ในกรณีที่บุคคลสมรสฝ่าฝืนมาตรา ๑๔๕๒ เด็กที่เกิดในระหว่างการสมรสที่ฝ่าฝืนนั้นให้สันนิษฐานไว้ก่อนว่าเป็นบุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรสซึ่งได้จดทะเบียนสมรสครั้งหลัง

ในกรณีที่หญิงสมรสฝ่าฝืนมาตรา ๑๔๕๒ ถ้ามีคำพิพากษาถึงที่สุดแสดงว่า เด็กมิใช่บุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรสซึ่งได้จดทะเบียนสมรสครั้งหลัง ให้นำข้อสันนิษฐานในมาตรา ๑๕๓๖ มาใช้บังคับ

ให้นำความในวรรคหนึ่งมาใช้บังคับแก่เด็กที่เกิดภายในสามร้อยสิบวันนับแต่วันที่ศาลมีคำพิพากษาถึงที่สุดให้การสมรสเป็นโมฆะเพราะฝ่าฝืนมาตรา ๑๔๕๒ ด้วย

English translation

Where a person marries in contravention of Section 1452, a child born during that marriage is presumed to be the legitimate child of the man who is the spouse in the marriage registered later.

Where a woman marries in contravention of Section 1452, and there is a final judgment showing that the child is not the legitimate child of the man who is the spouse in the marriage registered later, the presumption in Section 1536 applies.

Paragraph one also applies to a child born within three hundred and ten days from the day on which the judgment of the court declaring the marriage void for contravening Section 1452 became final.
