embryo is made using the intended parents\u2019 or donors\u2019 eggs and sperm. The surrogate has no genetic link to the child.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction decides whether the arrangement is lawful here at all. <strong>Section 22 of the 2015 Act permits only two methods<\/strong>: an embryo from the sperm of the husband and the egg of the wife, or an embryo from the sperm of the husband or the egg of the wife together with a donor egg or sperm. The section ends by <strong>expressly forbidding the use of the surrogate&#8217;s own egg<\/strong>. <strong>Traditional surrogacy is therefore not available in Thailand<\/strong>, whoever the parties are and whatever they agree.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"legal-framework-the-2015-art-act\">\u0e01\u0e23\u0e2d\u0e1a\u0e01\u0e0e\u0e2b\u0e21\u0e32\u0e22: \u0e1e\u0e23\u0e30\u0e23\u0e32\u0e0a\u0e1a\u0e31\u0e0d\u0e0d\u0e31\u0e15\u0e34\u0e40\u0e17\u0e04\u0e42\u0e19\u0e42\u0e25\u0e22\u0e35\u0e0a\u0e48\u0e27\u0e22\u0e01\u0e32\u0e23\u0e40\u0e08\u0e23\u0e34\u0e0d\u0e1e\u0e31\u0e19\u0e18\u0e38\u0e4c \u0e1e.\u0e28. 2558<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thailand\u2019s surrogacy laws are set by the Protection for Children Born through Assisted Reproductive Technologies Act. This law was enacted on February 19, 2015. It became effective 90 days after it was published in the Government Gazette. The law was introduced after famous scandals, like the \u201cbaby Gammy\u201d case. This case showed problems with child abandonment and human trafficking related to commercial surrogacy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0e1a\u0e17\u0e1a\u0e31\u0e0d\u0e0d\u0e31\u0e15\u0e34\u0e2a\u0e33\u0e04\u0e31\u0e0d \u0e14\u0e31\u0e07\u0e23\u0e32\u0e22\u0e25\u0e30\u0e40\u0e2d\u0e35\u0e22\u0e14\u0e17\u0e35\u0e48\u0e23\u0e30\u0e1a\u0e38\u0e44\u0e27\u0e49\u0e43\u0e19 <a href=\"https:\/\/www.thaisuperiorart.com\/wp-content\/uploads\/2020\/02\/Protection-of-a-child-born-by-Medically-Assisted-Reproductive-Technology-ACT.pdf\" rel=\"noopener\" target=\"_blank\">\u0e40\u0e2d\u0e01\u0e2a\u0e32\u0e23\u0e17\u0e32\u0e07\u0e01\u0e32\u0e23\u0e02\u0e2d\u0e07\u0e01\u0e0e\u0e2b\u0e21\u0e32\u0e22\u0e17\u0e35\u0e48\u0e04\u0e38\u0e13\u0e2a\u0e32\u0e21\u0e32\u0e23\u0e16\u0e04\u0e49\u0e19\u0e2b\u0e32\u0e44\u0e14\u0e49\u0e17\u0e35\u0e48\u0e19\u0e35\u0e48<\/a>. Let\u2019s just mentionned some conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Under Section 21 (1) the intended husband and wife must be lawfully married and <strong>of <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/thai-citizenship\/\">\u0e2a\u0e31\u0e0d\u0e0a\u0e32\u0e15\u0e34\u0e44\u0e17\u0e22<\/a><\/strong>; where one of them is not Thai, the marriage must have been registered for <strong>at least three years<\/strong>. So a couple with no Thai spouse is excluded however long they have been married. The surrogate must not be an ascendant or descendant of either spouse (Section 21 (2)) and must already have had a child of her own (Section 21 (4)),<\/li>\n\n<li>\u0e44\u0e21\u0e48\u0e21\u0e35\u0e1c\u0e25\u0e1b\u0e23\u0e30\u0e42\u0e22\u0e0a\u0e19\u0e4c\u0e17\u0e32\u0e07\u0e01\u0e32\u0e23\u0e04\u0e49\u0e32 (\u0e21\u0e32\u0e15\u0e23\u0e32 24)<\/li>\n\n<li>\u0e2b\u0e49\u0e32\u0e21\u0e42\u0e06\u0e29\u0e13\u0e32 (\u0e21\u0e32\u0e15\u0e23\u0e32 28)<\/li>\n\n<li>A child born through technology is a <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/legitimation\/\">legitimate<\/a> child of the intended parents. Donors have no rights or duties. If the parents die before the birth, the surrogate mother becomes the guardian (Section 30)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>These are criminal prohibitions, not guidance.<\/strong> \u0e20\u0e32\u0e22\u0e43\u0e15\u0e49 <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 48<\/strong> anyone who breaches the Section 24 ban on arranging surrogacy for commercial purposes is liable to <strong>imprisonment not exceeding ten years and a <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/fine\/\">\u0e14\u0e35<\/a> not exceeding 200,000 baht<\/strong>; the Act uses <em>\u0e41\u0e25\u0e30<\/em>, so both are imposed. Under <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 49<\/strong> a breach of the Section 28 advertising ban carries <strong>up to five years, or a fine up to 100,000 baht, or both<\/strong>, and Section 28 applies <strong>whether or not the advertising is for commercial purposes<\/strong>, so simply publicising that a woman is willing to carry a child, or that a couple is looking for someone to do so, is an offence. Under <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 47<\/strong> a doctor who provides surrogacy services without the Committee approval required by Section 23 faces up to six months, or a fine up to 10,000 baht, or both. The law prohibits commercial surrogacy, meaning no financial compensation beyond necessary expenses is allowed. It limits surrogacy to a lawfully married husband and wife. Under section 21 the surrogate must be a blood relative of one of them, and only where there is no blood relative may another woman carry the child, on criteria set by the Minister of Public Health; she must already have had a child of her own, she must not be an ascendant or descendant of either spouse, and if she has a husband or a partner living with her as such, his consent is required. In practice this excludes single people and same-sex couples, and it excludes a couple in which neither spouse is Thai. It does not exclude a foreigner married to a Thai for at least three years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"historical-context-and-ethical-concerns\">\u0e1a\u0e23\u0e34\u0e1a\u0e17\u0e17\u0e32\u0e07\u0e1b\u0e23\u0e30\u0e27\u0e31\u0e15\u0e34\u0e28\u0e32\u0e2a\u0e15\u0e23\u0e4c\u0e41\u0e25\u0e30\u0e02\u0e49\u0e2d\u0e01\u0e31\u0e07\u0e27\u0e25\u0e14\u0e49\u0e32\u0e19\u0e08\u0e23\u0e34\u0e22\u0e18\u0e23\u0e23\u0e21<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thailand\u2019s surrogacy laws have undergone substantial changes in recent years to regulate the practice more strictly. The Assisted Reproductive Technologies Act, or the Surrogacy Act, was created to ensure ethical and legal standards in surrogacy. One key change was banning commercial surrogacy. This means surrogate mothers cannot get paid more than their reasonable expenses. The law now mandates that only altruistic surrogacy is permissible, thereby limiting financial transactions associated with the surrogacy process.
