Thai law defines the service narrowly. Clause 4 of the Regulation of the Ministry of Foreign Affairs on the Legalization of Documents B.E. 2568 defines légalisation des documents as the certification of the documents specified in that regulation, and it lists exactly three things: legalization of a translation, legalization of a copy, and legalization of a signature. This is the single point that causes the most trouble, and both the Thai regulation and the Apostille Convention answer it the same way. Article 2 of the Apostille Convention defines legalization as the formality by which consular agents certify the authenticity of the signature, the capacity in which the person signing the document has acted and, where appropriate, the identity of the seal or stamp which it bears. Article 5 uses the same three words for the apostille itself. The Thai regulation reaches the same place from the other direction: what is certified is a translation, a copy, or a signature. So, in plain terms:- It certifies who signed and in what capacity, and that the seal is genuine.
- It does not certify that the contents of the document are true. A legalized affidavit is still only an affidavit.
- It does not make the document legally effective in Thailand. Whether a foreign divorce, marriage or company document is recognised here is a separate question of Thai law, decided by the office or the court in front of you.
- It does not guarantee the translation is accepted. The Ministry certifies the translator’s signature and the form of the translation, not that every term is the right one for your purpose.

The authentication chain for foreign documents begins in the issuing country and concludes with Thai MFA certification. Initially, documents must be authenticated by the relevant state or provincial authority in their country of origin, followed by federal-level authentication. US documents need to be authenticated by the state Secretary of State. Then, they must be approved by the US Department of State. Finally, they require legalization at the Thai Embassy or Consulate in the United States. Documents thaïlandais à usage international
Thai documents destined for international use follow a simpler but equally important process. The Thai MFA first certifies the document’s authenticity, after which the destination country’s embassy in Thailand provides final authentication. Common Thai documents requiring legalization include marriage certificates, birth certificates, educational diplomas, and business registration documents. The Ministry works in Thai and English, not in the language of the destination country. This is the mistake that sends most people home for a second appointment. Under clause 9 of the B.E. 2568 regulation, a document submitted for legalization of its translation must be translated from a Thai original official document; if the document was made privately, it has to be certified by the relevant government office first. Clause 10 then requires you to file, together with the application form:- the original Thai official document, or the privately made document already certified by the relevant office;
- the original English translation, marked “Translation” or words to the same effect, and signed by the translator as “Certified Correct Translation”. Where the issuing government office is able to produce the translation itself, the translation you file must be the one that office made;
- the valid ID card, passport or official identity document of the owner of the document, plus a copy of the same identity evidence for the translator;
- a power of attorney under clause 8 if the owner cannot attend in person.

Most guides to this subject cite no law at all. Three instruments govern the service, and one provision of the Civil Procedure Code explains why anyone bothers with it. 1. The Regulation of the Ministry of Foreign Affairs on the Legalization of Documents B.E. 2568. Royal Gazette vol. 142, special part 381 Ngor, 4 December 2025, in force the day after publication, signed by the Minister of Foreign Affairs on 12 November 2025. It repealed the B.E. 2539 regulation. It is the source of the definitions, the authentication chain in clauses 6 and 7, the application requirements in clause 8, and the translation rules in clauses 9 to 13. Two practical clauses at the end are worth knowing: fees are not refundable in any case (clause 33), and the Ministry reserves the right to deal with documents left uncollected for more than 90 jours after the collection date (clause 35). 2. If you ever have to use a foreign document in a Thai court, this is the provision that matters. Section 47 of the Civil Procedure Code lets the court order a party to swear that a power of attorney is genuine. Where the court has reasonable cause to suspect that it is not, or where the opposing party files a motion showing reasonable cause to suspect it, the court may require the document in the form set out in the third paragraph:- made en Thaïlande: witnessed by the District Officer;

What the Supreme Court has held: an uncertified document is not automatically void
This is where a lot of advice overstates the position. Legalization is not a validity requirement; it is what puts a document beyond challenge.- Supreme Court Decision 6616/2560. Applying section 26 of the Act for the Establishment of and Procedure for the Intellectual Property and International Trade Court B.E. 2539 together with section 47, the Court held that the section concerns the court’s power to deal with a power of attorney or other document where there is doubt. It is pas the case that a document lacking notary-public certification under the third paragraph is thereby unlawful. Certification obtained after the claim was filed still confirmed that the attorney had authority.
- Supreme Court Decision 9212/2557. The power of attorney carried no certificate of the Japanese government showing that the notary had authority to witness it. Because the defendants pleaded only bare denials and filed no motion showing reasonable cause to doubt the document, there was no reasonable cause to suspect it, and the plaintiff had standing.
- Supreme Court Decision 15690/2553. The same principle in a criminal complaint, section 47 third paragraph applied through section 15 of the Criminal Procedure Code. Where the court did not doubt the power of attorney and the defendant neither pleaded nor proved a reason to doubt it, the defendant was taken to accept it.
