ในกรณีที่ศาลสั่งให้คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นคนไร้ความสามารถ และศาลเห็นไม่สมควรให้คู่สมรสอีกฝ่ายเป็นผู้อนุบาล และตั้งบิดา หรือมารดา หรือบุคคลภายนอก เป็นผู้อนุบาล ในกรณีเช่นว่านี้ ให้ผู้อนุบาลเป็นผู้จัดการสินสมรสร่วมกันกับคู่สมรสอีกฝ่ายหนึ่ง เว้นแต่ถ้ามีเหตุสำคัญอันจะเกิดความเสียหายแก่คนไร้ความสามารถ ศาลจะสั่งเป็นอย่างอื่นก็ได้
อย่างไรก็ตาม เมื่อมีกรณีดังกล่าวตามวรรคหนึ่ง คู่สมรสอีกฝ่ายหนึ่งมีสิทธิร้องขอต่อศาลให้สั่งแยกสินสมรสได้

English translation
Where the court adjudges one spouse incompetent and considers it inappropriate for the other spouse to be the guardian, and appoints the father, the mother, or a third person as guardian, the guardian shall manage the marital property jointly with the other spouse, unless there is a material cause likely to result in damage to the incompetent person, in which case the court may order otherwise.
However, where the case in paragraph one arises, the other spouse has the right to apply to the court for an order separating the marital property.
