226 du 18 octobre B.E. 2515, Annonce du Conseil r\u00e9volutionnaire n\u00b0 300 du 13 d\u00e9cembre B.E. 2515 et Loi (n\u00b0 4) B.E. 2516. Les deux annonces de B.E. 2515 ont force de loi et ont remplac\u00e9 entre elles les articles 4, 5, 9, 14, 24, 25, 27, 28 et 28 bis, c'est pourquoi un article cit\u00e9 dans sa version de 1955 ou 1964 peut en fait correspondre \u00e0 sa version de 1972. Cela a plus d'importance qu'il n'y para\u00eet, et nous y reviendrons lorsque nous aborderons les amendes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Au-dessus de la loi se trouve un article de la Constitution. <strong>Article 50, alin\u00e9a 5, de la Constitution de 2560<\/strong>, dans le chapitre consacr\u00e9 aux devoirs des citoyens tha\u00eflandais, stipule qu\u2019il est du devoir de chacun \u201c de servir dans les forces arm\u00e9es conform\u00e9ment \u00e0 la loi \u201d. Il convient de noter ce qui y est dit et ce qui n\u2019y est pas dit : ce devoir constitutionnel incombe \u00e0 chaque citoyen et son contenu est enti\u00e8rement laiss\u00e9 \u00e0 la discr\u00e9tion du l\u00e9gislateur. <strong>La restriction aux hommes n'est pas constitutionnelle. C'est l'article 7 de la loi<\/strong>, qui dispose que tout homme de nationalit\u00e9 tha\u00eflandaise selon la loi a le devoir de servir personnellement dans l'arm\u00e9e. L'article 7 n'a jamais \u00e9t\u00e9 amend\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"nationality-is-the-trigger\">La nationalit\u00e9 est le d\u00e9clencheur, pas la r\u00e9sidence<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">C'est le point qui pi\u00e8ge les familles qui ont v\u00e9cu \u00e0 l'\u00e9tranger pendant des ann\u00e9es. L'article 7 s'applique \u00e0 <strong>nationalit\u00e9 tha\u00eflandaise<\/strong>. Il ne dit rien sur le lieu o\u00f9 un homme vit, sur son lieu de naissance, sur la question de savoir s'il d\u00e9tient un autre passeport ou s'il a jamais mis les pieds en Tha\u00eflande. Un fils qui poss\u00e8de la nationalit\u00e9 tha\u00eflandaise rel\u00e8ve de la loi, quoi qu'il en soit par ailleurs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les Tha\u00eflandais naturalis\u00e9s sont trait\u00e9s diff\u00e9remment, et la diff\u00e9rence est pr\u00e9cise. <strong>Article 14 (8)<\/strong>, dans sa forme actuelle issue de l'annonce du Conseil r\u00e9volutionnaire n\u00b0 226 de l'\u00e8re bouddhique 2515, place une personne naturalis\u00e9e tha\u00eflandaise parmi celles qui sont <strong>inscrit mais non appel\u00e9 en temps de paix<\/strong>. The register still applies; the call-up does not. Section 14 also covers monks and novices of recognised standing, religious officials of other faiths certified by the provincial governor, men undergoing reserve officer training, students of the Armed Forces Academies Preparatory School, certain teachers, and men with heavy <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/criminal-record\/\">casier judiciaire<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deux pi\u00e8ges s'offrent ici \u00e0 quiconque lit des sources anglaises plus anciennes. L'article 14 (8) original de 1954 exon\u00e9rait \u00e9galement un homme <strong>dont le p\u00e8re \u00e9tait un extraterrestre<\/strong>. La loi (n\u00b0 2) B.E. 2498 a supprim\u00e9 ce membre en 1955, et il n'est pas revenu. Et l'article 14 est une liste d'hommes qui sont enregistr\u00e9s et non appel\u00e9s, ce qui n'est pas la m\u00eame chose qu'un homme qui se trouve en dehors de la loi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"the-two-dates-that-matter\">Les deux dates qui comptent : l'inscription et la s\u00e9lection<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 16<\/strong>, dans sa forme actuelle issue de la loi (n\u00b0 4) de l'\u00e8re bouddhique 2516, oblige tout homme de nationalit\u00e9 tha\u00eflandaise, au cours de l'ann\u00e9e bouddhique o\u00f9 il atteint sa dix-huiti\u00e8me ann\u00e9e, \u00e0 se pr\u00e9senter pour \u00eatre inscrit sur le registre des hommes sujets au service militaire au bureau de district de son domicile militaire, au cours de ladite ann\u00e9e. Un homme qui ne peut se pr\u00e9senter en personne doit envoyer un adulte comp\u00e9tent et digne de confiance pour faire la notification en son nom ; <strong>si personne ne s'y rend, il est consid\u00e9r\u00e9 comme fuyant<\/strong>. Un homme enregistr\u00e9 en vertu de l'article 16 devient responsable \u00e0 partir de <strong>1er janvier de l'ann\u00e9e suivante<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u26a0\ufe0f Les guides plus anciens, et le texte de 1954 qui circule encore en ligne, donnent un <strong>Date limite de novembre<\/strong> pour l'enregistrement. La loi (n\u00b0 4) B.E. 2516 a remplac\u00e9 l'article 16 et la formulation de novembre a disparu avec lui. La date limite est d\u00e9sormais la fin de l'ann\u00e9e bouddhiste.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 25<\/strong>, tel que remplac\u00e9 par la proclamation n\u00b0 300 du Conseil r\u00e9volutionnaire de l&#x27;ann\u00e9e bouddhiste 2515, impose \u00e0 tout homme inscrit au registre, au cours de l&#x27;ann\u00e9e bouddhiste o\u00f9 il atteint l&#x27;\u00e2ge de vingt et un ans, de se pr\u00e9senter au bureau du district dont il rel\u00e8ve <strong>retirer la convocation<\/strong>. \u00c0 nouveau, un repr\u00e9sentant peut venir le r\u00e9cup\u00e9rer, et \u00e0 nouveau, si personne ne le fait, il est consid\u00e9r\u00e9 comme se soustrayant \u00e0 ses obligations. <strong>Article 26<\/strong> exige que l'agent de district publie l'avis chaque mois d'octobre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ainsi, la proc\u00e9dure pr\u00e9vue par la loi est la suivante : s\u2019inscrire l\u2019ann\u00e9e de ses 18 ans, retirer la convocation l\u2019ann\u00e9e de ses 21 ans, puis se pr\u00e9senter \u00e0 la s\u00e9lection. Il s\u2019agit de deux formalit\u00e9s distinctes, n\u00e9cessitant deux visites au bureau de district, espac\u00e9es de trois ans, et c\u2019est la premi\u00e8re que les familles vivant \u00e0 l\u2019\u00e9tranger ont tendance \u00e0 oublier.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"the-age-range\">La v\u00e9ritable tranche d'\u00e2ge, et d'o\u00f9 vient le chiffre 45<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La fourchette souvent cit\u00e9e, comprise entre 21 et 45, est erron\u00e9e aux deux extr\u00e9mit\u00e9s. <strong>Article 4, paragraphe 2<\/strong>, de la loi (n\u00b0 4) B.E. 2516, d\u00e9finit le groupe des hommes soumis au service militaire comme \u00e9tant ceux <strong>\u00e2g\u00e9 de 18 ans r\u00e9volus et n&#x27;ayant pas encore 30 ans r\u00e9volus<\/strong> qui ont \u00e9t\u00e9 enregistr\u00e9es en vertu de l&#x27;article 16 ou de l&#x27;article 18. <strong>Article 39<\/strong>, as replaced by section 6 of Act (No. 3) B.E. 2507, then sets the discharge ladder: reserve class 2 at <strong>30<\/strong> ann\u00e9es compl\u00e8tes, classe 3 \u00e0 <strong>40<\/strong>, and release from military service at <strong>46<\/strong>, not 45.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"deferment-under-section-29\">Report: article 29, et la r\u00e8gle des trente jours dont personne ne parle<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 29<\/strong>, never amended, applies where more men are available than the forces need, and grants deferment to three categories: a man who must support a parent who is incapable, disabled or too old to earn a living and who has nobody else to support them; a man who must support a child whose mother has died or is incapable, or an orphaned brother or sister who cannot support themselves; and <strong>a man in the course of education as prescribed by ministerial regulation<\/strong>. Where several sons would be called up together, only one is deferred on the parental ground, chosen by the parent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udd34 <strong>The procedural trap is in the same section.<\/strong> A claim on the first two grounds must be filed with the district officer <strong>not less than thirty days before the selection day<\/strong>, except in a special case that is not the claimant&#8217;s fault.
