ถ้าบุคคลใดได้เลือกเอาถิ่นใด โดยมีเจตนาปรากฏชัดแจ้งว่าจะให้เป็นภูมิลำเนาเฉพาะการเพื่อทำการใด ให้ถือว่าถิ่นนั้นเป็นภูมิลำเนาเฉพาะการสำหรับการนั้นมาตรา ๔๓[4] ภูมิลำเนาของคู่สมรส ได้แก่ถิ่นที่อยู่ที่คู่สมรสอยู่กินด้วยกันฉันคู่สมรส เว้นแต่คู่สมรสฝ่ายใดได้แสดงเจตนาให้ปรากฏว่ามีภูมิลำเนาแยกต่างหากจากกัน
