The transfer was never registered. The first administrator then transferred the property to the beneficiary under the will, who sued to evict the buyer and claimed <b>100,000 baht a month<\/b> in damages.<\/p>\n<p>The buyer counterclaimed inside that case for transfer of title against payment of the balance, and asked the court to freeze the title. In <b>Dika 1085\/2569<\/b>, on his appeal against the refusal of that freeze, the Supreme Court held of its own motion that the counterclaim should never have been admitted: his dispute was with the first administrator, who was not a party. <b>CPC ss.177 para 3 and 179 para 3<\/b> require a counterclaim to be connected to the plaintiff&#8217;s claim. Without a valid counterclaim he could not seek interim protection either; <b>CPC s.254(3)<\/b> is for plaintiffs only. The eviction claim itself was not decided in this judgment.<\/p>\n<p>Two practical points. Where there are two administrators, <b>CCC s.1726<\/b> requires a majority decision unless the will says otherwise, so in practice both must agree.
