Section 1551: Objection to registration of legitimation

ในกรณีที่มีการคัดค้านว่าผู้ซึ่งขอจดทะเบียนรับเด็กเป็นบุตรมิใช่บิดาของเด็ก เมื่อผู้ซึ่งขอจดทะเบียนรับเด็กเป็นบุตรนำคดีไปสู่ศาลขอให้ศาลพิพากษาว่าผู้ขอจดทะเบียนรับเด็กเป็นบุตรเป็นบิดาของเด็ก เด็กหรือมารดาเด็กจะขอให้ศาลพิพากษาในคดีเดียวกันนั้นก็ได้ว่าผู้ขอจดทะเบียนรับเด็กเป็นบุตรแม้จะเป็นบิดาของเด็ก ก็เป็นผู้ไม่สมควรใช้อำนาจปกครองบางส่วนหรือทั้งหมด ในกรณีเช่นว่านี้ให้นำความในวรรคสามของมาตรา ๑๕๔๙ มาใช้บังคับโดยอนุโลม

English translation

Where an objection is made that the person applying to register a child as their own is not the child's father, and that applicant brings the case to court asking the court to adjudge that the applicant is the child's father, the child or the child's mother may ask the court, in the same case, to adjudge that the applicant, even if the father of the child, is a person unfit to exercise parental power in part or in whole. In such a case, the provisions of paragraph three of Section 1549 apply mutatis mutandis.
