The Act as enacted was read in full, and the three amending instruments that matter to this page were read as <strong>scanned Gazette pages<\/strong>: the Military Service Act (No. 2) B.E. 2498 (vol. 72 part 66, special issue p.2, 26 August 2498), whose section 3 replaced section 14; the Act (No. 3) B.E. 2507 (vol. 81 part 7, p.51, 21 January 2507), whose section 6 replaced the discharge ladder; and the Act (No. 4) B.E. 2516 (vol. 90 part 75, special issue pp.5 to 10, 29 June 2516), whose sections replaced section 16 and section 33 and whose section 11 replaced all three penalty sections. Sections 4, 7, 9, 13, 14, 16, 25, 29, 33, 39, 43, 44 and 45 were each read against the operative text, not against a summary. <strong><a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/supreme-court-dika\/\">\u0e28\u0e32\u0e25\u0e0e\u0e35\u0e01\u0e32<\/a> Decision 9306\/2539<\/strong> was read in full in Thai, to its disposition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Two things were verified here that this page turns on, and they are stated because a reader has no way to check them. First, section 14 (8) as replaced in 1955 reads simply <strong>a person who has been naturalised as Thai under the law<\/strong>. The words <strong>or a person whose father is an alien<\/strong>, which the Act carried in 1954, are not in the replacement, so a foreign father does not take a son outside the call-up. Second, the discharge ages of 30, 40 and 46 sit in <strong>section 39<\/strong>, which section 6 of the 1964 Act replaced; section 35 is a different provision about registering on the active-service roll, and this page previously cited it by mistake.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>What this review does not cover, said rather than implied: the personnel and intake figures, the April timetable and the district-office practice described throughout, which are administration and reporting rather than statute; the ministerial regulations that set the education deferment conditions and the shortened service for special qualifications, which the Act delegates and which were not read; and the political and public-opinion passages, which are class=\"wp-block-paragraph\">The Royal Thai Armed Forces consist of three main branches: the Royal Thai Army, the Royal Thai Navy, and the Royal Thai Air Force. As of 2020, approximately 360,850 active military personnel serve, alongside 200,000 reservists. The men liable for service are those aged 18 complete and not yet 30 complete under section 4 (2) of the Military Service Act B.E. 2497, and section 39 releases a man from military service at 46. The RTARF is under the command of the King of Thailand. The Minister of Defence oversees military operations. Section 50 (5) of the Constitution B.E. 2560 makes it a duty of every person to serve in the armed forces as provided by law, and section 7 of the Military Service Act B.E. 2497 is the law that provides it, limiting the duty to men of <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/thai-citizenship\/\">\u0e2a\u0e31\u0e0d\u0e0a\u0e32\u0e15\u0e34\u0e44\u0e17\u0e22<\/a>. When individuals turn 21, they must join a conscription lottery. A red card means they will enlist in the Thai military. This service usually lasts for two years. Conversely, a black card indicates an exemption from service. The 1905 conscription law is where the practice began, but it is not the law in force. The governing statute today is the Military Service Act B.E. 2497 (1954), whose section 3 repealed its predecessor. It aims to provide a steady supply of military personnel. They are required to pass thorough health assessments, which include physical exams that evaluate potential diseases and disabilities that may impede their service. Factors such as height and chest circumference are also considered in assessing fitness. Higher educational qualifications can lead to reduced service obligations, and students may be deferred under Section 29(3) of the Act on the conditions and age limits set by ministerial regulation rather than by the Act itself. It is crucial for eligible men to report, because failing to do so is an offence: up to three months or 300 baht under Section 44 for a registration or summons failure, and up to three years under Section 45 for failing to appear for selection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"the-law-military-service-act-2497\">The Law: the Military Service Act B.E. 2497<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Conscription in Thailand is not policy or custom. It is one statute, and almost every question a foreign family asks is answered inside it. The governing law is the <strong>Military Service Act B.E. 2497 (1954)<\/strong>, published in the Royal Gazette volume 71, part 13, page 195, on 16 February 1954. Section 3 repealed the Military Service Act B.E. 2479 that preceded it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>It has been amended five times and not once since 1973<\/strong>: Act (No. 2) B.E. 2498, Act (No. 3) B.E. 2507, Revolutionary Council Announcement No. 226 of 18 October B.E. 2515, Revolutionary Council Announcement No. 300 of 13 December B.E. 2515, and Act (No. 4) B.E. 2516. The two Announcements of B.E. 2515 carry the force of law and between them replaced Sections 4, 5, 9, 14, 24, 25, 27, 28 and 28 bis, which is why a section quoted in its 1955 or 1964 form may in fact stand in its 1972 one. That matters more than it sounds, and we come back to it when we reach the fines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Above the Act sits one line of the Constitution. <strong>Section 50 (5) of the Constitution B.E. 2560<\/strong>, in the chapter on the duties of the Thai people, makes it a duty &#8220;to serve in the armed forces as provided by law&#8221;. Note what it does and does not say: the constitutional duty falls on every person and its content is left entirely to statute. <strong>The limitation to men is not constitutional. It is section 7 of the Act<\/strong>, which provides that every man who is of Thai nationality under the law has the duty to serve in the military personally. Section 7 has never been amended.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"nationality-is-the-trigger\">Nationality is the trigger, not residence<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is the point that catches families who have lived abroad for years. Section 7 attaches to <strong>\u0e2a\u0e31\u0e0d\u0e0a\u0e32\u0e15\u0e34\u0e44\u0e17\u0e22<\/strong>. It says nothing about where a man lives, where he was born, whether he holds another passport, or whether he has ever set foot in Thailand. A son who holds Thai nationality is inside the Act whatever else is true of him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Naturalised Thais are treated differently, and the difference is precise. <strong>Section 14 (8)<\/strong>, in its current form from Revolutionary Council Announcement No. 226 of B.E. 2515, places a person who has been naturalised as Thai among those who are <strong>registered but not called up in peacetime<\/strong>. The register still applies; the call-up does not. Section 14 also covers monks and novices of recognised standing, religious officials of other faiths certified by the provincial governor, men undergoing reserve officer training, students of the Armed Forces Academies Preparatory School, certain teachers, and men with heavy <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/criminal-record\/\">criminal records<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two traps here for anyone reading older English sources. The original 1954 section 14 (8) also excused a man <strong>whose father was an alien<\/strong>. Act (No. 2) B.E. 2498 removed that limb in 1955, and it has not come back. And section 14 is a list of men who are registered and not called, which is not the same thing as a man who is outside the Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"the-two-dates-that-matter\">The two dates that matter: registration and selection<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 16<\/strong>, in its current form from Act (No. 4) B.E. 2516, requires every man of Thai nationality, in the Buddhist year in which he enters his eighteenth year of age, to present himself for entry on the register of men liable to service at the district office of his military domicile, within that year. A man who cannot attend in person must send a competent and trustworthy adult to notify on his behalf; <strong>if nobody goes, he is treated as evading<\/strong>. A man registered under section 16 becomes liable from <strong>1 January of the following year<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u26a0\ufe0f Older guides, and the 1954 text still circulating online, give a <strong>November deadline<\/strong> for registration. Act (No. 4) B.E. 2516 replaced section 16 and the November wording went with it. The deadline is now the end of the Buddhist year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 25<\/strong>, as replaced by Revolutionary Council Announcement No. 300 of B.E. 2515, requires a registered man, in the Buddhist year in which he enters his twenty-first year, to present himself at that same district office <strong>to collect the summons<\/strong>. Again a representative may collect it, and again, if nobody does, he is treated as evading. <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 26<\/strong> requires the district officer to publish the notice each October.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So the sequence the Act actually sets is: register in the year you enter your eighteenth year, collect the summons in the year you enter your twenty-first, attend the selection. Two separate duties at two separate district-office visits, three years apart, and the first one is the one families abroad miss.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"the-age-range\">The real age range, and where 45 comes from<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The commonly quoted range of 21 to 45 is wrong at both ends. <strong>Section 4 (2)<\/strong>, from Act (No. 4) B.E. 2516, defines the pool of men liable for service as those <strong>aged 18 complete and not yet 30 complete<\/strong> who have been registered under section 16 or section 18. <strong>\u0e21\u0e32\u0e15\u0e23\u0e32 39<\/strong>, as replaced by section 6 of Act (No. 3) B.E. 2507, then sets the discharge ladder: reserve class 2 at <strong>30<\/strong> years complete, class 3 at <strong>40<\/strong>, and release from military service at <strong>46<\/strong>, not 45.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"deferment-under-section-29\">Deferment: section 29, and the thirty-day rule nobody mentions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 29<\/strong>, never amended, applies where more men are available than the forces need, and grants deferment to three categories: a man who must support a parent who is incapable, disabled or too old to earn a living and who has nobody else to support them; a man who must support a child whose mother has died or is incapable, or an orphaned brother or sister who cannot support themselves; and <strong>a man in the course of education as prescribed by ministerial regulation<\/strong>. Where several sons would be called up together, only one is deferred on the parental ground, chosen by the parent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ud83d\udd34 <strong>The procedural trap is in the same section.<\/strong> A claim on the first two grounds must be filed with the district officer <strong>not less than thirty days before the selection day<\/strong>, except in a special case that is not the claimant&#8217;s fault. A genuine ground filed on the day is a ground filed late.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"what-the-penalties-actually-are\">What the penalties actually are<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">All three penalty sections were last replaced by section 11 of Act (No. 4) B.E. 2516, and this is where the Act&#8217;s age shows.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 44<\/strong>, failing to register, failing to re-register, refusing registration, or failing to collect the summons: imprisonment not exceeding <strong>\u0e2a\u0e32\u0e21\u0e40\u0e14\u0e37\u0e2d\u0e19<\/strong> \u0e2b\u0e23\u0e37\u0e2d <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/fine\/\">\u0e14\u0e35<\/a> not exceeding <strong>300 baht<\/strong>, or both. If the man comes forward himself before the officials take the matter up, it drops to one month or 100 baht, or both.<\/li>\n\n<li><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 45<\/strong>, evading or refusing to appear before the selection board, <strong>or appearing but not submitting to selection, or not staying until the selection is finished<\/strong>, or evading by any means so as not to serve, or serving in another man&#8217;s place, or demanding or accepting money or any benefit under a promise to help someone avoid service: imprisonment not exceeding <strong>\u0e2a\u0e32\u0e21\u0e1b\u0e35<\/strong>.<\/li>\n\n<li><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 43<\/strong>, failing to notify a change of locality or of name within the time allowed: imprisonment not exceeding one month or a fine not exceeding 200 baht, or both.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those baht figures are not typographical errors and they are not historical. They are the amounts fixed in 1973 and still in force, because the Act has not been amended since. <strong>The practical consequence is that the two offences are nothing like each other.<\/strong> Missing the registration or the summons is a 300 baht matter. Evading the selection itself carries up to three years, and section 45 is drafted widely enough to catch a man who turns up and then walks out before the draw is finished.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"two-years-and-ror-dor\">Two years, and the two ways it gets shorter<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u0e21\u0e32\u0e15\u0e23\u0e32 9<\/strong>, as replaced by Revolutionary Council Announcement No. 226 of B.E. 2515, fixes conscripted service at <strong>two years<\/strong>. Ministerial regulations may set less for men with special qualifications or in special cases, and the claim has to be made with evidence to the selection board on the day of selection, or to the unit on the day a man asks to enlist, not afterwards. The second route is the one families plan around: a man who has completed the Ministry of Defence military training course, the reserve training known as Ror Dor, may serve <strong>less than two years, or be enrolled and discharged straight into the reserve without serving at all<\/strong>. Section 45 of the Military Service Act punishes demanding, accepting or agreeing to accept money or any other benefit on a promise to help a man avoid conscription with up to three years in prison. Where an official is involved the Penal Code takes over: in Supreme Court Decision 9306\/2539 a district conscription clerk in Yannawa, Bangkok, who took money from eleven men called for selection was convicted on <strong>eleven counts<\/strong> under Penal Code Section 149 at five years each, and on a twelfth count of using a forged document under Sections 268 and 265 at four years. That is fifty-nine years, and <strong>Section 91(3) cut it to the fifty-year maximum<\/strong>. The 300,000 baht was forfeited. The Supreme Court dismissed the forged-seal counts under Sections 251 and 252 and otherwise affirmed. The clerk argued he was not a competent official at all because selection is the board\u2019s function; the Court held that his appointment by the district head under Section 28 quater (2) of the Military Service Act made him one for this purpose.
