Published to the Supreme Court database on 11 October 2026<\/b>, Dika 6436\/2562<\/b> involves a couple who lived together without registering a marriage. Their daughter was killed as a motorcycle passenger on 3 April 2016. On 3 May 2016<\/b>, a month after her death, the parents registered their marriage.<\/p>\n

An arbitrator awarded the father 800,000 \u0e1a\u0e32\u0e17<\/b> plus interest for loss of support, and the insurer tried to set the award aside under Arbitration Act B.E. 2545 s.40<\/b> as contrary to public order. The Supreme Court refused. Under CCC s.1557<\/b> the parents’ marriage made the daughter a legitimate child from the date of her birth<\/b>, so the duty to maintain her parents under s.1563<\/b> had always existed and the father’s loss was real.<\/p>\n

For Thai-foreign families the lesson is blunt: a name on a birth certificate is not legitimation, and the gap only shows up when money or custody is at stake.<\/p>\n
