A Supreme Court decision published this month, Dika 2412\/2569, confirmed prison terms for two adults who photographed themselves, consented to each other&#8217;s participation, and posted the images to their own public account on X, the platform formerly called Twitter. Nobody was coerced, nobody was a minor, and nobody complained. They were still convicted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The sentence was six months&#8217; imprisonment each plus a fine, and the Supreme Court did not suspend it. Section 287 of the Penal Code covers making, possessing for trade, importing or distributing obscene documents, drawings and images, and section 388 punishes indecent behaviour in public. Those provisions were written for printed matter and for conduct in the street, and they carry relatively modest penalties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0e40\u0e14\u0e2d\u0e30 <em>Computer Crime Act B.E. 2550 (2007)<\/em> changed the arithmetic. Once obscene material is put into a computer system in a form the public can reach, the conduct is prosecuted under section 14 of that Act, which is punishable by up to five years&#8217; imprisonment, a fine, or both. The internet is not treated as a lighter forum than the street; it is treated as a heavier one. Our <a href=\"https:\/\/www.thailawonline.com\/th\/glossary\/computer-crime-act\/\">glossary entry on the Computer Crime Act<\/a> sets out the structure of the statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two features of the Act catch foreigners out repeatedly. It applies to conduct in Thailand regardless of where the platform or the server sits, and it does not require a victim. A police officer scrolling a public timeline is enough to start a case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dika-2412-2569-consent-did-not-save-them\">Dika 2412\/2569: consent did not save them<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"the-facts\">\u0e02\u0e49\u0e2d\u0e40\u0e17\u0e47\u0e08\u0e08\u0e23\u0e34\u0e07<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Two defendants photographed themselves together. The images showed genitals and breasts and were, on the courts&#8217; finding, obscene in character. They uploaded the photographs to a Twitter account that was open to the public rather than locked or restricted to approved followers. Both had consented; they were the only people depicted.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"what-the-supreme-court-decided\">\u0e04\u0e33\u0e15\u0e31\u0e14\u0e2a\u0e34\u0e19\u0e02\u0e2d\u0e07\u0e28\u0e32\u0e25\u0e2a\u0e39\u0e07\u0e2a\u0e38\u0e14<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court modified the lower courts&#8217; judgments on the legal characterisation but upheld the convictions. It held that entering the images into a public account is itself the act of dissemination, so the conduct is one offence under section 14 rather than a stack of separate offences. Applying Penal Code section 91, simultaneous and continuous acts forming a single course of conduct are punished once.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court reduced the penalty by half for mitigating circumstances under Penal Code section 78, leaving six months&#8217; imprisonment and a fine of 500 baht for each defendant. Critically, the imprisonment was <strong>\u0e44\u0e21\u0e48<\/strong> suspended. Penal Code sections 83 (principals), 29 and 30 (enforcement of unpaid fines) and Criminal Procedure Code sections 195(2) and 225 (the court&#8217;s power to correct points of law of its own motion) also feature in the reasoning. The Thai text is on the <a href=\"https:\/\/deka.in.th\/deka\/2569-2412\" target=\"_blank\" rel=\"noopener\">Dika database<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Assumption<\/th><th>What Dika 2412\/2569 held<\/th><\/tr><\/thead><tbody><tr><td>It is my own body, so it is my business<\/td><td>Irrelevant. Here the six-month term was not suspended.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-section-14-of-the-computer-crime-act-actually-says\">What section 14 of the Computer Crime Act actually says<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 14 lists several ways of committing the offence. The limbs that mattered in this case were the entry of computer data of an obscene nature that the public may access, and the dissemination or forwarding of such data by a person who knows what it contains. The prosecution in Dika 2412\/2569 relied on section 14(1), (4) and (5) together.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Entering the data<\/strong>: uploading the image to the platform.<\/li>\n\n\n\n<li><strong>Obscene character<\/strong>: judged on the content itself, not on the poster&#8217;s intention or artistic claim.<\/li>\n\n\n\n<li><strong>Public accessibility<\/strong>: an open account, an unlocked profile, a public group or a link anyone can open.<\/li>\n\n\n\n<li><strong>Knowledge<\/strong>: for the dissemination limb, knowing what the material is when you pass it on.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The public-accessibility element is where most people&#8217;s real exposure sits. A locked account with approved followers, a paid platform behind a login, and a closed chat are not the same thing as an open timeline, although none of them is a guaranteed shelter and the line has not been tested exhaustively by the courts. What is settled after this decision is that an open account is squarely inside the section.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"uploading-and-sharing-are-one-offence-not-two\">Uploading and sharing are one offence, not two<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The single-offence point sounds technical and is worth understanding, because it cuts both ways. Prosecutors in online cases often charge each upload, each repost and each forward separately, which can turn one evening&#8217;s conduct into a sentence measured in years. The Supreme Court&#8217;s reasoning limits that: where the uploading and the dissemination are the same continuous act, section 91 treats them as one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The other side of the coin is that a genuinely separate later act (a fresh post weeks afterwards, a different platform, a new set of images) is a fresh offence. The ruling compresses a single incident; it does not forgive a pattern. Anyone facing a multi-count indictment for online material should have counsel test whether the counts survive section 91.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-this-means-for-expats-creators-and-couples\">What this means for expats, creators and couples<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thailand hosts a large population of foreign residents who earn money from adult platforms or who simply live a good deal of their lives online. The practical exposure is wider than most of them think, and immigration consequences sit behind the criminal ones: a conviction and a custodial sentence can affect visa extensions and, in serious cases, removal.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Running an open adult account from Thailand, even if the subscribers and the company are abroad.<\/li>\n\n\n\n<li>Reposting or forwarding explicit images into a public group, which is the dissemination limb of section 14.<\/li>\n\n\n\n<li>Selling content through a link that anybody can open without a login.<\/li>\n\n\n\n<li>Sharing intimate images of a former partner, which adds the far more serious offences discussed in our guide to <a href=\"https:\/\/www.thailawonline.com\/th\/sex-crimes-in-thailand\/\">\u0e2d\u0e32\u0e0a\u0e0d\u0e32\u0e01\u0e23\u0e23\u0e21\u0e17\u0e32\u0e07\u0e40\u0e1e\u0e28\u0e43\u0e19\u0e1b\u0e23\u0e30\u0e40\u0e17\u0e28\u0e44\u0e17\u0e22<\/a> and potentially <a href=\"https:\/\/www.thailawonline.com\/th\/online-social-media-defamation-thailand\/\">online defamation<\/a>.<\/li>\n\n\n\n<li>Storing material that involves anyone under 18, which is a separate and much graver matter and is never a technicality.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">None of this is a reason to panic, and none of it turns a private photograph into a crime. The dividing line the courts are policing is publication to the public. Keep material private and the section 14 analysis does not begin.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"if-you-are-summoned-or-arrested\">If you are summoned or arrested<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Computer Crime Act cases usually begin with a summons from a technology crime unit rather than an arrest at the door, which gives you time to take advice before you say anything.
