ถ้ากลฉ้อฉลเป็นแต่เพียงเหตุจูงใจให้คู่กรณีฝ่ายหนึ่งยอมรับข้อกำหนดอันหนักยิ่งกว่าที่คู่กรณีฝ่ายนั้นจะยอมรับโดยปกติ คู่กรณีฝ่ายนั้นจะบอกล้างการนั้นหาได้ไม่ แต่ชอบที่จะเรียกเอาค่าสินไหมทดแทนเพื่อความเสียหายอันเกิดจากกลฉ้อฉลนั้นได้

If the fraud is only incidental that is to say it has merely induced a party to accept more onerous terms than would otherwise have done, such party can only claim compensation for damage resulting from such fraud.
