For a foreigner charged with a criminal offence in Thailand, the most important question is rarely “guilty or not guilty.” It is usually: will I actually go to prison? Thai courts convict in the overwhelming majority of prosecuted cases, but Thai law also gives judges a powerful tool to keep first-time and low-level offenders out of prison entirely: the suspended sentence, with or without probation conditions, under Section 56 of the Thai Penal Code. A Supreme Court decision, Dika No. 736/2569, shows exactly how that discretion works in practice, including what convinces a court to suspend a sentence, and what part of your past the court is allowed to look at.

Dika 736/2569: an online scam, a confession, and a second chance

The defendant posted gaming consoles for sale on Facebook Marketplace. He had no consoles. A buyer, convinced by the listing and photos, transferred 8,500 baht and received nothing. The defendant was prosecuted for fraud under Section 343, first paragraph, of the Penal Code (fraud committed by a false representation to the public) and for entering false data into a computer system under Section 14(1) of the Computer Crimes Act B.E. 2550, the standard charge pairing in Thai online-scam cases. He confessed.

The lower courts sentenced him to imprisonment without suspension. On appeal, the Supreme Court:

  • Upheld the conviction. The indictment adequately stated every element of both offences, satisfying Section 158(5) of the Criminal Procedure Code, and his confession supported conviction under Section 176.
  • Allowed his juvenile record to be considered. The defendant argued that raising his old juvenile offences violated the Juvenile and Family Court and Juvenile and Family Case Procedure Act B.E. 2553 (Section 84), which shields juvenile records. The Court disagreed: that protection governs juvenile proceedings; it does not prevent an adult criminal court from taking a defendant’s history into account when weighing sentencing discretion under Section 56.
  • Suspended the sentence anyway. What saved him was not the argument, but his conduct: he had paid the victim 20,000 baht, more than double the 8,500 baht loss, confessed and showed remorse, and had stayed out of trouble for nearly ten years since his juvenile cases. The Supreme Court suspended the six-month prison term for two years, placed him on probation for one year with reporting to a probation officer every three months, and ordered 12 hours of community service (Section 56).

The decision is a textbook illustration of how Thai sentencing actually works: the law looks backward at your record, but it weighs most heavily what you do after the offence, restitution, remorse, and rehabilitation.

Section 56Amended on 8 April 2016

Where the court is to impose imprisonment not exceeding five years, whether or not a fine is also imposed, or is to impose a fine, and the person's record falls within one of the three descriptions the section gives, the court may adjudge them guilty but suspend the determination of the punishment, or determine the punishment but suspend its execution, for a period it fixes of not more than five years from the day of the judgment, and it may attach conditions for controlling their conduct.

Full text

Whoever commits an offence punishable by imprisonment or by fine, and in that case the court is to impose imprisonment not exceeding five years, whether or not a fine is also imposed, or is to impose a fine, if it appears that that person: (1) has never previously received a punishment of imprisonment; (2) has previously received a punishment of imprisonment, but it was a punishment for an offence committed negligently, or for a petty offence, or was imprisonment not exceeding six months; or (3) has previously received a punishment of imprisonment but was released from it more than five years before committing the further offence, the later offence being one committed negligently or a petty offence, and when the court has taken into account the age, personal history, conduct, intelligence, education and training, health, mental condition, disposition, occupation, and environment of that person, or the nature of the offence, or that person's sense of remorse and efforts to mitigate the harm caused, or any other extenuating circumstance, the court may adjudge that the person is guilty but suspend the determination of the punishment, or determine the punishment but suspend its execution, whether the punishment be imprisonment or a fine or both, so as to give that person an opportunity to reform within such period as the court fixes, which must not exceed five years from the day of the judgment; and the court may or may not fix conditions for controlling that person's conduct. The conditions for controlling the conduct of an offender under paragraph one may be fixed by the court, one or several as may be appropriate to the case, as follows: (1) to report in person from time to time to the official designated by the court, so that the official may question, advise, assist, or admonish the offender as it thinks fit as to conduct and occupation, or to arrange for the offender to perform social service or public benefit activities; (2) to train for or to carry on a regular lawful occupation; (3) to refrain from association, or from any conduct, that might lead to the commission of a similar offence again; (4) to undergo treatment for narcotic addiction, for physical or mental deficiency, or for any other illness, at the place and for the period fixed by the court; (5) to undergo training at the place and for the period fixed by the court; (6) to be prohibited from leaving the place of residence, or from entering any place, during the times fixed by the court, and for this purpose an electronic device or any other device capable of monitoring or restricting travel may be used; (7) to pay compensation, or otherwise to remedy the damage, to the injured person as agreed between the offender and the injured person; (8) to repair, restore, or remedy damage caused to natural resources or to the environment, or to pay compensation for that purpose; (9) to enter into a bond in such sum as the court thinks fit that the offender will not commit an act of mischief or cause danger to another person or to property; (10) any other condition that the court thinks fit to fix in order to correct or rehabilitate the offender, or to prevent the offender from committing or having the opportunity to commit an offence again, or any condition for remedying the injured person as the court thinks fit. As to the conditions fixed by the court under paragraph two, if it later appears to the court, on the application of the offender, of the offender's legal representative, of the offender's curator, of the public prosecutor, or of an official, that the circumstances relating to the control of the offender's conduct have changed, the court may, if it thinks fit, amend, add to, or revoke any of them, or may additionally fix any condition mentioned in paragraph two that it has not already fixed. If there is a breach of a bond, the provisions of Section 47 shall apply mutatis mutandis.

Section 58

If a person whose punishment was suspended under Section 56 commits a new offence, one that is not negligent and not petty, within the probation period and is sentenced to imprisonment for it, the later court determines or activates the previously suspended punishment and adds it to the new sentence. If no such offence is committed within the period, the person is discharged from the suspended punishment.

Full text

When it appears to the Court itself, or upon the statement of the plaintiff or of an official, that within the time fixed by the Court under Section 56 the person upon whom judgment was passed has committed an offence which is not an offence committed through negligence or a petty offence, and the Court passes a sentence of imprisonment for that offence, the Court trying the later case shall determine the punishment which was reserved from determination in the earlier case and add it to the punishment in the later case, or shall add the punishment the execution of which was suspended in the earlier case to the punishment in the later case, as the case may be. But if, within the time fixed by the Court under Section 56, that person has not committed an offence as mentioned in the first paragraph, that person shall be relieved from having the punishment determined, or from undergoing the punishment, in that case, as the case may be.

Section 57

If a person breaches the conduct conditions set under Section 56, the court may warn the person, or, where punishment was not yet fixed, determine it, or, where punishment was fixed but suspended, impose it.

Full text

When it appears to the court itself, or upon the statement of the public prosecutor or an official, that the offender has failed to comply with the conditions fixed by the court under Section 56, the court may admonish the offender, or may determine the punishment in the case where the court has not yet determined the punishment, or impose the punishment in the case where the court has already determined the punishment but suspended its imposition.

Section 343

Fraud on the public is committed where the fraud under Section 341 is carried out by asserting a false statement to the public, or by concealing a fact that should be disclosed to the public. It carries up to five years, or a fine of up to 100,000 baht, or both. Where the public fraud also has a characteristic listed in Section 342 (impersonation, or exploiting a child's lack of intelligence or the weakness of mind of the person deceived), the penalty is imprisonment from six months to seven years and a fine from 10,000 to 140,000 baht. The offence is not compoundable under Section 348.

Full text

Where the offence under Section 341 is committed by asserting a false statement to the public, or by concealing a fact which should be disclosed to the public, the offender shall be liable to imprisonment not exceeding five years, or a fine not exceeding one hundred thousand baht, or both. Where the offence under paragraph one also has any of the characteristics described in Section 342, the offender shall be liable to imprisonment from six months to seven years and a fine from ten thousand baht to one hundred and forty thousand baht.

Section 348

This section makes every offence in the cheating and fraud chapter compoundable, with one exception: public fraud under Section 343. So Sections 341, 342, 344, 345, 346 and 347 can be settled between the parties, and Section 343 cannot. Section 348 creates no offence and carries no penalty of its own; it governs how the offences in the chapter may be brought to an end.

Section 78

Where mitigating circumstances appear, the court may reduce the punishment to be imposed by up to one half, whether or not the punishment has already been increased or reduced under any other provision. The section lists examples such as remorse and effort to repair the harm, surrender to officials, prior good conduct, grievous distress, and giving the court useful information.

Full text

When it appears that there are mitigating circumstances, whether or not there has been an increase or reduction of punishment under the provisions of this Code or of any other law, if the court thinks fit it may reduce the punishment to be imposed on the offender by not more than one half. Such mitigating circumstances include: the offender being ignorant and of feeble understanding, being in grievous distress, having previously had good conduct, feeling remorse and endeavouring to mitigate the injurious consequences of the offence, surrendering to the official, or giving the court information that is beneficial, or any other circumstance that the court considers to be of a similar nature.

Section 84 Juvenile and Family Court Act B.E. 2553

Full text

For the protection of the rights of a child or juvenile, it is prohibited to disclose the criminal record of a child or juvenile, or to take it into consideration, in any manner whatsoever that is detrimental to, or constitutes unfair discrimination against, that child or juvenile, except where it is used to assist the court's discretion in determining measures for children and juveniles. In case of a violation, the court shall order the violating act to be stopped or revoked, and may award damages or mitigation of harm, or order that steps be taken to remedy the damage caused, as it thinks fit. A child or juvenile who is alleged to have committed an offence or who is a defendant, and who is under the custody of any person or organisation, must be rehabilitated both physically and mentally and encouraged to have the opportunity to return to society, and must be treated humanely and with respect for human dignity. If there is exploitation, wrongful conduct, torture, punishment, cruel, inhuman or other degrading treatment, or any act that is not for the purpose of physical or mental rehabilitation or of return to society and that is contrary to the best interests of the child or juvenile, the court shall order the violating act to be stopped or revoked, and shall award damages or mitigation of harm, or order that steps be taken to remedy the damage caused, as it thinks fit.

How suspended sentences work: Section 56 of the Penal Code

Section 56 allows a court to suspend either the fixing of punishment or the execution of an imprisonment sentence where, broadly:

  • the sentence of imprisonment imposed is not more than five years; and
  • the defendant has never served a prison sentence, or any earlier prison sentence was for a negligence or petty offence or was not more than six months, or the defendant left prison more than five years ago and the new offence is itself one of negligence or a petty offence; and
  • the court is satisfied, looking at age, history, behaviour, intelligence, education, health, mental condition, occupation, environment, the nature of the offence, and any effort to remedy the harm, that suspension is appropriate.

The court sets a suspension period of up to five years. If the defendant stays clean, the sentence is never served and, where the fixing of punishment was suspended, no penalty is ever fixed. If, during that period, the defendant commits a new offence that is neither negligent nor petty and is sentenced to imprisonment for it, the court in the new case must fix or impose the suspended punishment and add it to the new sentence (Section 58). Breaching a probation condition is dealt with separately: the court may warn the defendant or fix or impose the suspended punishment (Section 57).

Probation conditions the court can impose

ConditionWhat it means in practice
Reporting to a probation officerPeriodic check-ins, typically every 3-4 months during the suspension period

What this means if you are facing charges in Thailand

Dika 736/2569 confirms a pattern that criminal lawyers in Thailand see every week, and it applies equally to foreigners. Understanding it can change the outcome of a case.

Restitution is the strongest card

Paying the injured party, ideally more than the strict loss, and before judgment, is the clearest signal a Thai court recognises. In this case, 20,000 baht paid on an 8,500 baht fraud converted a prison sentence into a suspended one at the Supreme Court. In many prosecutions for fraud, cheque offences, defamation and even some assaults, full compensation plus a sincere apology also opens the door to settlement or the victim withdrawing a compoundable complaint. Our overview of fraud and scam laws in Thailand explains which fraud offences can be settled this way.

A confession is a sentencing strategy, not just an admission

Thai courts routinely reduce sentences, commonly by half, for a confession, and a confession supports the finding of remorse that Section 56 rewards. Whether to confess is a serious strategic decision that must be made with a lawyer who has seen the evidence file, ideally before the prosecutor files the indictment. See our guide to criminal trial procedures in Thailand for how the stages fit together.

Your history matters, including history you thought was sealed

The Court’s ruling on the juvenile record is the doctrinally interesting part of the decision. Juvenile records are protected in juvenile proceedings, but an adult court weighing suspension may still hear about them as background. For expats, the analogue is a foreign criminal record: it will not usually appear in a Thai court file automatically, but if it surfaces, the court may consider it in exercising discretion, and conversely, a long clean stretch after old trouble counts in your favour, exactly as the defendant’s ten quiet years did here.

Suspension is not acquittal

A suspended sentence is still a conviction. For a foreigner, that matters twice over: a conviction can affect visa extensions, permanent-residence and citizenship applications, and can ground deportation or blacklisting in serious cases, even where no day is spent in prison. Post-conviction options such as appeal and royal pardon are covered in our guide to appeals and pardons in Thailand.

Fraud and the Computer Crimes Act: why online cases are charged twice

Because the false listing was posted online, the defendant faced Section 14(1) of the Computer Crimes Act on top of Penal Code fraud. This doubling is now standard in every marketplace-scam, romance-scam and false-advertising prosecution in Thailand, and it raises the stakes: a Section 14(1) Computer Crimes Act offence aimed at the public, as a false listing is, cannot be settled by the victim (Section 14 paragraph two makes it compoundable only when it targets one particular person), and fraud by a false representation to the public under Section 343, the charge here, is not compoundable either (Section 348), so paying the victim does not automatically end the case, it “only” supports lighter sentencing, as it did here. Foreigners are found on both sides of these cases: as scam victims, and, more often than you would expect, as accused sellers after a deal goes wrong and an angry buyer files a criminal complaint. Last reviewed: 28 September 2026. Supreme Court decision 736/2569 was read in Thai to its disposition, with Penal Code sections 56, 57, 58, 78, 343 and 348. The computer-crime compoundability point was checked against the 2017 amendment under an earlier review. Practice statements about how often courts suspend sentences and how foreign records surface are experience, not statute.

Frequently asked questions

Who qualifies for a suspended sentence in Thailand?

Broadly, a defendant sentenced to imprisonment of five years or less, without a disqualifying prior prison record, where the court finds their age, history, conduct after the offence and efforts to remedy the harm justify suspension under Section 56 of the Penal Code. It is discretionary, never automatic.

Do foreigners get suspended sentences too?

Yes, regularly, on the same criteria as Thais. Courts do consider whether the defendant has ties to Thailand and will comply with conditions, so stable residence, family and employment in Thailand help.

Does a suspended sentence appear on a criminal record?

Yes. It is a conviction and appears on a Thai criminal record check unless and until expunged under the applicable rules. It can affect immigration status and future background checks.

What happens if I break a probation condition?

The court may warn you or fix/activate the punishment (Section 57). Committing a new intentional offence during the suspension period is the most serious breach: under Section 58 if the court imprisons you for the new offence, it must add the suspended term to the new sentence.

Can compensation make a criminal case go away entirely?

For compoundable offences (ordinary fraud between private parties, defamation, some others), yes, the victim can withdraw the complaint and the case ends. For non-compoundable offences, including the Section 14(1) computer-crime charge used where the false data is aimed at the public, compensation cannot end the case but strongly supports a reduced or suspended sentence. Not every Computer Crimes Act offence is non-compoundable: Section 16 is expressly compoundable, and since the 2017 amendment so is a Section 14(1) offence directed at one individual rather than at the public.

Was the juvenile record decisive in Dika 736/2569?

No, the Court held the record could lawfully be considered, but suspended the sentence anyway because of restitution (20,000 baht on an 8,500 baht loss), confession, remorse, and nearly ten years of good behaviour.
