เว้นแต่ผู้ทำพินัยกรรมจะได้กำหนดไว้เป็นอย่างอื่นในพินัยกรรม ผู้ปกครองทรัพย์จะทำพินัยกรรมตั้งบุคคลอื่นให้ทำการสืบแทนตนก็ได้
