นิติกรรมใดมีเงื่อนไขบังคับก่อนและเงื่อนไขนั้นเป็นการพ้นวิสัย นิติกรรมนั้นเป็นโมฆะนิติกรรมใดมีเงื่อนไขบังคับหลังและเงื่อนไขนั้นเป็นการพ้นวิสัย ให้ถือว่านิติกรรมนั้นไม่มีเงื่อนไข
