Contrat prémarital et instructions (Thaïlande, bilingue EN-TH)
In Thailand a prenuptial agreement must be signed before the marriage and recorded in the Marriage Register on the day the marriage is registered. This pack gives you the agreement our firm uses as its base, in English and Thai, and plain instructions to fill it in, sign it and register it correctly.
What the Agreement does
- Drafted under Thai law (Civil and Commercial Code, sections 1465 to 1469), for a marriage registered at a district office in Thailand
- Each spouse keeps what he or she owned before the marriage, inheritances and gifts
- Clause 2.7: under Thai law the income from personal property is normally common property. In this Agreement it stays personal (rent, interest, dividends). The instructions explain how to change this if you prefer the normal rule
- Clause 5: everything held or earned outside Thailand stays the personal property of the spouse who holds it
- Clause 6: added for foreigners marrying Thai nationals. It sets out how the foreign spouse is lawfully protected when land is bought in Thailand (usufruct, superficies, lease, loan or ownership of the house), and the Thai spouse undertakes to register the agreed right
- Clear rules on debts, joint bank accounts, management of common property, pensions and division on divorce
- Full disclosure schedules for the property and debts of each spouse

A foreigner marrying a Thai national in Thailand, in a simple situation. It can also be used by two foreigners marrying in Thailand and by same-sex couples. It cannot be registered with a marriage celebrated outside Thailand.
