Pour un étranger inculpé d'une infraction pénale en Thaïlande, la question la plus importante est rarement “ coupable ou non coupable ”. C'est généralement : Vais-je vraiment aller en prison ? Les tribunaux thaïlandais condamnent dans l'immense majorité des affaires poursuivies, mais la loi thaïlandaise offre également aux juges un outil puissant pour éviter totalement aux primo-délinquants et aux délinquants de faible envergure d'aller en prison : la peine avec sursis, avec ou sans conditions de mise à l'épreuve, en vertu de Article 56 du Code pénal thaïlandais. Dika 736/2569 : une arnaque en ligne, une confession et une seconde chance
Le prévenu a mis en vente des consoles de jeux sur Facebook Marketplace. Il ne possédait aucune console. Un acheteur, convaincu par l'annonce et les photos, a transféré 8 500 bahts et n'a rien reçu. Le prévenu a été poursuivi pour escroquerie en vertu de Article 343, premier alinéa, du Code pénal (fraude commise par fausse déclaration au public) et pour introduction de données fausses dans un système informatique en vertu de Article 14, paragraphe 1, de la loi sur la criminalité informatique de 2550 (B.E. 2550), the standard charge pairing in Thai online-scam cases. He confessed.

The Supreme Court granted a suspended sentence under Section 56.

Comment fonctionnent les peines avec sursis : Article 56 du Code pénal

- la peine d'emprisonnement prononcée est pas plus de cinq ans; et
- l'accusé n'a pas d'antécédents d'emprisonnement, ou toute peine antérieure concernait une infraction par négligence ou une infraction mineure, ou a été purgée il y a suffisamment longtemps pour que la loi n'en tienne pas compte ; et
- the court is satisfied, looking at age, history, behaviour, intelligence, education, health, mental condition, occupation, environment, the nature of the offence, and any effort to remedy the harm, that suspension is appropriate.
Le tribunal fixe une période de mise à l'épreuve pouvant aller jusqu'à cinq ans. Si le prévenu se conduit bien, la peine n'est jamais exécutée et, lorsque le prononcé de la peine a été suspendu, aucune peine n'est jamais prononcée. Si le prévenu commet une nouvelle infraction intentionnelle punie d'une peine privative de liberté pendant cette période, le sursis peut être révoqué et s'ajouter à la nouvelle peine en vertu de l'article 58.

La restitution est la carte la plus forte
Paying the injured party, ideally more than the strict loss, and before judgment, is the clearest signal a Thai court recognises. In this case, 20,000 baht paid on an 8,500 baht fraud converted a prison sentence into a suspended one at the Supreme Court. In many prosecutions for fraud, cheque offences, defamation and even some assaults, full compensation plus a sincere apology also opens the door to settlement or the victim withdrawing a compoundable complaint. A confession is a sentencing strategy, not just an admission
Thai courts routinely reduce sentences, commonly by half, for a confession, and a confession supports the finding of remorse that Section 56 rewards. Whether to confess is a serious strategic decision that must be made with a lawyer who has seen the evidence file, ideally before the prosecutor files the indictment. Your history matters, including history you thought was sealed
The Court’s ruling on the juvenile record is the doctrinally interesting part of the decision. Juvenile records are protected in juvenile proceedings, but an adult court weighing suspension may still hear about them as background. For expats, the analogue is a foreign criminal record: it will not usually appear in a Thai court file automatically, but if it surfaces, the court may consider it in exercising discretion, and conversely, a long clean stretch after old trouble counts in your favour, exactly as the defendant’s ten quiet years did here.
Suspension is not acquittal
A suspended sentence is still a conviction. For a foreigner, that matters twice over: a conviction can affect visa extensions, permanent-residence and citizenship applications, and can ground deportation or blacklisting in serious cases, even where no day is spent in prison. Fraud and the Computer Crimes Act: why online cases are charged twice
Because the false listing was posted online, the defendant faced Section 14(1) of the Computer Crimes Act on top of Penal Code fraud. This doubling is now standard in every marketplace-scam, romance-scam and false-advertising prosecution in Thailand, and it raises the stakes: Computer Crimes Act offences are not compoundable in the same way as ordinary fraud between private parties, so paying the victim does not automatically end the case, it “only” supports lighter sentencing, as it did here. Foreigners are found on both sides of these cases: as scam victims, and, more often than you would expect, as accused sellers after a deal goes wrong and an angry buyer files a criminal complaint. For compoundable offences (ordinary fraud between private parties, defamation, some others), yes, the victim can withdraw the complaint and the case ends. For non-compoundable offences, including the Section 14(1) computer-crime charge used where the false data is aimed at the public, compensation cannot end the case but strongly supports a reduced or suspended sentence. Not every Computer Crimes Act offence is non-compoundable: Section 16 is expressly compoundable, and since the 2017 amendment so is a Section 14(1) offence directed at one individual rather than at the public.
