within 84 days, which is in fact the maximum pre-charge <strong>detention<\/strong> period under Criminal Procedure Code section 87, and only for offences carrying ten years or more. The general rule is <strong>section 420 of the Civil and Commercial Code<\/strong>: a person who wilfully or negligently and unlawfully injures the life, body, health, liberty, property or any right of another commits a wrongful act and must make compensation.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><strong>For a road accident there is a second rule that matters more, and most foreign victims are never told about it.<\/strong> \u0e20\u0e32\u0e22\u0e43\u0e15\u0e49 <strong>section 437<\/strong>, a person who has in his possession or control a <strong>conveyance propelled by mechanism<\/strong> is responsible for the injury it causes <strong>unless he proves<\/strong> that the injury resulted from force majeure or from the fault of the injured person. The burden sits on the person in control of the vehicle, not on the person it hit. So an injured pedestrian, passenger or motorcyclist does not begin by having to prove how the driver was careless: the driver begins by having to explain. The same rule applies to things that are dangerous by their nature or through their mechanical action.<\/p>\n\n\n<p class=\"wp-block-paragraph\">That does not make a claim automatic. If the injured person was partly at fault, <strong>section 442<\/strong> applies <strong>section 223<\/strong>, and compensation depends on the circumstances, above all on how far the injury was caused chiefly by one side or the other. Riding without a helmet, crossing away from a crossing or riding without a licence are the kinds of facts a Thai court weighs here. Engaging an expert legal team is crucial, as they can help gather the necessary evidence, represent you in negotiations, and ensure that any settlement is fair and proportionate to the damages suffered.<\/p>\n\n\n<h3 class=\"wp-block-heading\" id=\"what-you-can-claim-and-by-when\">What you can claim, and the deadline that ends it<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The court fixes the manner and extent of compensation according to the circumstances and the gravity of the wrongful act (<strong>section 438<\/strong>). Where a person is injured, <strong>section 444<\/strong> covers expenses and damages for total or partial inability to work, present and future, and lets the court <strong>reserve the right to revise its judgment for up to two years<\/strong> where the consequences of the injury cannot yet be known, which matters in a head or spinal injury. <strong>Section 446<\/strong> allows a claim for damage that is not pecuniary loss, the nearest Thai equivalent to pain and suffering; that claim is personal and does not pass to heirs unless it has been acknowledged or an action has already been started. Where the accident causes death, <strong>section 443<\/strong> covers funeral and other necessary expenses, medical treatment and loss of earnings if death was not immediate, and compensation for anyone deprived of legal support they were entitled to.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><strong>The deadline is short and it is the single most common way a foreign victim loses a good claim.<\/strong> \u0e20\u0e32\u0e22\u0e43\u0e15\u0e49 <strong>section 448<\/strong>, a claim for damages from a wrongful act is barred <strong>\u0e2b\u0e19\u0e36\u0e48\u0e07\u0e1b\u0e35<\/strong> from the day the injured person knew both of the wrongful act and of the person liable to pay, and in any event <strong>\u0e2a\u0e34\u0e1a\u0e1b\u0e35<\/strong> from the day the act was committed. Where the act is also a criminal offence carrying a longer limitation period, that longer period applies instead. One year passes quickly when you have gone home to recover, and an insurer discussing a settlement is not stopping the clock.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"criminal-liability-in-thailand\">\u0e04\u0e27\u0e32\u0e21\u0e23\u0e31\u0e1a\u0e1c\u0e34\u0e14\u0e17\u0e32\u0e07\u0e2d\u0e32\u0e0d\u0e32\u0e43\u0e19\u0e1b\u0e23\u0e30\u0e40\u0e17\u0e28\u0e44\u0e17\u0e22<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Criminal liability, on the other hand, pertains to the state\u2019s prosecution of an individual believed to have violated traffic laws, leading to an accident. Charges may include reckless driving, driving under the influence of alcohol or drugs, or other traffic offences. Where the harm was caused by negligence rather than intention, the Criminal Code grades it by the injury done: <strong>section 390<\/strong>, causing injury to body or mind by negligence, up to one month or a fine of up to 10,000 baht, or both; <strong>section 300<\/strong>, causing grievous bodily harm by negligence, up to three years or a fine of up to 60,000 baht, or both; and <strong>section 291<\/strong>, causing death by negligence, up to ten years and a fine of up to 200,000 baht. Knowing which of the three is in play tells you how serious your position is.<\/p>\n\n\n<p class=\"wp-block-paragraph\">A word on the figure people repeat about police investigations. <strong>Eighty-four days is not an investigation deadline.<\/strong> It is the longest a court may order a person to be held in custody before charge under <strong>section 87 of the Criminal Procedure Code<\/strong>, in periods of no more than twelve days at a time, and only where the offence carries a maximum penalty of <strong>ten years or more<\/strong>. For an offence above six months and below ten years the total is <strong>48 days<\/strong>, and at six months or below it is <strong>seven days<\/strong> on a single order. It does not run at all against someone who has been released on bail, and it says nothing about how long the police may take to complete a file.<\/p>\n\n\n\n<p
