During the marriage, the husband transferred THB 1,431,731 of marital funds\n(<em>sin somros<\/em>) to a third party as a gratuitous gift. His wife did not consent and, on the\nfindings, did not know at the time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She had already brought and settled a separate claim for compensation under CCC section 1523\nparagraph 2 arising from the same relationship. It is not. A gift escapes the consent requirement only if it is <strong>les deux<\/strong> for\ncharitable purposes, for social purposes, or in accordance with moral obligation, <strong>ET<\/strong>\nproportionate to the family&#8217;s station in life. Both limbs, not either.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That reading matters here. A contribution to a family wedding clears both. A temple donation of\nsensible size clears both. Both limbs are required, and a gift cannot satisfy the second. This is\nwhy claims against a gift recipient are structurally stronger than claims against a buyer, the\nrecipient&#8217;s innocence is legally irrelevant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"the-interest-holding-and-why-it-is-the-practical-story\">La d\u00e9tention d'int\u00e9r\u00eats, et pourquoi c'est l'histoire pratique<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/court-of-appeal\/\">Cour d&#039;appel<\/a>&#8216;s instinct was the intuitive one: the money left on a certain date, so interest\nshould run from that date. The Supreme Court disagreed, and the reasoning is worth following because it\ngoverns how these claims should be timed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A gratuitous transfer of marital property is <strong>not void<\/strong>. It is\n<strong><a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/void-and-voidable\/\">annulable<\/a><\/strong>. It remains fully effective until a court revokes it. Until that moment the\nrecipient holds the money lawfully, owes nothing, and therefore cannot be in default\n(<em>phit nat<\/em> \/ \u0e1c\u0e34\u0e14\u0e19\u0e31\u0e14). Since CCC section 224 default interest presupposes default, there is\nnothing for interest to attach to before judgment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The consequence is uncomfortable. Every month between the transfer and the judgment is a month in\nwhich the recipient has the use of your money for free. In this case the transfers and the\nfirst-instance judgment were separated by roughly two years, two years of interest on THB 1.4 million\nthat the wife was never going to recover, no matter how completely she won.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the argument for filing immediately rather than waiting for the divorce proceedings to take\nshape.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"two-claims-not-one\">Deux revendications, pas une<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where the transfer went to a romantic partner, Thai law offers two separate routes, and clients\nroutinely assume they must choose:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table>\n <thead>\n <tr>\n <th><\/th>\n <th>R\u00e9vocation<\/th>\n <th>Compensation<\/th>\n <\/tr>\n <\/thead>\n <tbody>\n <tr>\n <td><strong>Disposition<\/strong><\/td>\n <td>CCC s.1480 with s.1476<\/td>\n <td>art. 1523, al. 2, du C.C.C.<\/td>\n <\/tr>\n <tr>\n <td><strong>Recovers<\/strong><\/td>\n <td>The asset or money itself<\/td>\n <td>Dommages-int\u00e9r\u00eats pour le tort conjugal<\/td>\n <\/tr>\n <tr>\n <td><strong>Limitation<\/strong><\/td>\n <td>1 year from discovery \/ 10 years from the act<\/td>\n <td>Separate regime<\/td>\n <\/tr>\n <\/tbody>\n<\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Decision 139\/2569 resolved the procedural question directly. The defendants argued that the settled\nsection 1523 claim made this action a repeat proceeding barred by CPC section 144. The Court rejected\nthat: the two claims <strong>\u0e2d\u0e32\u0e28\u0e31\u0e22\u0e02\u0e49\u0e2d\u0e2b\u0e32\u0e15\u0e48\u0e32\u0e07\u0e01\u0e31\u0e19<\/strong>, they rest on different grounds. Compensation\nconcerns the marital wrong; revocation concerns unauthorised management of marital property. Both are\navailable, and they can be run in sequence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also disposed of a ratification argument. Section 1480 removes the right to revoke where\nthe innocent spouse has ratified the transaction. Here, the wife&#8217;s earlier conduct amounted to\n<strong>\u0e01\u0e32\u0e23\u0e1a\u0e2d\u0e01\u0e25\u0e49\u0e32\u0e07<\/strong>, avoiding the transaction, which brings it to an end, and not to\n<strong>\u0e01\u0e32\u0e23\u0e43\u0e2b\u0e49\u0e2a\u0e31\u0e15\u0e22\u0e32\u0e1a\u0e31\u0e19<\/strong>, ratification. Ten years from the transaction, absolutely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The one-year clock starts on <strong>discovery<\/strong>, not on separation, not on filing for\ndivorce, not on instructing a lawyer. In practice this is where these claims are lost. Someone finds a\nbank statement in March, spends the year deciding whether the marriage is over, and instructs a lawyer\nthe following April. The remedy has already expired.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read alongside the interest holding, the two rules point the same way. Waiting can extinguish the\nclaim; waiting less can still cost you the interest. There is no version of this in which delay helps.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-to-do-if-you-have-just-found-a-transfer\">Que faire si vous venez de trouver un virement<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n <li><strong>Record the date and manner of discovery.<\/strong> This is the fact the <a href=\"https:\/\/www.thailawonline.com\/fr\/glossary\/prescription\/\">d\u00e9lai de prescription<\/a>\n turns on and you may have to prove it.<\/li>\n <li><strong>Secure the evidence now.<\/strong> Bank statements, transfer records, Land Department\n records, messages. Access tends to disappear once the dispute is open.<\/li>\n <li><strong>Avoid anything resembling ratification.<\/strong> Do not sign consent documents, accept a\n share of proceeds, or give written acknowledgement of the transfer.<\/li>\n <li><strong>Ask about provisional measures<\/strong> if further dissipation looks likely.<\/li>\n <li><strong>D\u00e9posez la r\u00e9clamation de l'article 1480 sans tarder<\/strong>, before, or alongside, any compensation\n claim, not after it settles.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"preventing-the-problem-instead\">Pr\u00e9venir le probl\u00e8me plut\u00f4t<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article 1476\/1<\/strong> lets spouses vary the consent regime, in whole or in part, but only\nthrough a <a href=\"https:\/\/www.thailawonline.com\/fr\/prenuptial-agreement-thailand\/\">contrat de mariage<\/a> made under sections 1465 and 1466, and in Thailand that must be registered at the\ndistrict office at the same time as the marriage. It cannot be added later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A properly drafted agreement can set a baht threshold above which any transfer requires written\nconsent, schedule pre-marital assets so that classification is never in dispute, and define what\n&#8220;proportionate to the family&#8217;s station in life&#8221; means for that couple.
