The accused pays compensation, the injured party withdraws the complaint, and the case dies. Expats are often on one side of this bargain, as the victim of a <a href=\"https:\/\/www.thailawonline.com\/glossary\/fraud\/\">fraud<\/a> who wants their money back, or as a defendant hoping that paying up will make a criminal charge disappear. The court initially showed leniency: it deferred fixing any punishment for three years under <strong>Section 56 of the Penal Code<\/strong>, with one year of probation, on conditions that included paying the victim at least 5,000 baht a month until a further 100,000 baht agreed in a settlement had been paid within 20 months (she had already paid 50,000).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She paid three instalments and stopped. When she failed to appear, the court revoked the probation conditions and fixed the punishment it had deferred: six months in prison, halved to three months for her guilty plea. She could have appealed that order under section 34 of the Probation Act B.E. 2559, but did not, so it became final. Only then, with the judgment already final, did she pay 80,000 baht in restitution, and the victim, now satisfied, asked to withdraw the criminal complaint. The lower courts, treating the case as pending again, allowed the withdrawal and struck the case from the court&#8217;s list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court reversed. Explaining why <strong>Section 39(2) of the Criminal Procedure Code<\/strong> no longer applied, it held that the withdrawal of a complaint in a <a href=\"https:\/\/www.thailawonline.com\/glossary\/compounding-offense\/\">compoundable offence<\/a> extinguishes the prosecution only while the case is still pending. After the judgment becomes final, a withdrawal <em>has no legal effect whatsoever<\/em>. The three-month prison sentence was reinstated. The Court also confirmed, under <strong>Section 34 of the Probation Act B.E. 2559 (2016)<\/strong>, the procedural framework governing challenges to probation revocation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"compoundable-offences-the-legal-background\">Compoundable offences: the legal background<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thai criminal law distinguishes between two categories of offences. Non-compoundable offences (\u0e04\u0e27\u0e32\u0e21\u0e1c\u0e34\u0e14\u0e2d\u0e32\u0e0d\u0e32\u0e41\u0e1c\u0e48\u0e19\u0e14\u0e34\u0e19), such as <a href=\"https:\/\/www.thailawonline.com\/glossary\/theft\/\">theft<\/a> in most forms, drug offences, or serious violence, are prosecuted in the name of the state, and the victim&#8217;s forgiveness does not stop the case. Compoundable offences (\u0e04\u0e27\u0e32\u0e21\u0e1c\u0e34\u0e14\u0e2d\u0e31\u0e19\u0e22\u0e2d\u0e21\u0e04\u0e27\u0e32\u0e21\u0e44\u0e14\u0e49), including ordinary <a href=\"https:\/\/www.thailawonline.com\/fraud-and-scam-laws-in-thailand\/\">fraud under Section 341<\/a>, criminal <a href=\"https:\/\/www.thailawonline.com\/foreigners-facing-defamation-charges-thailand\/\">defamation<\/a>, embezzlement, and trespass, exist primarily to protect the injured person, so that person can end the prosecution by settling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 39(2) of the <a href=\"https:\/\/www.thailawonline.com\/thai-criminal-procedure-code\/\">Criminal Procedure Code<\/a>, the right to prosecute a compoundable offence is extinguished when the complaint is withdrawn or the parties lawfully compromise. This is the legal engine behind most criminal settlements in Thailand. The conditions for controlling the conduct of an offender under paragraph one may be fixed by the court, one or several as may be appropriate to the case, as follows: (1) to report in person from time to time to the official designated by the court, so that the official may question, advise, assist, or admonish the offender as it thinks fit as to conduct and occupation, or to arrange for the offender to perform social service or public benefit activities; (2) to train for or to carry on a regular lawful occupation; (3) to refrain from association, or from any conduct, that might lead to the commission of a similar offence again; (4) to undergo treatment for narcotic addiction, for physical or mental deficiency, or for any other illness, at the place and for the period fixed by the court; (5) to undergo training at the place and for the period fixed by the court; (6) to be prohibited from leaving the place of residence, or from entering any place, during the times fixed by the court, and for this purpose an electronic device or any other device capable of monitoring or restricting travel may be used; (7) to pay compensation, or otherwise to remedy the damage, to the injured person as agreed between the offender and the injured person; (8) to repair, restore, or remedy damage caused to natural resources or to the environment, or to pay compensation for that purpose; (9) to enter into a bond in such sum as the court thinks fit that the offender will not commit an act of mischief or cause danger to another person or to property; (10) any other condition that the court thinks fit to fix in order to correct or rehabilitate the offender, or to prevent the offender from committing or having the opportunity to commit an offence again, or any condition for remedying the injured person as the court thinks fit. From that moment, the case is no longer &#8220;pending&#8221; and there is nothing left for a withdrawal to extinguish. Late restitution may still matter for other purposes, it can support a petition for a <em>royal pardon<\/em> or improve the offender&#8217;s position in parole and sentence-reduction decisions, but it cannot erase the conviction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"the-second-lesson-probation-conditions-are-not-optional\">The second lesson: probation conditions are not optional<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The defendant in Dika 7211\/2568 lost her freedom twice over. The court had already given her the benefit of <a href=\"https:\/\/www.thailawonline.com\/suspended-sentences-in-thailand-probation-rules-for-expats\/\">a deferred sentence under Section 56 of the Penal Code<\/a>, on the condition that she compensate her victim in instalments. When she stopped paying, the deferral was revoked and a prison term was fixed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thai courts routinely attach compensation schedules to <a href=\"https:\/\/www.thailawonline.com\/glossary\/suspended-sentence\/\">suspended sentences<\/a> in fraud and embezzlement cases. Defendants sometimes treat these schedules casually, assuming that partial payment or a later lump sum will smooth things over. This decision shows the opposite: non-compliance triggers revocation, and once revocation and the resulting sentence are final, even full payment plus the victim&#8217;s forgiveness comes too late.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-this-means-for-expats\">What this means for expats<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"if-you-are-the-injured-party\">If you are the injured party<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Your leverage is greatest while the case is alive. A criminal complaint for fraud or embezzlement is often the most effective debt-recovery tool in Thailand precisely because the defendant can only make the case go away by satisfying you before final judgment. Use that window: negotiate a settlement that is paid, not merely promised, before you withdraw, and record the settlement in writing before the court where possible.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"if-you-are-the-defendant\">If you are the defendant<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Settle early. The realistic opportunities are at the police stage, during trial, or at the latest while an appeal is pending. Waiting until after conviction to &#8220;fix it with money&#8221; is a strategy the Supreme Court has now explicitly closed. And if you receive a suspended sentence with conditions, treat every condition, payment schedules, reporting, community service, as strictly binding, because revocation proceedings move quickly and, as this case shows, are effectively irreversible once final.
