I write only once a month. Last month I promised an issue nobody enjoys thinking about: what happens in Thailand when you die, or when you can no longer speak for yourself. I have worked in the legal field for more than thirty years, and I have managed law firms in Thailand for twenty. In that time our office has drafted hundreds of wills, opened estates in Thai courts, sat with families in hospital corridors and untangled inheritances that went wrong years before anyone called a lawyer. This issue is built from those files, not from theory.

Three subjects this month. First, the last will: what actually stops working the day you die, which rights survive you, and why a proper bilingual will costs 3,900 baht at our firm when others quote 20,000 baht for the same document. Second, the documents that matter before death: the living will and the power of attorney, including an exchange I had in August with the director of an expatriate medical clinic about what actually happens at the bedside, and the court decision that settled whether living wills are binding in Thailand. Third, inheritance as it really unfolds: two true stories from our office, with names changed, including one that turned on a Supreme Court decision our weekly law watch flagged only weeks ago.

To our knowledge, no other law firm in Thailand publishes anything like it.

One principle joins everything below. In estate matters, paper is cheap while you are healthy and silence is expensive when you are not. Most of the misery we see in inheritance files was avoidable for less than the price of a hotel weekend in Hua Hin.

1. The Day You Die, Half Your Paperwork Dies With You

In August I compared the property rights foreigners use instead of nominee companies. The question I left open was the hard one: what happens to those rights, and to everything else you own here, at the moment of death? The answer surprises almost everyone, because rights that feel like ownership during your lifetime can evaporate in a single day.

Now the uncomfortable arithmetic. If you die without a will, Thai law distributes your estate among six classes of statutory heirs, starting with children and parents, with the spouse taking a share fixed by law (CCC Sections 1629 and 1635). The law is rational. It is also blind. It does not know that you were estranged from a brother for thirty years, that your partner of two decades was never registered as your spouse, or that you promised the condo to a stepdaughter Thai law does not recognise as your heir. Without a will, none of those wishes exist.

A valid Thai will is a simple, strict document

An ordinary Thai will must be in writing, dated, signed by you before at least two witnesses present at the same time (CCC Section 1656). A beneficiary, or the spouse of a beneficiary, must not witness or write the will (CCC Section 1653); we still see homemade wills ruined by exactly this. There are other forms, including a will written entirely in your own hand (Section 1657) and the public will made at the district office (Section 1658).

This year the public option became genuinely practical. Since 24 March 2026, under the new Ministerial Regulation on Wills B.E. 2569, a public will can be registered at any district office in the country on standardised forms, with proper identity and capacity checks, for a state fee of 250 baht, and a certified duplicate is kept in the state system. Because we believe in giving you the real law, not a summary of a rumour of it, the new procedure is documented in detail in our inheritance guide for foreigners.

So should you register your will at the amphur? My honest answer, for most people, is no. An ordinary will, properly drafted, signed before two qualified witnesses, is fully valid in Thailand, and in our long experience wills are very rarely contested. Registration adds a state record and a certified duplicate, which earns its 250 baht in particular situations: a family where a fight is foreseeable, a testator whose capacity might later be questioned, or someone with no safe place to keep the original. If that is you, we can prepare the file so the appointment is a formality. For everyone else, two witnesses and a well drafted document remain enough, and simpler is stronger.

Why 3,900 baht, and why others charge 20,000

Let me be blunt about pricing, because clients keep telling us what they were quoted elsewhere. A standard last will for an expatriate in Thailand is not a 20,000 baht document. It is a well understood legal instrument with strict formalities, and after hundreds of them, our office has refined bilingual models for nearly every family situation we meet. Modern tools, including AI working under a lawyer’s review, prepare the first draft from your instructions in minutes. The lawyer’s time goes where it belongs: your specific situation, the traps in your asset list, the witnesses, the signing.

That is why our bilingual last will, drafted and reviewed by a lawyer, costs 3,900 baht, with optional secure storage for 1,000 baht. For simple situations, our online Last Will Maker does it for 590 baht, and I want to be precise about what that is, because it is not a template with blanks. It is a tool built on our own documents and two decades of will files: it interviews you, applies our knowledge to your answers, and assembles the bilingual document itself. As far as I know, no other law firm in Thailand offers a tool like it, designed for expatriates and working in both Thai and English. When a firm quotes 20,000 baht or more for the same standard document, you are not paying for more law. You are paying for their office rent, or for the assumption that foreigners do not check prices. Ask them what exactly justifies the difference. It is a fair question, and we are comfortable with any honest answer you receive.

2. Before the Last Breath: Living Wills, Powers of Attorney and the Hospital Room

A will only speaks after death. The harder documents are the ones that speak when you are alive but cannot: unconscious after a motorbike accident, sedated in an ICU, or slipping into dementia. This is where I see the most confusion among expatriates, and the most false confidence.

What a clinic in Hua Hin sees that lawyers do not

In August I corresponded with, and then met, the director of a medical clinic that cares for a large expatriate community. He asked us to look at the living will document his patients rely on, and whether it still matched current law and hospital practice. I respected the question enormously, because it shows the medical side of a problem lawyers usually meet too late, and because asking is exactly what a responsible clinic should do.

A clinic sees the moment itself: the patient who arrives unconscious with no documents, the spouse who cannot say what treatment their partner would have refused, the adult children eight time zones away who disagree with each other while the doctors wait, the beautifully written directive in German or French that no Thai nurse can act on at three in the morning. Doctors want to treat. Hospitals want valid instructions and someone authorised to speak. When neither exists, the machines stay on, the bills grow, and the family carries a decision that should never have been theirs.

I will say this with respect, because that clinic does serious work: the document they were using is not at the level where we operate today. That is no insult. It is what happens to every legal form that stands still, because forms age quietly while the law, the court decisions and hospital practice keep moving. The difference is that updating these documents is our trade. We revise ours continuously, and in 2026 we rebuilt our living will completely: a bilingual document aligned with the regulation and with how Thai hospitals actually work, at a price that should embarrass nobody’s budget. That exchange is a model of how this should happen: checked before the crisis, not discovered during it.

The living will is binding law in Thailand, and a court confirmed it

Thailand answered the legal question years ago, and many expatriates still do not know it. Section 12 of the National Health Act B.E. 2550 (2007) gives every person the right to make a written declaration refusing medical treatment that serves only to prolong the final stage of dying. A Ministerial Regulation in force since 20 May 2011 sets out how a valid living will is made, and allows you to name a person to communicate your wishes to the medical team.

Doctors challenged that regulation in court, arguing it amounted to euthanasia and conflicted with medical ethics. The Supreme Administrative Court dismissed the challenge and upheld the regulation in full (Decision Red No. ฟ.11/2558, Black No. ฟ.147/2554, judgment of 18 June 2015). We have just published a full analysis of this decision on the site, because a right this important deserves more than a footnote. A living will that follows the rules is not a polite suggestion. It is a document the law requires healthcare providers to respect, and major private hospitals, including Bumrungrad and the Bangkok Hospital group, have built it into their patient rights policies, usually with two doctors confirming the terminal condition before treatment is withheld. What makes the difference in practice is a document in Thai and English, in the form hospitals recognise, with a named contact person they can reach.

The power of attorney trap almost nobody sees

Now the trap. Foreigners often believe a power of attorney solves incapacity: sign one while healthy, and your wife, brother or friend can manage everything if you cannot. Thai law says the opposite. Under Section 826 of the Civil and Commercial Code, agency is extinguished when the principal dies or becomes incapacitated. Thailand has no durable power of attorney of the kind Canadians, Americans or Britons know from home. The ordinary POA fails at exactly the moment you bought it for, and it fails again at death, when only a court appointed estate administrator may act.

If you become incapacitated with nothing in place, your family’s real remedy is a court proceeding to have you declared incompetent and a guardian appointed (CCC Section 28), a process that takes months, in Thai, while the bills arrive and the accounts sit frozen. I have watched a spouse borrow money to pay a hospital while a fortune sat untouchable in the patient’s own bank account. That is not a legal technicality. That is a family in real trouble because nobody told them Section 826 exists, and Thai courts apply it as written.

What actually works is a package built for Thai reality: a living will under Section 12 with a named spokesperson for medical decisions, specific powers of attorney for defined transactions while you remain capable, sensible banking arrangements with your spouse or partner, and a will so that the after death side is equally clean. Our bilingual living will, in its completely rebuilt 2026 edition, costs 1,900 baht, or 5,000 baht bundled with a last will, and our power of attorney page explains honestly what a Thai POA can and cannot do. If you hold a living will drafted years ago, or a form a clinic or friend gave you, have it reviewed. Paper you cannot rely on is worse than no paper, because it stops you from preparing the real thing.

3. Inheritance in Reality: Two Files From Our Office

Legal articles explain inheritance as a flowchart. Files never read like flowcharts. Over almost twenty years, first at Isaan Lawyers and now at ThaiLawOnline, estates have become one of our deepest specialities, not because we chose the subject but because the files kept coming, each one teaching something no textbook mentions. Here are two, real but disguised: names, nationalities and identifying details are changed and some facts are simplified.

Helga, the widow who had to become a court petitioner

Helga wrote to us from Austria after her husband died suddenly at their condo near Hua Hin. No Thai will. His assets were ordinary: the condominium, two Thai bank accounts, a pickup truck. She assumed, reasonably, that as his widow she could show a marriage certificate and collect what was his. Thailand does not work that way. The banks froze the accounts. The Land Office would register nothing. Every institution gave the same answer: bring a Thai court order appointing an estate administrator.

So we built one, at a distance, piece by piece: her documents from Austria, translated, legalised and certified through the embassy chain; proof of the marriage and of the heirs; a petition to the Thai court; a hearing our lawyer attended with her joining by video; then the certified order, and only then, months after the death, the first baht released. Start to finish it took the better part of a year, mostly waiting for foreign paperwork to move. With a 3,900 baht Thai will naming her as executor and listing the Thai assets, the same estate would have been a far shorter, far cheaper, largely administrative exercise. Helga said something at the end that stayed with me: nobody had ever told them. That is the sentence this newsletter exists to delete.

Rebecca, her father’s girlfriend, and the emptied accounts

Rebecca wrote to us from abroad after her father, a retired engineer from Northern Europe, died at his home in the North of Thailand. He had lived for years with his Thai girlfriend. They never registered a marriage, and he never made a will. Thai law is unsentimental about both facts: an unmarried partner is not an heir, so the estate belonged by law to his only child, Rebecca, and through her, in time, to his grandchildren. The law, however, was not the one holding his ATM cards.

While Rebecca organised a funeral from another continent, the accounts were being emptied: withdrawals and transfers using his cards and online banking, continuing even after the date of death on the certificate. That is unlawful, no matter how many years a couple shared a house. From the moment of death the money belongs to the estate, and only a court appointed estate administrator may touch it; a PIN code is not an inheritance right. By the time the banks froze what remained, most of it was gone, and a new house had been bought. We had Rebecca appointed administrator, obtained the statements, matched every movement of money against the timeline of the death, and traced where it went. The case is before the court now, seeking recovery of the funds and of the house bought with them, so I will say nothing more about it, except this: nothing in the file was exotic. No hidden fortune, no offshore structure. Just a PIN code, an unregistered relationship and a missing will.

Two lessons from two files. First, Thai inheritance law reads paper, not feelings, and it cuts both ways: an unmarried partner inherits nothing without a will, so if you want your partner protected, only a will protects them; and if your heirs live abroad, speed is everything once death occurs, because whoever holds the PIN moves faster than any court. Notify the banks at once, secure cards, phones and codes, and get the administrator petition moving. Second, expertise in this field is cumulative. Every estate we administer, every decision our weekly watch digests, makes the next file faster and cheaper for the client. The site now carries a weekly rhythm, not a monthly one. Every week, This Week in Thai Law reports what changed: new laws and regulations, enforcement that affects foreigners, and fresh Supreme Court decisions analysed in plain English, the way Decision 284/2569 on estate administrators who help themselves was analysed in August. Law firms usually publish when marketing departments need content. We publish when the law moves.

The State of Expat Law: what the first half of 2026 really changed

I believe strongly in this kind of publication. Rumours about Thai law spread in expat groups within hours; corrections never travel as far. A firm that documents, twice a year, what actually became law is doing something for the public record. To our knowledge, no other law firm in Thailand publishes a systematic review like it.

Lawyers need tools. This is ours.

Behind the weekly watch and the reports sits the asset we have quietly built for years: the Thai Law Library and the research database underneath it. The public side already offers 3,097 bilingual section pages across the Civil and Commercial Code, the Penal Code, both procedure codes and the Land Code, plus translated and annotated Supreme Court decisions spanning 1958 to 2025, with new decisions added every week. Counting the full research corpus of legislation and Supreme Court case law behind it, we believe this is the largest private legal database in Thailand, outside the government’s own systems.

Why does a client care? Because law is a tool trade. A carpenter with power tools is not a worse carpenter; he simply stops wasting his skill on what a machine does better. AI is that tool for lawyers. It reads a thousand decisions so the lawyer can think about yours; it prepares the first draft so the lawyer’s hour goes into judgment, not typing. Used without a database and without lawyer review, AI confidently invents Thai law; we see the results when clients bring us its answers. Used properly, it is why a firm of our size can watch every Supreme Court publication, answer at odd hours, and price a will at 3,900 baht. The lawyers who refuse these tools are not protecting quality. They are protecting their invoices.

A Human Note: The Season of Remembering

Since January, every issue has ended away from the law, with something human. This month the calendar did the choosing for me, because while I was writing about death certificates and estate administrators, Thailand entered the season when it feeds its dead.

It began at the end of August, when Thai Chinese families marked Sart Chin, the hungry ghost period, with tables of food set out for ancestors and for spirits with no descendants left to remember them. On Friday 25 September comes the Mid-Autumn Festival: mooncakes and lanterns in Yaowarat and in Chinese shrines across the country, families gathering under the full moon, the year’s gentlest reminder that a family is a circle you keep closing. And from late September into October, the South celebrates Sat Duan Sip, the Festival of the Tenth Lunar Month, at its most spectacular in Nakhon Si Thammarat: ancestors are believed to return home for the fortnight, welcomed with trays of ritual sweets, including khanom la, whose golden lace threads are said to be woven as clothing for the dead, and then sent back with merit to carry.

I find these weeks moving in a way that is hard to explain to newcomers. Thai culture does not hide death in a drawer. It cooks for it, sets a place for it, jokes with it, and in doing so keeps the dead inside the family instead of outside it. There is a lesson in that for those of us raised to treat mortality as an impolite subject. A will, a living will, a folder of documents your family can find: these are not morbid objects. They are krayasart and khanom la in legal form, food prepared in advance for the people who will one day have to carry you. The Thais have understood for centuries that you care for your family by preparing for your absence. We just do it with paper.
