สิทธิเรียกร้องค่าทดแทนตามมาตรา ๑๔๓๙ ให้มีอายุความหกเดือนนับแต่วันที่ผิดสัญญาหมั้น

สิทธิเรียกร้องค่าทดแทนตามมาตรา ๑๔๔๔ ให้มีอายุความหกเดือนนับแต่วันรู้หรือควรรู้ถึงการกระทำชั่วอย่างร้ายแรงอันเป็นเหตุให้บอกเลิกสัญญาหมั้น แต่ต้องไม่เกินห้าปีนับแต่วันกระทำการดังกล่าว

สิทธิเรียกร้องค่าทดแทนตามมาตรา ๑๔๔๕ และมาตรา ๑๔๔๖ ให้มีอายุความหกเดือนนับแต่วันที่ผู้หมั้นหรือผู้รับหมั้นรู้หรือควรรู้ถึงการกระทำของผู้อื่นอันจะเป็นเหตุให้เรียกค่าทดแทน และรู้ตัวผู้จะพึงใช้ค่าทดแทนนั้น แต่ต้องไม่เกินห้าปีนับแต่วันที่ผู้อื่นนั้นได้กระทำการดังกล่าว

English translation

The claim for compensation under Section 1439 is barred after six months from the day of the breach of the betrothal agreement.

The claim for compensation under Section 1444 is barred after six months from the day on which the gross misconduct which is the cause of renouncing the betrothal agreement was known or ought to have been known, but in no case later than five years from the day of that misconduct.

The claim for compensation under Section 1445 and Section 1446 is barred after six months from the day on which the betrothing party or the betrothed party knew or ought to have known of the act of the other person giving rise to the claim and of the person liable to pay the compensation, but in no case later than five years from the day on which that other person committed the act.
