It is a criminal offence under Section 81 of the Immigration Act B.E. 2522 (1979), punishable by imprisonment of up to 2 years, a <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/fine\/\">\u0e14\u0e35<\/a> of up to 20,000 baht, or both. It is a settlement fine under the Immigration Act, paid at the immigration counter on departure or at an <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/immigration-bureau\/\">\u0e2a\u0e33\u0e19\u0e31\u0e01\u0e07\u0e32\u0e19\u0e15\u0e23\u0e27\u0e08\u0e04\u0e19\u0e40\u0e02\u0e49\u0e32\u0e40\u0e21\u0e37\u0e2d\u0e07<\/a> when applying to regularise the stay, and paying it closes the criminal case with no court record. There is no grace period: the day after the &#8220;admitted until&#8221; date is day 1, and the count includes weekends and holidays.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>Since 2016 a ministerial order has added a re-entry ban on top of the fine. A foreigner who reports and leaves voluntarily is banned for 1 year after an overstay of more than 90 days, 3 years after more than 1 year, 5 years after more than 3 years and 10 years after more than 5 years. A foreigner caught and prosecuted is banned for 5 years for an overstay under 1 year and 10 years for longer. The ban is recorded on the immigration <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/blacklist\/\">\u0e1a\u0e31\u0e0d\u0e0a\u0e35\u0e14\u0e33<\/a> and applies on the next attempted entry.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"practical-points-for-a-foreigner-who-has-overstayed\">\u0e02\u0e49\u0e2d\u0e04\u0e27\u0e23\u0e1b\u0e0f\u0e34\u0e1a\u0e31\u0e15\u0e34\u0e2a\u0e33\u0e2b\u0e23\u0e31\u0e1a\u0e0a\u0e32\u0e27\u0e15\u0e48\u0e32\u0e07\u0e0a\u0e32\u0e15\u0e34\u0e17\u0e35\u0e48\u0e2d\u0e22\u0e39\u0e48\u0e40\u0e01\u0e34\u0e19\u0e27\u0e35\u0e0b\u0e48\u0e32 (\u0e42\u0e2d\u0e40\u0e27\u0e2d\u0e23\u0e4c\u0e2a\u0e40\u0e15\u0e22\u0e4c)<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><p>For an overstay under 90 days the practical route is to go to the airport, pay the fine in cash at the immigration desk, and leave; the officer stamps the passport with the overstay and the fine, and no ban follows. A foreigner who wants to stay rather than leave must first pay the fine at the local immigration office; an <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/extension-of-stay\/\">\u0e01\u0e32\u0e23\u0e02\u0e22\u0e32\u0e22\u0e40\u0e27\u0e25\u0e32\u0e1e\u0e33\u0e19\u0e31\u0e01<\/a> is not granted while the stay is irregular, and offices refuse extension applications from overstayers except on documented medical grounds.<\/p><\/p>\n\n\n<p class=\"wp-block-paragraph\"><p>The common mistake is to wait. Every day adds to the fine until day 40 and, more seriously, the 90-day line turns a fine into a ban. Being stopped at a police checkpoint, a hotel check or an immigration raid after that line means arrest, a court appearance for the Section 81 fine, transfer to the Immigration Detention Centre and <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/deportation\/\">\u0e01\u0e32\u0e23\u0e40\u0e19\u0e23\u0e40\u0e17\u0e28<\/a> at the foreigner&#8217;s own cost. Bail from the detention centre is possible but expensive.<\/p><\/p>\n\n\n<h2 class=\"wp-block-heading\"
