Civil liability in Thailand refers to the legal responsibility one party (the defendant) has to another (the plaintiff) due to actions or omissions that cause harm or damage. It typically involves the obligation to compensate the injured party for losses incurred. This segment of legal provisions focuses on rectifying harm inflicted by individuals. The regulations predominantly fall within the domain of the Civil and Commercial Code of Thailand, where the general rule on wrongful acts is section 420, complemented by other relevant statutes.

5 benefits of understanding civil liability

Understanding civil liability in Thailand offers several significant benefits, particularly for expatriates and businesses operating within the country. Here are five key benefits, with a detailed explanation for each:

1. Prevention of Legal Missteps

Understanding civil liability in Thailand helps individuals and businesses avoid actions that could lead to legal disputes. Knowing the boundaries of duties and liabilities of Thai law can prevent costly legal mistakes and the potential for lawsuits. This knowledge is particularly important in areas like property transactions, where the nuances of Thai law can greatly affect the legality and success of such dealings.

2. Enhanced Negotiation Power

With a firm grasp of civil liability in Thailand, you can negotiate contracts and resolve disputes with greater confidence and effectiveness. This knowledge empowers you to clearly articulate your legal rights and obligations, thereby enhancing your position in both personal and business negotiations. It ensures that you can advocate for terms that minimize your liability and protect your interests.

3. Improved Risk Management

By understanding the scope and implications of civil liability in Thailand, individuals and businesses can better manage risks associated with their activities. This awareness allows for the implementation of more effective strategies to mitigate risks, such as obtaining appropriate insurance, drafting clearer contracts, and conducting thorough due diligence.

4. Fostering Trust and Compliance

Knowledge of civil liability laws helps in fostering a culture of compliance and trust. When stakeholders are aware that you are knowledgeable and adhere to local laws, it builds credibility and trustworthiness. For businesses, this can enhance relationships with partners, customers, and regulators, and for individuals, it strengthens personal and professional relationships.

Facilitating Dispute Resolution

A clear understanding of civil liability in Thailand is invaluable when disputes arise. It equips you with the necessary tools to seek amicable solutions and understand when to compromise and when to stand firm. Additionally, it aids in navigating the judicial or arbitration processes more effectively should disputes escalate to formal proceedings.

The legislation is classified into two primary categories

The initial classification involves culpability concerning wrongful acts within delictual or quasi-delictual scenarios; for instance, a scenario where a child hurls a rock through a window. These are old civil law classifications. Some new vocabulary use more a “contractual fault” and a “non-contractual fault”.

Subsequently, contractual liabilities are considered, encompassing situations where breaches occur due to non-compliance with contractual terms, regardless of whether the agreement was oral or written. An illustration of this would be signing a contract to purchase a new vehicle, only to receive a used one or, worse still, no vehicle at all.

In addressing the damages done, these can span physical injuries (e.g., an injury with or without lasting disabilities), material losses (e.g., damage to property such as a broken window), and non-financial loss. Non-financial loss is recoverable for injury to body or health and for loss of liberty (Civil and Commercial Code section 446), and a false statement that damages someone’s reputation or livelihood gives its own claim (section 423); mere inconvenience is not a head of damages. The court sets the compensation according to the circumstances and the gravity of the wrong (section 438). Thai civil law does not award punitive damages as a general rule. They are available only where a statute provides for them, for example against a business that deliberately took unfair advantage of a consumer or was grossly negligent (Consumer Case Procedure Act B.E. 2551, section 42), or against a maker or seller who knew a product was unsafe, up to twice the actual damages (Product Liability Act B.E. 2551, section 11).

Section 420

Anyone who intentionally or negligently causes unlawful harm to another's life, body, health, liberty, property, or any other right must pay compensation. This is the foundational tort provision in Thai law.

Full text

A person who, wilfully or negligently, unlawfully injures the life, body, health, liberty, property or any right of another person, is said to commit a wrongful act and is bound to make compensation therefor.

Section 438

It is for the court to decide in what manner and to what extent compensation is to be made, judging by the circumstances and by the gravity of the wrongful act. Compensation may take the form of returning the property the injured person lost through the wrongful act, or paying its value, together with damages for any other injury caused.

Full text

The Court shall determine the manner and the extent of the compensation according to the circumstances and the gravity of the wrongful act. Compensation may include restitution of the property of which the injured person has been wrongfully deprived or its value as well as damages for any injury caused.

Section 446

Damages for non-pecuniary loss.

Full text

In the case of injury to the body or health of another, or in the case of deprivation of liberty, the injured person may also claim compensation for the damage which is not pecuniary loss. The claim is not transferable, and does not pass to the heirs, unless it has been acknowledged by contract, or an action on it has been commenced. A woman against whom a criminal offence against morals has been committed has a similar claim.

Section 423

Full text

A person who, contrary to the truth, asserts or circulates as a fact that which is injurious to the reputation or the credit of another or his earnings or prosperity in any other manner, shall compensate the other for any damage arising therefrom, even if he does not know of its untruth, provided he ought to know it. A person who makes a communication the untruth of which is unknown to him, does not thereby render himself liable to make compensation, if he or the receiver of the communication has a rightful interest in it.

Section 42 Consumer Case Procedure Act B.E. 2551

Full text

If the act complained of was committed by the business operator with intent to take unfair advantage of the consumer, or with intent to cause damage to the consumer, or with gross negligence disregarding the damage that would be caused to the consumer, or in breach of the responsibility of a person in a profession or business which is ordinarily trusted by the public, then when the court gives judgment ordering the business operator to compensate the consumer, the court shall have power to order the business operator to pay punitive damages in addition to the amount of actual damages determined by the court, as it considers appropriate, having regard to the circumstances, such as the damage suffered by the consumer, the benefits obtained by the business operator, the financial status of the business operator, the business operator's mitigation of the damage caused, and the consumer's contribution to causing the damage. In determining punitive damages under paragraph one, the court shall have power to award not more than twice the actual damages determined by the court; but if the actual damages determined by the court do not exceed fifty thousand baht, the court shall have power to award punitive damages of not more than five times the actual damages determined by the court.

Section 161

As a rule the losing party ultimately bears all court fees and costs, which include the lawyer's fee element. But the court keeps a discretion: even against a winner it may order the winner to bear the costs, or split them between the parties, looking at reasonable cause and good faith. In a non-contentious case, the party who started it pays.

Full text

Subject to the provisions of the following five sections, the party who loses the case shall be ultimately liable for all court fees and costs. But whether a party wins the case in full on its claims or only in part, the court has the power to render judgment ordering the winning party to be liable for all court fees and costs, or ordering each party to be liable for its own costs or for a proportionate share of the court fees and costs that all parties have incurred, as the court exercises its discretion, having regard to reasonable cause and good faith in the conduct of the case. In a case without dispute, the party that commenced the case shall pay the court fees and costs.

Sources

Civil liability in Thailand can arise from various situations, such as:

Torts

Wrongful acts leading to injury or damage (e.g., negligence or defamation).

Breach of Contract

Failing to fulfill contractual obligations.

Product Liability

Manufacturers or sellers being held liable for defective products causing harm. This can involve consumer law in Thailand.

In instances where an individual is deemed responsible for causing harm, the courts have the authority to order the liable party to either rectify the damages or provide financial compensation.

Typically, when the gravity of the offense and the magnitude of the damages are substantial, court intervention is necessary to ensure monetary damages for the harm inflicted.

A class action in Thailand is a legal procedure that allows a group of individuals with common interests and grievances to file a lawsuit collectively against a defendant. The procedure is in sections 222/1 onward of the Civil Procedure Code, and a case proceeds as a class action only once the court has allowed it to. It enables plaintiffs to put together their claims, typically in cases involving consumer rights, environmental damage, or large-scale corporate misconduct. The judgment binds the class members who did not opt out within the period the court sets, which must be at least 45 days (Civil Procedure Code section 222/15), ensuring a uniform resolution and potentially significant compensation or remedies for widespread harm.

Frequently asked questions

What is civil liability in Thailand?

It is the legal responsibility one party has to another for acts or omissions that cause harm, usually an obligation to compensate the injured party. The general rule on wrongful acts is section 420 of the Civil and Commercial Code.

Can I claim compensation for non-financial loss?

Yes, for injury to body or health and for loss of liberty (Civil and Commercial Code section 446). A false statement that damages your reputation or livelihood gives its own claim (section 423). Mere inconvenience is not a head of damages.

Does Thai law award punitive damages?

Not as a general rule. They are available only where a statute provides for them, for example against a business that deliberately took unfair advantage of a consumer or was grossly negligent (Consumer Case Procedure Act section 42).

Who pays the court fees in a civil case?

The plaintiff pays the filing fee when the claim is filed (Civil Procedure Code section 149). The losing party is ultimately liable for court fees and costs, although the court may apportion them (section 161). After a settlement or withdrawal the court may refund all or part of the fee (section 151).

Sending a notice letter before court proceedings in Civil Law in Thailand is normal.

The legal process typically starts with a formal notice. It outlines the offense and the resulting damages while granting a specific timeframe for redressal. That is a letter sent by a lawyer to the other party.

Should the culprit party fail to properly address the grievances raised in the notice, using to the courts becomes imperative.

In Thailand, a plaintiff pays a court filing fee when the claim is filed (Civil Procedure Code section 149). It is a fee, not a deposit. For a money claim it is calculated on the amount claimed under Table 1 annexed to the Code, generally 2%, with a ceiling; on a claim of 1 million baht that is 20,000 baht. The losing party is ultimately liable for the court fees and costs, although the court has discretion to apportion them (section 161), so a successful plaintiff can recover the fee from the defendant. When a case ends by settlement or withdrawal, the court may order all or part of the fee refunded (section 151); there is no fixed percentage.
