ผู้จัดการมรดกจะทำนิติกรรมใด ๆ ซึ่งตนมีส่วนได้เสียเป็นปฏิปักษ์ต่อกองมรดกหาได้ไม่ เว้นแต่พินัยกรรมจะได้อนุญาตไว้ หรือได้รับอนุญาตจากศาล
