It rests on Sections 1514 and 1515 of the Thai <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/thai-civil-and-commercial-code\/\">\u0e1b\u0e23\u0e30\u0e21\u0e27\u0e25\u0e01\u0e0e\u0e2b\u0e21\u0e32\u0e22\u0e41\u0e1e\u0e48\u0e07\u0e41\u0e25\u0e30\u0e1e\u0e32\u0e13\u0e34\u0e0a\u0e22\u0e4c<\/a>: the consent must be in writing, certified by two witnesses, and the divorce takes effect only when registered. It is the fastest and cheapest divorce Thailand offers.<\/p><\/p>\n\n\n<div class=\"wp-block-rank-math-toc-block\" id=\"rank-math-toc\"><h2>\u0e2a\u0e32\u0e23\u0e1a\u0e31\u0e0d<\/h2><nav><ul><li><a href=\"#what-sections-1514-and-1515-require\">What Sections 1514 and 1515 require<\/a><\/li><li><a href=\"#what-to-bring-and-what-can-go-wrong\">What to bring and what can go wrong<\/a><\/li><li><a href=\"#uncontested-divorce-compared-with-a-court-divorce\">Uncontested divorce compared with a court divorce<\/a><\/li><li><a href=\"#frequently-asked-questions\">\u0e04\u0e33\u0e16\u0e32\u0e21\u0e17\u0e35\u0e48\u0e1e\u0e1a\u0e1a\u0e48\u0e2d\u0e22<\/a><\/li><\/ul><\/nav><\/div>\n\n\n<h2 class=\"wp-block-heading\" id=\"what-sections-1514-and-1515-require\">What Sections 1514 and 1515 require<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>Section 1514<\/strong> provides that a divorce may be effected by mutual consent or by judgment, and that a divorce by consent must be in writing and certified by at least two witnesses. <strong>Section 1515<\/strong> adds that a divorce by consent is valid only when registered, as the marriage was. Both spouses appear personally before the registrar at an amphur (or a Bangkok khet), sign the divorce register (Kor Ror 6), and each receives a divorce certificate (Kor Ror 7). Under Section 1531 the divorce is effective from that registration.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>No ground is needed<\/strong> and no reason is asked. The registrar checks identity, the marriage record and the written consent, and records what the spouses have agreed on <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/child-custody\/\">\u0e01\u0e32\u0e23\u0e14\u0e39\u0e41\u0e25<\/a> under Section 1520, child maintenance under Section 1522 and property. Where the agreement is silent, the default rules apply: marital property is divided equally, and open questions of custody or support can be taken to the Juvenile and <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/family-court\/\">\u0e28\u0e32\u0e25\u0e40\u0e22\u0e32\u0e27\u0e0a\u0e19\u0e41\u0e25\u0e30\u0e04\u0e23\u0e2d\u0e1a\u0e04\u0e23\u0e31\u0e27<\/a> \u0e20\u0e32\u0e22\u0e2b\u0e25\u0e31\u0e07.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"what-to-bring-and-what-can-go-wrong\">What to bring and what can go wrong<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>Each spouse brings identification (Thai ID card or passport), the original <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/marriage-certificate\/\">\u0e43\u0e1a\u0e17\u0e30\u0e40\u0e1a\u0e35\u0e22\u0e19\u0e2a\u0e21\u0e23\u0e2a<\/a> (Kor Ror 3), the signed <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/divorce-agreement\/\">\u0e02\u0e49\u0e2d\u0e15\u0e01\u0e25\u0e07\u0e01\u0e32\u0e23\u0e2b\u0e22\u0e48\u0e32\u0e23\u0e49\u0e32\u0e07<\/a> if there is one, and two witnesses with their identification. A foreigner who does not read Thai brings an interpreter. The visit takes about an hour, the district office fee is nominal, and the agreement can usually be prepared in three to five days. The amphur can only divorce a marriage that appears in the Thai civil registry; a marriage registered abroad is dissolved by the Family Court even when both spouses agree. Both must attend in person, so a spouse who has left the country cannot be divorced this way by power of attorney. And the amphur does not check fairness: an agreement signed under pressure, or one that gives away a foreigner&#8217;s condominium, is recorded as written.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"uncontested-divorce-compared-with-a-court-divorce\">Uncontested divorce compared with a court divorce<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>The court route under Section 1516 needs a proven ground, takes six to twelve months and produces a judgment. The amphur route needs consent, takes a morning and produces a registration. For property the difference matters: at the amphur the written agreement governs, and the equal split in Section 1533 is applied by nobody unless the spouses leave the property undivided. Section 1532 fixes the pool at the registration date for a consent divorce and at the filing date for a court divorce.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>Recognition abroad is the other divergence. Several countries treat an administrative divorce with suspicion or refuse it, whereas a court judgment is accepted almost everywhere, as explained in the guide on <a href=\"https:\/\/www.thailawonline.com\/th\/thai-divorce-recognition\/\">whether a Thai divorce is valid abroad<\/a>. Once registered, an uncontested divorce cannot be undone; the agreement can only be challenged in court on the ordinary grounds for setting aside a contract.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"frequently-asked-questions\">\u0e04\u0e33\u0e16\u0e32\u0e21\u0e17\u0e35\u0e48\u0e1e\u0e1a\u0e1a\u0e48\u0e2d\u0e22<\/h2>\n\n<div id=\"rank-math-faq\" class=\"rank-math-block\">\n<div class=\"rank-math-list\">\n<div id=\"faq-question-1\" class=\"rank-math-list-item\">\n<h3 class=\"rank-math-question\">Can a foreigner get an uncontested divorce at the amphur in Thailand?<\/h3>\n<div class=\"rank-math-answer\">\n\n<p>Yes, if the marriage was registered in Thailand. Both spouses attend the district office in person with their passports or ID cards, the marriage certificate, two witnesses and any written agreement. A foreigner who does not read Thai should bring an interpreter.
