Under section 101 of the Emergency Decree on Managing the Work of Aliens B.E. 2560, as amended in 2561 (2018), the worker is fined 5,000 to 50,000 baht, is deported once the fine is paid, and cannot apply for a work permit for two years. There is no prison term for the worker; the up-to-five-years figure still quoted widely online was in the 2560 original and was removed by the 2561 amendment.
