In Bangkok the general courts are split by subject and district: the Civil Court and the Criminal Court, plus the Bangkok South, Thonburi, Min Buri, Taling Chan and Phra Khanong courts. Outside Bangkok each province has a Provincial Court (san changwat) hearing civil and criminal cases. Alongside them sit the Kwaeng Courts (san kwaeng), the district courts for small matters: civil claims not exceeding 300,000 baht and criminal charges carrying at most three years imprisonment or a 60,000 baht fine, tried by a single judge.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>Specialised courts<\/strong> are also courts of first instance: the Labour Court, the Tax Court, the Central Intellectual Property and International Trade Court, the Central <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/bankruptcy\/\">\u0e01\u0e32\u0e23\u0e25\u0e49\u0e21\u0e25\u0e30\u0e25\u0e32\u0e22<\/a> Court, and the Juvenile and Family Courts in every province. Their appeals go to the Court of Appeal for Specialised Cases. The Administrative Courts and the Constitutional Court are separate systems.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"practical-points-for-a-foreigner-going-to-court\">\u0e02\u0e49\u0e2d\u0e1b\u0e0f\u0e34\u0e1a\u0e31\u0e15\u0e34\u0e2a\u0e33\u0e2b\u0e23\u0e31\u0e1a\u0e0a\u0e32\u0e27\u0e15\u0e48\u0e32\u0e07\u0e0a\u0e32\u0e15\u0e34\u0e43\u0e19\u0e01\u0e32\u0e23\u0e40\u0e14\u0e34\u0e19\u0e17\u0e32\u0e07\u0e44\u0e1b\u0e28\u0e32\u0e25<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>Where to file.<\/strong> A civil claim is filed where the defendant is domiciled or where the cause of action arose, so a Pattaya condominium dispute goes to the Pattaya Provincial Court, not to Bangkok. A divorce, <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/child-custody\/\">\u0e01\u0e32\u0e23\u0e14\u0e39\u0e41\u0e25<\/a> or inheritance matter goes to the <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/family-court\/\">\u0e28\u0e32\u0e25\u0e40\u0e22\u0e32\u0e27\u0e0a\u0e19\u0e41\u0e25\u0e30\u0e04\u0e23\u0e2d\u0e1a\u0e04\u0e23\u0e31\u0e27<\/a> of the province, and an unpaid wages claim to the Labour Court, where no court fee is charged. A land dispute, however large, is an ordinary civil matter for the Provincial Court.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p><strong>What it costs and takes.<\/strong> A monetary civil claim carries a court fee of 2% of the amount claimed, capped at 200,000 baht. Every court holds a mediation session before trial, and many foreigner cases end there. A contested civil trial typically runs 12 to 18 months from filing to judgment; proceedings are in Thai, and a foreign party testifies through an interpreter. The Court of Appeal reviews the file; the Supreme Court hears civil cases only with its permission.
