Before hiring in Thailand, put the pay, working hours, duties and leave terms in writing. Before dismissing someone, review the evidence and calculate each amount due. A contract borrowed from another country rarely addresses those tasks properly.

This guide covers ordinary private-sector employment. Special rules and exclusions require separate attention. The number of staff affects some duties, but a small business should not assume employment protection starts only at ten employees.

Start with a workable employment contract

State the employer, position, workplace, reporting line, wage components, pay dates, hours, leave and notice terms. Explain any commission or bonus formula rather than leaving the manager and employee to interpret a broad promise later.

Written terms make disputes easier to assess, although not every employment relationship requires a written contract. The label “consultant” also does not decide whether someone is an employee. Review the real arrangement, including supervision, duties and how payment is earned.

Probation is still employment. Keep a clear assessment process and review performance early. Ending employment before the statutory severance threshold does not remove all notice, payment or unfair-dismissal risks.

Do not confuse a fixed term with a severance exemption

A contract ending on a stated date is not automatically exempt from severance. Section 118 contains a narrow exception for qualifying project, occasional or seasonal work. The conditions include the type of work, completion within two years and a written contract made at the start.

Check the substance before relying on this exception. Repeatedly calling an ordinary continuing job a short contract does not provide a dependable way around employment obligations.

Section 118 Labour Protection Act B.E. 2541

Full text

The employer shall pay severance pay to an employee whose employment is terminated, as follows: (1) an employee who has worked continuously for 120 days but less than 1 year shall be paid not less than 30 days' wages at the latest rate, or, for an employee paid by results calculated per unit, not less than the wages for the last 30 days of work; (2) an employee who has worked continuously for 1 year but less than 3 years shall be paid not less than 90 days' wages at the latest rate, or, for an employee paid by results calculated per unit, not less than the wages for the last 90 days of work; (3) an employee who has worked continuously for 3 years but less than 6 years shall be paid not less than 180 days' wages at the latest rate, or, for an employee paid by results calculated per unit, not less than the wages for the last 180 days of work; (4) an employee who has worked continuously for 6 years but less than 10 years shall be paid not less than 240 days' wages at the latest rate, or, for an employee paid by results calculated per unit, not less than the wages for the last 240 days of work; (5) an employee who has worked continuously for 10 years but less than 20 years shall be paid not less than 300 days' wages at the latest rate, or, for an employee paid by results calculated per unit, not less than the wages for the last 300 days of work; (6) an employee who has worked continuously for 20 years or more shall be paid not less than 400 days' wages at the latest rate, or, for an employee paid by results calculated per unit, not less than the wages for the last 400 days of work. Termination of employment under this section means any act by which the employer does not allow the employee to continue working and does not pay wages, whether because the employment contract has ended or for any other reason, and includes the case where the employee does not work and does not receive wages because the employer is unable to continue operating its business. Paragraph one does not apply to an employee employed for a definite period whose employment is terminated in accordance with that period. Employment for a definite period under paragraph three may be made only for employment on a specific project that is not the normal work of the employer's business or trade and that must have a definite start and end, or for work of an occasional nature with a set end or completion, or for seasonal work where the employment is during that season, and the work must be completed within a period not exceeding 2 years, with the employer and the employee having made a written contract from the start of the employment.

Full text

An employment contract ends upon expiry of its term, without advance notice being required. Where an employment contract has no fixed term, the employer or the employee may terminate it by giving the other party written advance notice on or before any wage payment date, so that the termination takes effect on the next following wage payment date, but advance notice of more than 3 months is not required. A probationary employment contract shall also be deemed an employment contract with no fixed term. In terminating an employment contract under paragraph two, the employer may pay wages in the amount that would be payable up to the time of termination under the notice and have the employee leave work immediately. Advance notice under this section does not apply to termination of employment under section 119 of this Act and section 583 of the Civil and Commercial Code.

The employer is not required to pay severance pay to an employee whose employment is terminated in any of the following cases: (1) dishonesty in the performance of duty, or intentionally committing a criminal offence against the employer; (2) wilfully causing damage to the employer; (3) negligence causing serious damage to the employer; (4) violating work rules, regulations or orders of the employer that are lawful and fair, after the employer has given a written warning, except that in a serious case the employer need not give a warning. A written warning remains effective for not exceeding 1 year from the date of the employee's violation; (5) abandoning duty for 3 consecutive working days, whether or not there is an intervening holiday, without reasonable cause; (6) being sentenced to imprisonment by a final judgment of imprisonment. In the case of (6), if the offence was committed through negligence or is a petty offence, it must be one that caused damage to the employer. Where employment is terminated without severance pay under paragraph one, if the employer did not state the facts constituting the reason for termination in the termination letter, or did not inform the employee of the reason at the time of termination, the employer may not raise that reason afterwards.

Work rules and personnel records

Employers with ten or more employees must prepare work rules in Thai under section 108. The rules cover matters such as hours, holidays, pay arrangements, leave, discipline, complaints and termination. Keep the applicable rules accessible to employees and retain evidence of communication.

Review the current publication and record-keeping requirements when adopting or changing rules. Do not copy an old instruction to file every handbook with the Labour Department. Filing duties for particular returns are a separate issue.

Maintain contracts, time records, leave requests, payroll calculations, warnings and the employee’s response. An unsigned accusation written after dismissal is a weak substitute for a properly documented process.

Hours, overtime and holidays

For ordinary work, the general limits are eight hours a day and 48 hours a week, subject to lawful arrangements and exceptions. Specified hazardous work has lower limits. Plan rest breaks and weekly holidays as part of the schedule.

Overtime generally requires consent on each occasion, subject to statutory exceptions. A broad sentence in the contract should not be treated as permission to disregard the law.

WorkGeneral minimum payment
Overtime on an ordinary working day1.5 times the ordinary hourly wage.
Work during normal hours on a holidayAn additional one times the rate for someone already entitled to holiday wages; two times for someone not entitled to those holiday wages.
Overtime on a holidayThree times the ordinary hourly wage.

Classify the day and employee’s entitlement before calculating pay. Different roles and work arrangements require a check of the applicable exceptions. Do not use one multiplier for every weekend shift.

Check the leave policy against current minimums

LeaveGeneral entitlement
Annual holidayAt least six working days after one year of continuous service.
Sick leaveLeave for the period of genuine illness. Statutory paid sick leave is limited to 30 working days a year; the leave itself is not simply capped at 30 days.
Necessary business leaveAt least three paid working days a year.
Maternity leaveUp to 120 days per pregnancy; employer-paid wages for up to 60 days.
Leave to assist a spouse after childbirthUp to 15 days with full pay, subject to the statutory conditions.
Additional infant-care leaveUp to 15 days in the qualifying medical circumstances, with 50% wages and the required supporting evidence.

The expanded childbirth-related entitlements took effect on 7 December 2025. Update older handbooks and payroll settings. The Ministry of Labour explains the amendment here. Other leave categories, including military service and sterilisation, need their own policy treatment.

Remote work needs written terms

For an agreed remote-working arrangement, record the hours, supervision, equipment, expenses and arrangements for contact outside working hours. Section 23/1 addresses written or electronic agreements and the right to refuse contact outside the relevant working period, subject to prior written consent.

Set realistic availability expectations. A manager should not assume an employee working from home is permanently on call.

Before dismissal, separate the legal questions

Notice, severance, final wages and unfair dismissal are different issues. Paying one does not necessarily resolve the others. Review the contract, pay cycle, length of service, reason for dismissal and any special protection before setting the final date.

For an indefinite contract, the ordinary statutory notice mechanism is tied to wage-payment dates. Calculate the actual dates rather than assuming every case requires exactly 30 days. The relevant general provisions include LPA section 17 and Civil and Commercial Code section 582.

Where statutory severance is due, section 118 uses the following service bands:

Continuous serviceMinimum severance
120 days to under one year30 days’ wages
One year to under three years90 days’ wages
Three years to under six years180 days’ wages
Six years to under ten years240 days’ wages
Ten years to under twenty years300 days’ wages
Twenty years or more400 days’ wages

Check which payments constitute wages and whether a statutory exception applies. Section 119 contains specified grounds for withholding severance; “poor attitude” or an unsupported allegation is not a substitute for proving the applicable ground. Warning requirements and the reason communicated at termination matter.

Prepare an itemised final-payment calculation and confirm the deadline for each component before giving notice. Where an exit is negotiated, review the settlement separately. Our severance waiver guide explains why a waiver should not be treated as a standard hiring clause.

Employee Welfare Fund: prepare for January 2027

The Royal Decree fixing the collection start date schedules contributions from 1 January 2027. The rate regulation provides an initial employee contribution of 0.25% of wages, matched by 0.25% from the employer, with an increase scheduled from October 2031.

Update, 2 November 2026: collection is postponed to 1 January 2027. The Royal Decree on the start of collection B.E. 2569, published in the Royal Gazette on 22 October 2026 (vol. 143, part 65 Kor), repeals the B.E. 2568 decree, and its section 4 starts collection on 1 January 2027. No first remittance falls due on 15 November 2026. January 2027 is the first month, so the first remittance falls due by 15 February 2027. The Cabinet also accepted in principle a draft that would apply the 0.25% rates to 31 December 2031 and the 0.50% rates from 1 January 2032. We have not yet read that regulation in the Gazette, so check it before relying on those two dates.

Before changing payroll, determine which employees are covered and whether a qualifying provident fund or alternative arrangement gives an exemption. Do not assume a scheme covering some staff exempts everyone. Confirm registration, deductions and remittance requirements with the payroll provider. Our Employee Welfare Fund checklist sets out the preparation work.

Frequently asked questions

Does a fixed-term contract exempt an employer from severance in Thailand?

Not automatically. Section 118 has a narrow exception for qualifying project, occasional or seasonal work that must be completed within two years, with a written contract made at the start. Calling an ordinary continuing job a short contract is not a dependable way around severance.

When must an employer prepare work rules?

Employers with ten or more employees must prepare work rules in Thai under section 108. They cover hours, holidays, pay arrangements, leave, discipline, complaints and termination. Keep them accessible to employees and keep evidence that they were communicated.

What are the general working-hour limits?

For ordinary work, eight hours a day and 48 hours a week, subject to lawful arrangements and exceptions. Specified hazardous work has lower limits. Overtime generally requires the employee’s consent on each occasion.

How much severance is due under section 118?

It depends on continuous service: 30 days’ wages from 120 days to under one year, 90 days from one to under three years, 180 from three to under six, 240 from six to under ten, 300 from ten to under twenty, and 400 days from twenty years.

What an employer should review now

Compare the contract, work rules and payroll settings against one another. Resolve inconsistent hours, obsolete leave terms, unclear allowances and missing records. Before a dismissal, provide the complete personnel file and the proposed reason while there is still time to correct the process.

Arrange an employment-law review. Bring the contract, work rules, recent payroll records and any warning or termination documents.
