In <b>Dika 502\/2569<\/b> the Supreme Court let the insurer recover the <b>151,400 baht<\/b> excess from its own policyholder and his driver.<\/p>\n<p>The route was <b>section 401 of the Civil and Commercial Code<\/b>, management of affairs without mandate, not subrogation. That choice decided the deadline too: because the insurer was not standing in the victims&#8217; shoes, the one-year tort period in <b>\u0e21\u0e32\u0e15\u0e23\u0e32 448<\/b> did not apply and the residual <b>\u0e2a\u0e34\u0e1a\u0e1b\u0e35<\/b> period in <b>section 193\/30<\/b> did.
