The Thai government carries out <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/deportation\/\">\u0e01\u0e32\u0e23\u0e40\u0e19\u0e23\u0e40\u0e17\u0e28<\/a> orders for illegal employment. Recent cabinet resolutions have directed joint \u201cSearch, Arrest, Fine, Deport\u201d campaigns that link both agencies in field raids.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"1-1-definition-of-work\"><strong>1.1 \u0e19\u0e34\u0e22\u0e32\u0e21\u0e02\u0e2d\u0e07 \u201c\u0e07\u0e32\u0e19\u201d<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Since 2018, \u201cwork\u201d includes any activity done in Thailand. This can be physical or mental, and it can be paid or unpaid. However, it does not include business activities under a <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/foreign-business-licence\/\">Foreign Business Licence<\/a>. Consequently, remote work for an overseas employer, volunteer coaching or speaking at a paid seminar can all require a permit unless a specific exemption applies. See defined in Section 5 of the Foreigners\u2019 Working Management Emergency Decree B.E. 2560 (2017).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"1-2-reserved-occupations\"><strong>1.2 \u0e2d\u0e32\u0e0a\u0e35\u0e1e\u0e17\u0e35\u0e48\u0e2a\u0e07\u0e27\u0e19\u0e44\u0e27\u0e49<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Work reserved to Thai nationals is set by ministerial notification under section 7 of the Emergency Decree. The current instrument is the <strong>\u0e1b\u0e23\u0e30\u0e01\u0e32\u0e28\u0e01\u0e23\u0e30\u0e17\u0e23\u0e27\u0e07\u0e41\u0e23\u0e07\u0e07\u0e32\u0e19 \u0e01\u0e33\u0e2b\u0e19\u0e14\u0e07\u0e32\u0e19\u0e17\u0e35\u0e48\u0e2b\u0e49\u0e32\u0e21\u0e04\u0e19\u0e15\u0e48\u0e32\u0e07\u0e14\u0e49\u0e32\u0e27\u0e17\u0e33<\/strong>, signed 1 April 2020 and published in the Royal Gazette on 21 April 2020 (vol. 137, special part 92 Ngor, p. 14). It takes effect sixty days after publication, so it has been in force since <strong>21 June 2020<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not set a single list, and that is the part most summaries get wrong. It sets <a href=\"https:\/\/www.thailawonline.com\/th\/prohibited-jobs-for-foreigners-in-thailand\/\"><strong>four schedules<\/strong><\/a>, and which schedule a job sits in decides whether it is closed outright or merely conditional:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Schedule 1: absolutely prohibited<\/strong> anywhere in the Kingdom, together with any work that another law reserves to Thai-national professionals. It includes tour guiding and tour arranging, haircutting, perming and beauty work, street vending, Thai massage, wood carving, auctioneering, gem cutting and polishing, hand weaving, clerical and secretarial work, and driving a vehicle, although <strong>piloting an international aircraft and driving a forklift are expressly excepted<\/strong>.<\/li>\n\n<li><strong>Schedule 2:<\/strong> prohibited, but subject to Thailand\u2019s international agreements and obligations.<\/li>\n\n<li><strong>Schedule 3:<\/strong> permitted <strong>only where the foreigner has an employer<\/strong>.<\/li>\n\n<li><strong>Schedule 4:<\/strong> permitted only with an employer <strong>\u0e41\u0e25\u0e30<\/strong> admission under a government-to-government memorandum of understanding, on conditions set by the <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/director\/\">\u0e1c\u0e39\u0e49\u0e2d\u0e33\u0e19\u0e27\u0e22\u0e01\u0e32\u0e23<\/a>-General of the Department of Employment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a profession is licensed, the licence has to be held before a work permit will issue. A foreigner who takes Schedule 1 work risks prosecution regardless of any employer arrangement, because that schedule is not conditional on anything.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2-offences-and-monetary-penalties\"><strong>2.
