ถ้าเหตุอันทำให้คู่หมั้นบอกเลิกสัญญาหมั้นเป็นเพราะการกระทำชั่วอย่างร้ายแรงของคู่หมั้นอีกฝ่ายหนึ่งซึ่งได้กระทำภายหลังการหมั้น คู่หมั้นผู้กระทำชั่วอย่างร้ายแรงนั้นต้องรับผิดใช้ค่าทดแทนแก่คู่หมั้นผู้ใช้สิทธิบอกเลิกสัญญาหมั้นเสมือนเป็นผู้ผิดสัญญาหมั้น มาตรา ๑๔๔๕[134] คู่หมั้นฝ่ายหนึ่งอาจเรียกค่าทดแทนจากผู้ซึ่งได้ร่วมประเวณีกับคู่หมั้นของตน หรือผู้ซึ่งกระทำกับคู่หมั้นของตนเพื่อสนองความใคร่ของผู้นั้นหรือคู่หมั้นของตนโดยรู้หรือควรจะรู้ถึงการหมั้นนั้น เมื่อได้บอกเลิกสัญญาหมั้นแล้วตาม

English translation
