ในกรณีทำให้เขาเสียหายแก่ร่างกายหรืออนามัยก็ดี ในกรณีทำให้เขาเสียเสรีภาพก็ดี ผู้ต้องเสียหายจะเรียกร้องเอาค่าสินไหมทดแทนเพื่อความที่เสียหายอย่างอื่นอันมิใช่ตัวเงินด้วยอีกก็ได้ สิทธิเรียกร้องอันนี้ไม่โอนกันได้ และไม่ตกสืบไปถึงทายาท เว้นแต่สิทธินั้นจะได้รับสภาพกันไว้โดยสัญญาหรือได้เริ่มฟ้องคดีตามสิทธินั้นแล้วอนึ่ง หญิงที่ต้องเสียหายเพราะผู้ใดทำผิดอาญาเป็นทุรศีลธรรมแก่ตนก็ย่อมมีสิทธิเรียกร้องทำนองเดียวกันนี้

English translation

In the case of injury to the body or health of another, or in the case of deprivation of liberty, the injured person may also claim compensation for the damage which is not pecuniary loss. The claim is not transferable, and does not pass to the heirs, unless it has been acknowledged by contract, or on action on it has been commenced.
