class=\"wp-block-list\">\n<li><strong>\u0e14\u0e34\u0e01\u0e32 5681\/2568 (2025)<\/strong>, confirmed that &#8220;carrying&#8221; a firearm during the offence under former Section 277(4) requires the firearm to be <strong>\u201c\u0e1e\u0e23\u0e49\u0e2d\u0e21\u0e43\u0e0a\u0e49\u0e07\u0e32\u0e19\u201d<\/strong>, not simply in the bag, a meaningful narrowing for defence.<\/li>\n\n\n\n<li><strong>\u0e14\u0e34\u0e01\u0e32 3270\/2568 (2025)<\/strong>, <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/court-of-first-instance\/\">court of first instance<\/a> imposed <strong>\u0e42\u0e17\u0e29\u0e08\u0e33\u0e04\u0e38\u0e01\u0e15\u0e25\u0e2d\u0e14\u0e0a\u0e35\u0e27\u0e34\u0e15\u0e2a\u0e35\u0e48\u0e04\u0e23\u0e31\u0e49\u0e07\u0e15\u0e34\u0e14\u0e15\u0e48\u0e2d\u0e01\u0e31\u0e19<\/strong> for repeat offences against a child under 15 with a firearm\/knife; the Supreme Court merged them under Section 91(3), life is still the result.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Section 277\/2 escalates the penalty when the victim suffers serious harm (15-20 years or life) or dies (life or death penalty).<\/p>\n\n\n\n<h3 id=\"section-278-indecent-act-on-person-over-15\" class=\"wp-block-heading\">\u0e21\u0e32\u0e15\u0e23\u0e32 278 class=\"wp-block-paragraph\">Sexual touching, exposure, or non-penetrative sexual contact without consent, <strong>\u0e2a\u0e39\u0e07\u0e2a\u0e38\u0e14 10 \u0e1b\u0e35 \u0e41\u0e25\u0e30 200,000 \u0e1a\u0e32\u0e17<\/strong>. The 2019 amendment had added a separate aggravated offence for penetration with an object or a non-genital body part, but <strong>those paragraphs were repealed on 30 December 2025<\/strong> by the Criminal Code Amendment Act (No. 30) B.E. 2568. It restored the wide definition of sexual intercourse in <strong>Section 1(18)<\/strong>, so penetration by an object or by a body part other than the genitals counts again as sexual intercourse; it repealed the penetration paragraphs the 2019 Act had inserted into <strong>Sections 278 and 279<\/strong>, so that conduct now falls under Section 276 or Section 277; and it created a new offence of <strong>sexual harassment at Section 284\/1<\/strong>, punishable by up to one year and THB 20,000, rising to two years where the conduct is repeated and the victim cannot lead a normal life, three years in a public place or in a computer system the general public can reach, and five years where the victim is a child not over fifteen.
