The Criminal Code marks these offences one by one, usually with a closing section in each chapter. They cover most disputes foreigners actually meet in Thailand: defamation, fraud, embezzlement and trespass. Under Section 39(2) of the Criminal Procedure Code the right to prosecute is extinguished when the complaint is withdrawn or the parties lawfully compromise. The withdrawal must happen before the judgment becomes final; it can be done at the police station, before the <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/public-prosecutor\/\">\u0e1e\u0e19\u0e31\u0e01\u0e07\u0e32\u0e19\u0e2d\u0e31\u0e22\u0e01\u0e32\u0e23<\/a> files, during trial or while an appeal is pending. Once a prosecution has been filed, withdrawing it requires the accused not to object (Criminal Procedure Code Section 35); a written compromise avoids that problem.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>The offence is compoundable only if the Code says so. Defamation is compoundable under Section 333, fraud under Section 348, embezzlement under Section 356 and trespass under Section 366. Theft is not, except that Section 71 makes theft, fraud and related property offences between close relatives compoundable and leaves spouses unpunished altogether. Offences against the state, drugs, public fraud under Section 343 and <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/lese-majeste\/\">\u0e25\u0e27\u0e07\u0e1e\u0e23\u0e30\u0e1a\u0e23\u0e21\u0e23\u0e32\u0e0a\u0e32\u0e19\u0e38\u0e20\u0e32\u0e1e<\/a> are never compoundable.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"what-settlement-means-in-practice-for-a-foreigner\">\u0e04\u0e27\u0e32\u0e21\u0e2b\u0e21\u0e32\u0e22\u0e02\u0e2d\u0e07\u0e01\u0e32\u0e23\u0e15\u0e31\u0e49\u0e07\u0e23\u0e01\u0e23\u0e32\u0e01\u0e43\u0e19\u0e17\u0e32\u0e07\u0e1b\u0e0f\u0e34\u0e1a\u0e31\u0e15\u0e34\u0e2a\u0e33\u0e2b\u0e23\u0e31\u0e1a\u0e0a\u0e32\u0e27\u0e15\u0e48\u0e32\u0e07\u0e0a\u0e32\u0e15\u0e34<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>A settlement agreement<\/strong> (\u0e1a\u0e31\u0e19\u0e17\u0e36\u0e01\u0e02\u0e49\u0e2d\u0e15\u0e01\u0e25\u0e07) is signed by both sides, usually in front of the inquiry official or the court, recording the payment and the victim&#8217;s withdrawal of the complaint. The court then strikes the case out. A private payment with nothing in writing settles nothing: the victim can still proceed, and the offender has no proof of compromise. For a foreigner facing a <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/defamation\/\">\u0e01\u0e32\u0e23\u0e2b\u0e21\u0e34\u0e48\u0e19\u0e1b\u0e23\u0e30\u0e21\u0e32\u0e17<\/a> or cheque complaint, this is normally the fastest exit, and it leaves no conviction on the record.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>The common mistake on the victim&#8217;s side is the 3-month clock. Making an entry in the police daily record book is not a complaint; the injured person must expressly ask for the offender to be prosecuted. Many foreigners who have been defrauded discover, after months of negotiation, that the criminal route has closed and only a civil claim remains.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"compoundable-and-non-compoundable-offences-compared\">\u0e01\u0e32\u0e23\u0e40\u0e1b\u0e23\u0e35\u0e22\u0e1a\u0e40\u0e17\u0e35\u0e22\u0e1a\u0e04\u0e27\u0e32\u0e21\u0e1c\u0e34\u0e14\u0e17\u0e35\u0e48\u0e22\u0e2d\u0e21\u0e04\u0e27\u0e32\u0e21\u0e44\u0e14\u0e49\u0e41\u0e25\u0e30\u0e04\u0e27\u0e32\u0e21\u0e1c\u0e34\u0e14\u0e17\u0e35\u0e48\u0e22\u0e2d\u0e21\u0e04\u0e27\u0e32\u0e21\u0e44\u0e21\u0e48\u0e44\u0e14\u0e49<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>For a non-compoundable offence, compensation still matters but only as mitigation: the court may reduce the sentence or suspend it, and a public prosecutor may weigh it, but the victim cannot end the case.
