Additionally, the court may consider the child\u2019s own wishes, especially if they are of an age where their opinion can be reasonably taken into account. Two of those matter in practice: <strong>where the court so orders<\/strong>, \u0e41\u0e25\u0e30 <strong>where the parents have agreed in a way the law allows them to agree<\/strong>. On a divorce by mutual consent, <strong>section 1520<\/strong> requires the spouses to record in writing which of them exercises parental power over which child, and if they do not agree the court decides; in a contested divorce the court deciding the divorce decides parental power too. <strong>Section 1522<\/strong> does the same for maintenance. Under <strong>section 1567<\/strong> the parent who holds parental power decides where the child lives, may correct the child short of cruelty, and may demand the child back from anyone holding the child unlawfully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Losing parental power is not losing the child, and this is the most misunderstood point in the whole subject.<\/strong> <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 1584\/1<\/strong> gives a father or a mother the right to contact with their child as is reasonable in the circumstances, and it says so <em>whoever<\/em> exercises parental power or is the guardian. A parent who is not awarded parental power keeps that right by statute, and does not have to bargain for it. <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 1582<\/strong> is the other direction: where a parent abuses parental power or is guilty of gross misconduct the court may remove it in whole or in part, on its own motion or on the application of a close relative or the public prosecutor.<\/p><\/p>\n\n\n\n\n<h3 class=\"wp-block-heading\" id=\"unmarried-fathers-and-legitimation\">If the parents never married, the father starts with nothing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>This is the situation we are asked about most often, and the answer surprises almost every foreign father.<\/strong> \u0e20\u0e32\u0e22\u0e43\u0e15\u0e49 <strong>section 1546<\/strong>, a child born to a woman who is not married to the father is the legitimate child <em>of the mother alone<\/em>. The father has no parental power at all, whatever is on the birth certificate and however long the couple lived together. Until that is fixed he cannot consent to the child travelling, decide the child\u2019s residence, or be heard as of right on custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 1547<\/strong> gives three ways to fix it: the parents marry; the father registers the child as his at the district office; or the court gives judgment that the child is his. <strong>Section 1548<\/strong> is the trap in the middle route, because registration requires the consent of <em>both the mother and the child<\/em>. If they do not attend, the registrar notifies them, and <strong>if they say nothing for sixty days the law presumes they refuse<\/strong>, extended to a hundred and eighty days if they are outside Thailand. Silence is a refusal, not a consent.
