to Do When Your Spouse Gives Marital Assets Away<\/h2>\n\n<p>One of the most common things we see before a divorce filing is not a hidden account \u2014 it is a\ngift. Money moved to a partner. A car put in a sibling&#8217;s name. A condo signed over to a parent\n&#8220;for safekeeping.&#8221; Thai law has a specific remedy for this, and it has a deadline that most people\nmiss.<\/p>\n\n<h3 class=\"tlo-warning\">File early \u2014 waiting costs you twice<\/h3>\n\n<p>This is the single most important point on this page, so it goes first.<\/p>\n\n<p>\u0e20\u0e32\u0e22\u0e43\u0e15\u0e49 <strong>CCC section 1480<\/strong>, an action to revoke an unauthorised dealing with marital\nproperty is barred:<\/p>\n\n<ul>\n  <li><strong>one year<\/strong> after you learn of the grounds for revocation; and<\/li>\n  <li><strong>ten years<\/strong> after the transaction itself, in any event.<\/li>\n<\/ul>\n\n<p>The one-year clock starts when you <em>find out<\/em> \u2014 not when you separate, not when you file for\ndivorce, and not when you finally decide to do something about it. Discovering a transfer and then\nspending eight months deciding whether to act can extinguish the claim outright.<\/p>\n\n<p>There is a second, less obvious cost to waiting, confirmed by the Supreme Court in\n<a href=\"https:\/\/www.thailawonline.com\/th\/supreme-court-decisions\/\">Decision\n139\/2569<\/a>: a gift of marital property <strong>remains valid until a court revokes it<\/strong>. That\nmeans the recipient is not in default until judgment, and interest on the money only starts running\nfrom the date of the judgment \u2014 not from the date the money left the account. In that case, a wife\nrecovered THB 1,431,731 in full but lost roughly two years of interest on it, purely because of timing.<\/p>\n\n<h3>When can a gift of marital property be revoked?<\/h3>\n\n<p><strong>CCC section 1476<\/strong> lists the dealings with <em>\u0e0b\u0e34\u0e19 \u0e0b\u0e2d\u0e21\u0e23\u0e2d\u0e2a<\/em> that spouses must manage\njointly or with the other&#8217;s consent. Subsection (5) covers gratuitous gifts (<em>hai doy sanaeha<\/em> \/\n\u0e43\u0e2b\u0e49\u0e42\u0e14\u0e22\u0e40\u0e2a\u0e19\u0e48\u0e2b\u0e32). A gift made by one spouse alone is revocable unless it clears a narrow two-part\nexception. The gift must be <strong>both<\/strong>:<\/p>\n\n<ul>\n  <li>for charitable purposes, for social purposes, or made in accordance with moral obligation;\n  <strong>\u0e41\u0e25\u0e30<\/strong><\/li>\n  <li>proportionate to the family&#8217;s station in life.<\/li>\n<\/ul>\n\n<p>This is frequently misstated as four separate exceptions, which would let any gift through so long as\nit was proportionate to the family&#8217;s means. It does not work that way \u2014 a gift must satisfy both limbs.\nA temple donation of a sensible size is covered. A customary family wedding gift is covered. A\nseven-figure transfer to a romantic partner fails both.<\/p>\n\n<h3>The third-party defence \u2014 and why it usually fails against a gift<\/h3>\n\n<p>Section 1480 protects a third party who received the property <strong>in good faith\n<em>\u0e41\u0e25\u0e30<\/em> for value<\/strong>. Both limbs are required. Because a gift by definition has no\nconsideration, the recipient of a gift cannot rely on this protection no matter how innocent they\nwere. This is why revocation claims against a gift recipient are considerably stronger than claims\nagainst a buyer.<\/p>\n\n<p>The practical consequence: if your spouse <em>sold<\/em> the asset to a genuine arm&#8217;s-length buyer,\nyour claim is likely against your spouse, not the asset. You can run\nthem in sequence.<\/p>\n\n<p>But note the interaction with the limitation period. If you settle the compensation claim first and\nthe section 1480 one-year clock has been running the whole time, you may win the first case and lose\nthe right to bring the second. Sequence them deliberately, not by accident.<\/p>\n\n<h3>What to do, in order<\/h3>\n\n<ol>\n  <li><strong>Date your discovery.<\/strong> Write down when you learned of the transfer and how. This\n  is the fact the one-year limitation period turns on, and you may have to prove it.<\/li>\n  <li><strong>Preserve the evidence.<\/strong> Bank statements, transfer slips, Land Department records,\n  chat messages, photographs of the asset. Get these before accounts are closed or access is cut off.<\/li>\n  <li><strong>Do not ratify.<\/strong> Section 1480 removes your right to revoke if you have ratified the\n  transaction. Avoid anything that reads as approval after the fact \u2014 signing consent documents,\n  accepting a share of the proceeds, written acknowledgements. Decision 139\/2569 confirms that\n  <em>avoiding<\/em> the transaction is not ratifying it, but do not create the argument in the first\n  place.<\/li>\n  <li><strong>Get the injunction question answered early.<\/strong> If further dissipation looks likely,\n  provisional measures to freeze the asset are worth considering before, not after, the next transfer.<\/li>\n  <li><strong>File the
