In most countries, <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/registered-thai-lawyer\/\">\u0e17\u0e19\u0e32\u0e22\u0e04\u0e27\u0e32\u0e21\u0e17\u0e35\u0e48\u0e44\u0e14\u0e49\u0e23\u0e31\u0e1a\u0e01\u0e32\u0e23\u0e08\u0e14\u0e17\u0e30\u0e40\u0e1a\u0e35\u0e22\u0e19<\/a> must follow their \u201cethical code\u201d and it can apply also outside of their country. An ethical code are some regulations, rules that lawyers must follow and they are in place normally to protect the clients, to protect justice. The translation was very difficult and we hope you will understand most of this text. Our goal is only to inform and please read the disclaimer below this page. The 1986 rules are still the ones in force. But many foreign \u201clawyers\u201d in Thailand are not lawyers and do not have a license to practice law. Even if a foreign lawyer is registered in his own country,, he can normally not plead in Court in Thailand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Foreigners are restricted by law to be \u201cattorneys\u201d. That doesn\u2019t mean they are not qualify and can\u2019t work for a law firm. Any international law firm in Thailand do employ foreign attorneys, from Tilleke Gibbins, to Baker Mackenzie or ThaiLawOnline.. Yes, I know, we are way smaller than these 2 others! But we try to maintain high quality legal services.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"two-organisations\">\u0e2a\u0e2d\u0e07\u0e2d\u0e07\u0e04\u0e4c\u0e01\u0e23<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The Lawyers Council of Thailand (TLC) and the Thai Bar (TBA, \u0e40\u0e19\u0e15\u0e34\u0e1a\u0e31\u0e13\u0e11\u0e34\u0e15\u0e22\u0e2a\u0e20\u0e32) are the two bodies a Thai lawyer answers to. The TLC licenses lawyers and enforces their ethics; the Thai Bar is the body every applicant for a licence must first join (Lawyers Act B.E. 2528, section 35). That is the problem: Should a Bar Association represent the best interests of the lawyers or the best interest of the public? Well, not everyone follow their Ethical Code for Thai lawyers. But this is crucial.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"a-tlc\">\u0e01) \u0e17\u0e35\u0e41\u0e2d\u0e25\u0e0b\u0e35<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The TLC was created by the Lawyers Act B.E. 2528 (1985).<\/strong> Section 6 makes it a juristic person made up of its committee and its members, and section 7 gives it its objects, among them controlling lawyers&#8217; ethics and running welfare for its members. It registers and licenses lawyers: section 8(1) gives it that power and duty, and under section 36 the Board accepts the registration and issues the licence once the applicant meets the section 35 qualifications. Its committee is one representative of the Ministry of Justice, one of the Thai Bar, and a president and up to 23 other members elected by lawyers nationwide, at least nine of whom must have offices in the regions (section 14).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"b-tba\">\u0e02) \u0e23\u0e2d\u0e1b\u0e23\u0e30\u0e01\u0e32\u0e28<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Thai Bar is older than the Council<\/strong>, and the Lawyers Act treats it as an existing body. These practices were established a long time ago abroad to protect the public. There are still a lot to do in Thailand, to follow the Ethical Code for Thai lawyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0e44\u0e14\u0e49\u0e23\u0e31\u0e1a\u0e01\u0e32\u0e23\u0e15\u0e23\u0e27\u0e08\u0e2a\u0e2d\u0e1a\u0e25\u0e48\u0e32\u0e2a\u0e38\u0e14\u0e40\u0e21\u0e37\u0e48\u0e2d: 25 \u0e01\u0e31\u0e19\u0e22\u0e32\u0e22\u0e19 2026.<\/strong> The statements of law on this page were checked against the Lawyers Act B.E. 2528 (sections 6, 7, 14, 35 and 37), the Lawyers Council regulation on lawyers&#8217; ethics B.E. 2529, and its amendment No. 2 of B.E. 2566 as published in the Royal Gazette. Lawyers\u2019 ethical codes usually apply everywhere they practice, whether they\u2019re acting as an attorney or if they violate any rules through their behavior.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When someone uses titles like \u201clegal advisor,\u201d \u201clegal consultant,\u201d or \u201c<a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/director\/\">\u0e1c\u0e39\u0e49\u0e01\u0e33\u0e01\u0e31\u0e1a<\/a> of X,\u201d they often are not an \u201cattorney,\u201d \u201clawyer,\u201d or \u201cbarrister.\u201d It\u2019s important to ask for their qualifications, experience, and references. Remember, only Thai nationals can be licensed as lawyers in Thailand (Lawyers Act B.E. 2528, section 35). Genuine attorneys will not hesitate to share their legal status, education, and can easily provide their license number. You can also check their status with their Bar Association in Thailand or abroad if you wish.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"foreign-attorneys-must-follow-their-ethical-code\">\u0e17\u0e19\u0e32\u0e22\u0e04\u0e27\u0e32\u0e21\u0e15\u0e48\u0e32\u0e07\u0e0a\u0e32\u0e15\u0e34\u0e08\u0e30\u0e15\u0e49\u0e2d\u0e07\u0e1b\u0e0f\u0e34\u0e1a\u0e31\u0e15\u0e34\u0e15\u0e32\u0e21\u0e08\u0e23\u0e23\u0e22\u0e32\u0e1a\u0e23\u0e23\u0e13\u0e27\u0e34\u0e0a\u0e32\u0e0a\u0e35\u0e1e\u0e02\u0e2d\u0e07\u0e15\u0e19.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As for me, I was admitted to the Bar of Quebec but chose to resign a few years ago. Why? I was paying $2,000 in membership fees per year without receiving anything in return. Moreover, they required me to complete 30 hours of continuing education about Quebec laws every two years, despite my having lived and worked in Asia for over 10 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Leaving the bar was a better decision for me. However, I continuously learn about Thai law and strive to improve my knowledge and skills, as any lawyer should. I\u2019ve never been investigated for failing to follow an ethical rule. If your Thai lawyer doesn\u2019t do the work properly, do not hesitate to make a complaint to his Bar Association.
